SUBJECT: Residential Parking Permit District - Loras College
In 1985, the City adopted an ordinance providing for the establishment of Residential
Parking Permit Districts. The purpose of such districts is to reduce traffic congestion
resulting from the use of parking within residential districts by persons not residing
within the district, to protect the residents of these districts from an unreasonable
burden in gaining access to their residences, to preserve the character of such districts
as residential districts, and other various purposes. A Residential Parking Permit
District designation can be made only after a petition of residents representing 60
percent (60%) of the dwelling units in a proposed area is received, a parking study is
conducted by the City Engineer, and a public hearing is held by the City Council.
Assistant City Engineer Gus Psihoyos is recommending City Council approval of a
Residential Parking Permit District of West 11th Street, West 16th Street, Cornell Street
and Picket Street, and that a public hearing be set for May 17, 2004.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is in response to an October 24, 2003 petition to establish a Residential
Parking Permit District (RPPD) in the 500 block of W. 16th Street and a
subsequent February 2, 2004 petition to establish an RPPD on Cornell Street,
Picket Street, W. 15th Street, and part ofW. 16th Street.
BACKGROUND
In 1985, the City adopted an ordinance providing for the establishment of
Residential Parking Permit Districts. The purpose of such districts is to reduce
traffic congestion resulting from the use of parking within residential districts by
persons not residing within the district, to protect the residents of these districts
from an unreasonable burden in gaining access to their residences, to preserve
the character of such districts as residential districts, and other various purposes.
A Residential Parking Permit District designation can be made only after a
petition of residents representing 60 percent (60%) of the dwelling units in a
proposed area is received, a parking study is conducted by the City Engineer,
and a public hearing is held by the City Council.
To be eligible for an RPPD designation, the proposed district must include at
least four (4) block faces or contain 50 parking spaces, must have at least 80
percent (80%) of the curbside parking utilized during peak periods, and must
have at least 25 percent (25%) of such utilization by non-residents of the area. A
petition may be considered for an area which contains less than four (4) adjacent
block faces or fifty (50) curb parking spaces if there are extenuating conditions
that render such requirement unreasonable. Upon the recommendation of the
City Manager, such requirement may be waived by the City Council if it finds that
the proposed residential district is isolated or separated from other residential
areas by topographical features or by commercial area. Upon designation as an
RPPD, no one can park curbside in the district during the restricted hours without
a residential or guest parking permit.
DISCUSSION
The petition which was submitted on October 24, 2003, represents in excess of
60 percent (60%) of the dwelling units along W. 16th Street, as is required under
the ordinance. However, the area described in the petition did not contain at
least four (4) adjacent block faces or fifty (50) curb parking spaces. Not meeting
this criterion prevented staff from recommending further study of the conditions.
After receiving the petition from the residents in the 500 block of W. 16th Street, a
petition for an RPPD designation was received from residents living on Cornell
Street, W. 15th Street, Picket Street, and the 400 block of W. 16th Street. At a
subsequent neighborhood meeting, it was agreed by members of both areas to
combine their petitions, allowing the original 500 block at W. 16th to meet the
minimum number of parking spaces requirement.
The City has received letters from Loras College supporting both petitions.
The City's parking study of this area indicates that during the requested time
period at least eighty percent (80%) of the curbside spaces were utilized and at
least twenty-five percent (25%) of such curbside spaces were utilized by non-
resident parkers. The petition, therefore, meets the requirements of the RPPD
ordinance.
The petition also included a request to have May Place posted as "No Parking".
RECOMMENDATION
Since the parking study indicates that the parking conditions in the area
described in the petitions meet the criteria necessary for the establishment of a
Residential Parking Permit District, I recommend that W. 16th Street be
designated as a RPPD. I also recommend that the district parking regulations be
from 6 a.m. to midnight daily, except Sundays and holidays.
I would further recommend that the City Council set a public hearing on the
designation of W. 15th Street, W. 16th Street, Cornell Street, and Picket Street as
a Residential Parking Permit District between the hours of 6 a.m. and midnight
daily, except Sundays and holidays. After the public hearing, the City Council
may reject the petition, adopt an ordinance designating the proposed area as a
Residential Parking Permit, or adopt alternate hours other than the 6 a.m. to
midnight parking restriction daily except Sundays and holidays.
I would also recommend the designation of "No Parking" on both sides of May
Place.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution setting a public
hearin~ on May 17, 2004 on the proposed Residential Parking Permit District of
W.15 Street, W. 16th Street, Cornell Street, and Picket Street.

