SUBJECT: Purchase of IDOT Right of Way Adjacent to Dubuque Technology Park
For the past six months City staff has been working with the Iowa Department of
Transportation and Rick Dickinson of the Greater Dubuque Development Corporation to
acquire right-of-way adjacent to the Dubuque Technology Park. The purpose of
acquiring the right-of-way is to provide room for a sign for the industrial park. A
proposed sign has been designed by Gary Olsen and donated by the Dubuque Rotary
Club.
Economic Development Director Bill Baum recommends City Council approval to
purchase 58,588 square feet of property from the Iowa Department of Transportation to
place a sign for the Dubuque Technology Park. The purchase price has been
established at $14,647.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Purchase of IDOT Right of Way adjacent to Dubuque Technology Park
INTRODUCTION
For the past six months I have been working with the engineering department, the Iowa
Department of Transportation, and Rick Dickinson of the Greater Dubuque
Development Corporation to acquire Right of Way adjacent to the Dubuque Technology
Park. The purpose of acquiring the ROW is to provide room for a sign for the industrial
park. A proposed sign has been designed by Gary Olsen, and donated by the Dubuque
Rotary Club.
DISCUSSION
The process of acquiring property from Iowa DOT is not easy. First, we had to
determine previous ownership, since IDOT regulations provide that the previous owner
be offered the property prior to disposal to other parties. We determined and
documented that the previous property owner is deceased.
The next step involved the preparing of plat of the property to legally describe the
property proposed to be purchased. Our engineering staff completed the plat of survey
of Lot F of the Dubuque Technology Park, and forwarded the plat of survey to IDOT for
approval, which is in process.
Finally, the price for the property must be established and agreed upon. IDOT typically
is required to have an appraisal of the property completed, and fair market value of the
land established. This becomes the purchase price. However, in this case IDOT is
waiving the appraisal process, and making an internal decision to provide the property
to the City of 25 cents a square foot. The lot is 58,588 square feet, so the proposed
purchase price is $14,647.
RECOMMENDATION
We have researched the price the City typically pays for trail ROW. The 25 cents per
square foot is less per square foot than we have paid for similar parcels. Therefore, I
recommend the City agree to purchase the property for $14,647. Although we had a
Capital Improvement Program budget for signage at this industrial park, the CIP was
cancelled a few years ago because of the Sproule litigation. The Economic
Development Department does have one CIP project that has been unspent the past
two fiscal years. We have budgeted $50,000 per year from the general fund to write
down the interest expenses for property owners to meet the development standards in
the Port of Dubuque. The fiscal year 2005 budget again provides $50,000 for the same
purpose. Because we have had little interest in this write down program, I recommend
the use of $14,647 from this CIP item.
ACTION REQUESTED
I request City council approval of the attached resolution approving the purchase of Lot
F of Dubuque Technology Park.

Whereas, the City of Dubuque owns and manages Dubuque Technology Park in the
City of Dubuque, Iowa; and
Whereas, the Iowa Department of Transportation has excess Highway 61 Right of Way
west of said Dubuque Technology Park; and
Whereas, the attached plat ofthe excess Highway 61 Right of Way, Lot F of Dubuque
Technology Park in the SW % of Section 12, Township 88 North, Range 2 East of the
5th P.M. has been prepared for Iowa Department of Transportation .!Wproval; and
Whereas, the Iowa Department of Transportation is requesting twenty five cents per
square foot (. 25<ã>.sa.ft.) for Lot F;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF DUBUQUE,
IOWA:
1. The acquisition of Lot F of Dubuque Technology Center, for $14,647 containing
1.345 acres is hereby approved.
2. The City Manager and City Clerk are hereby authorized and directed to execute
appropriate legal documents to complete the purchase of Lot F of Dubuque
Technology Center.
