Discussion
As the applicant, Zoning Advisory Commission Chairperson Eugene Bird, Jr., removed
himself from the table. . He spoke in favor of the request, reviewing the existing sign
regulation$ within the PI District, surrounding land use and topography. Mr. Bird
reviewed the proposed location of the off-premise sign and a rendering of the
proposed sign relative to the highway. He indicated he would only place one sign on
the property, if approved.
Staff reviewed the surrounding zoning and land' use and history of amendments to the
PI District.
There was one public comment regarding the impact on this area as a gateway to the
community and as an entry into the Mines of Spain State Recreation Area.
The Zoning Advisory Commission discussed the request, noting that off-premise signs
have not been allowed in this PI District since its adoption in 1984, and conditions
have not changed to warrant an amendment to . allow off-premise signs in Zone A of
this district.
Recommendation
By a vote of 5 to 0, with one abstention by Chairperson Bird, the Zoning Advisory
Commission recommends that the City Council deny the request

Chairperson and Members of the Commission,
Tonight, Bird Sign Inc. is asking for your approval to admend the ordiance
for Julien Dubuque Drive Planned Industrial District. To allow Off-Premise
Billboards in Lot A only and to be bound by the bulk standards in a heavy
industrial district.
The district includes lot A thru I. Our request is limited on!>' to Lot A. The
current business on this lot is Tschiggfrie Excavating. The location of the
billboard structure will be along the frontage of Hwy 151/61. In relationship
to the Zoning district, the billboard will be on the west edge. (Hand out A)
In discussions with staff, the original ordinance did not address Off-
Premise signs. By default, the Off-Premise signs are not allowed. The
zoning classification for lot A is HI. Under this zoning classification,
Billboards would be allowable and meet all necessary requirements.
Bird Sign has been a loco! business for many years and plan to have many
more years to come. We offer a service of advertising to many businesses
with in the Dubuque area. As a part of this service, we are dedicated to
quality and committed to making Dubuque the best that it can be.
The impact of this structure should be viewed as a plus for the Gateway to
Dubuque. Many local citizens and tourists will view the information provided
by this billboard and others. Billboards provide a media tool for local
businesses to address the mortoring public. This tool is greatly needed and
should be allowed to expand. Lot A is 12 acres in area and this structure as
stated earlier will be on the very westly edge of that lot. Impact to Lot A
or the other lots will be not even noticed because of the current usage. Our
intent with this project is NOT to take away from the current statuS of the
Mines of Spain or Residential properties. The location of the structure will
limit the view of any residents and little to no impact on the adjacent
properties.. Keeping in mind, only one structure is proposed and only one
structure can be placed on this zoning lot.

ORDINANCE NO. 31-04
AN ORDINANCE REPEALING SECTION E(3) OF ORDINANCE NO. 17-84 AND
ENACTING A NEW SECTION E(3) IN LIEU THEREOF PERTAINING TO OFF-
PREMISE SIGNAGE REQUIREMENTS OF THE JULIEN DUBUQUE DRIVE PI
PLANNED INDUSTRIAL DISTRICT.
Whereas, Ordinance No. 17-84 was adopted June 4, 1984 by the City Council
establishing the Julien Dubuque Drive PI Planned Industrial District; and
Whereas, Bird Sign Company has requested an amendment to the PUD
Ordinance regulating signage requirements in the PI Planned Industrial District.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1" That AppendÎx A (The Zoning Ordinance) is hereby amended by
repealing Section E(3) of Ordinance No. 17-84 and enacting a new Section E(3) in lieu
thereof, as follows:

Signage shall be limited to one (1) freestanding or wall-
mounted sign per each 100 feet of lot frontage, not to
exceed three signs per industrial use.
Sign area shall not exceed 100 square feet per sign.

sign. No maximum number of directional signs is
established.
Off-premise signs shall only be allowed within Parcel A. Off-
premise signs shall be regulated as per the HI Heavy
Industrial off-premise sign regulations.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.

SUBJECT: Amended Planned Industrial District
INTRODUCTION
Flint Drake, of Kane, Norby and Reddick, on behalf of Bird Sign, Inc., has submitted an
application for a text amendment for the Julien Dubuque Drive Planned Industrial
District. The applicant is requesting that Zone A of the Planned Industrial District be
amended to allow off-premise signage as regulated by the bulk standards established in
the HI Heavy Industrial District.
DISCUSSION
The Julien Dubuque Drive Planned Industrial District was established in June of 1984.
The district originally was approximately 110 acres located both north and south of
Julien Dubuque Drive at the city's south end. The original planned industrial district
consisted of nine zones, A through I. Primarily, the zones south of Julien Dubuque
Drive allowed industrial activity, and the zones north of Julien Dubuque Drive were
reserved as green space. In 2000, the eastern end of the industrial district was rezoned
removing approximately 30 acres and three zones from the district to allow development
of a new softball complex. The current PI district consists of an 80-acre area and six
zones.
The applicant has asked to amend the Planned District sign regulations as they pertain
to Zone A, an approximately 12 acre parcel that lies at the west end of the planned
industrial district. This property is bounded by Julien Dubuque Drive on the north,
Inland Drive on the east, MarJo Hills Drive on the south, and Highway 61/151 on the
west. The property is currently used by Tschiggfrie Excavation for their storage
buildings and equipment storage. Current district regulations allow no off-premise
signage within the entire district. The applicant has asked to amend the district so that
off-premise signage would be allowed in Zone A. The applicant has further asked to
apply HI Heavy Industrial District sign standards to Zone A, which means that a
billboard of up to 50 feet in height and 750 square feet in area would be permitted.

Current off-premise sign regulations require 750 feet of separation between signs on a
federal aid primary highway. Currently, there are no off-premise signs within 750 feet of
this Zone A, which means a billboard could be placed anywhere within this zone.
This property is located at the southern gateway to the city of Dubuque and in relatively
close proximity to residential development. The addition of a billboard of up 50 feet in
height and 750 square feet in area may have a negative impact on the adjacent
residential properties and to the aesthetic quality of the gateway to the community.
RECOMMENDATION
Staff recommends that the Commission review the criteria established in Section 6-1.1
regarding granting a rezoning.

Dear Zoning Advisory Commission:
Recently, I received a notice from the Dubuque Planning Services Department. The
notice was in regards to proposed zoning changes that border the Mines of Spain
Recreation Area. The changes are to amend the prohibition of off-premise signs along
Highways 151/61/52. The signs are currently planned to be placed on the east side of the
road on or along Tschiggfii.e property.
When the Industrial District was developed along Julien Dubuque Drive and MaIjo Hills
Road, a prohibition was placed on the area. The prohibition was to not allow off-premise
(billboard) signs. At that time the public and the city administration saw that such a
regulation was necessary. I believe that same ruling should stand today. This stretch of
road passes by a portion of the Mines of Spain Recreation Area. In the early ruling, I am
sure the citizens and the City of Dubuque saw billboard signs as an impact on nature and
the scenic value we place on Dubuque and the surrounding area. As you drive this
stretch of road today, there is an absence of signs, development and the like. This stretch
of road speaks for the citizens of Dubuque and it is the fIrst impression as you enter the
City of Dubuque.
I urge you as the Zoning Advisory Commission, to not amend the prohibition, but let it
stand as it is. The citizens and the city spoke in the past and I believe they acted in such a
way that they intended the prohibition to last.