RESOLUTION SETTING A PUBLIC HEARING ON ESTABLISHING A
RESIDENTIAL PARKING PERMIT DISTRICT ON WEST 15TH STREET, WEST
16TH STREET, CORNELL STREET, AND PICKET STREET
Whereas, the City of Dubuque, pursuant to Section 32-383 of the Code of
Ordinances, have received petitions containing sufficient signatures requesting
that an area described as follows be designated as a Residential Parking Permit
District:
West 15th Street, West 16th Street, Cornell Street, and Picket Street
Whereas, pursuant to said Section 32-383, the City Manager has caused
a parking study of the area identified above to be undertaken and which study
shows at least 80 percent (80%) of the curbside parking spaces in the proposed
parking permit district were utilized during peak periods, and at least 25 percent
of the curbside parking spaces in the proposed parking permit were utilized by
non-resident parking; and
Whereas, the City Manager, based upon the results of the study, and in
accordance with Section 32-383, recommends that the area be designated as a
Residential Parking Permit District and that the City Council set a public hearing
on the petition to establish such area asa Residential Parking Permit District and
the hours such parking restrictions are to be in effect.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City Council finds and determines that a valid
petition has been received for the designation of West 15th Street, West 16th
Street, Cornell Street, and Picket Street, as a Residential Parking Permit District.
Section 2. That the Residential Parking Permit District hours be
effective between the hours of 6 a.m. and midnight daily, except Sundays and
holidays.
Section 3. That the City Clerk be authorized and directed to publish a
notice of public hearing on the designation of the above described area as a
Residential Parking Permit District, to be held on May 17, 2004.
Passed, approved and adopted this 3rd day of May, 2004.

Dear Friends,
We as a neighborhood feel that we have met the guidelines for A Residential Parking Pennit District. We
understand that the 500 block of West16'" st. has already filed a petition for A Residential Parking
Permit District with the City Clerks office, and that they have the full support of Loras College behind
them. We have worked with Loras Collage for many years as a neighborhood and hope to have that same
support. Please consider when parking study is being conducted that two rental properties on Cornell
st, ( 1480 Cornell and 1505 Cornell) are vacant at the present time. In the past, when the two
properties in question were rented to capacity, there were as many as 6 (six) additional vehicles in the
neighborhood.
We are also asking that May Place be posted no parking on both sides of the street. We are
requesting this because the street is 18 feet wide with no curb. We feel this is a safety hazard for
homeowners with off street parking as well as Fire trucks and all Emergency vehicles. At the very least,
we do want the Residential Parking Permit District established for Nay Place.

I am the owner of the property at the above actress. It has .come to my
attention by my tenants that students are contil'lually parking in front of this
resident. Sometimes the oars even remain for a day or two. This problem
has intensified following the construction of the new dormitoies very
close by at Loras College. A resident parking only s:ign would oertainly help
this situation.
I understand that a request has been made by' steve Gubenhein at
553 and 561 Loras for a variance in order to put two additional parking
places there. This is only one block from where we are having such
difficult and would only conrpOU!ld. the parkiP.g problem.

We sign with the knowledge that if a Residential Parking Permit District is
designated an annual fee of ten dollars ($IO.OO) shall be charged per vehicle

Permits shall be issued to any dwelling unit, and only vehicles with a permit
shall be allowed to park curb side in the district between the hours
identified above and as identified by City Council. (The annual fee is
subject to change by City Council action.)
