RE: Establishment of the Grandview Avenue Parkway Demolition District
Dear Mayor and City Council Members:
INTRODUCTION
The Historic Preservation Commission is requesting that the City Council approve the
establishment of the Grandview Avenue Parkway Demolition District. A map and an
ordinance are attached for your consideration.
BACKGROUND
The demolition districts were created to help protect architecturally and historically
significant structures from being demolished. The Building Official cannot issue
demolition permits in these areas without review by the Historic Preservation
Commission and final approval by the City Council.
Structures located in these demolition districts are not subject to a design review by the
Historic Preservation Commission. The property owner may make exterior alterations
to the structure.
DISCUSSION
The Historic Preservation Commission received a petition from property owners along
the Grandview Avenue Parkway to create a demolition district. The proposed district
encompasses the properties located on both sides of the Grandview Avenue Parkway
from Delhi Street to Southern Avenue.
The Historic Preservation Commission notified the 200 property owners in the proposed
demolition district of a public meeting held on March 18, 2004. Attached are the
meeting minutes and submitted petitions in favor and against the proposed demolition
district. According to the attached petitions, 105 (52.5%) property owners are in favor,

34 (17%) property owners are in opposition and 61 (30.5%) property owners are
undecided or could not be reached.
The 1979 Kriviskey Architectural Survey identified 71 of the 296 (primary and
secondary) structures located in the proposed demolition district as having architectural
or historical significance. Out of the 71 identified significant buildings, 37 are owned by
people in favor, 16 are owned by people in opposition and 18 are owned by people who
were undecided or could not be reached.
RECOMMENDATION
The Historic Preservation Commission is recommending the establishment of the
Grandview Avenue Parkway Demolition District. The Commission is basing the
boundaries for this demolition district on the area requested by the property owners who
submitted the petition.
The Grandview Avenue Parkway is an architectural gem located in the City of Dubuque.
One only needs to drive or walk along this parkway to witness the vast array of
architectural styles. Creation of this demolition district will help protect these
architecturally and historically significance properties.
The Commission respectfully requests that the City Council adopt the amendment to the
Demolition District Ordinance that would establish the Grandview Avenue Parkway
Demolition District.

AN ORDINANCE AMENDING CHAPTER 11 (BUILDING REGULATIONS) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY AMENDING SECTION
11-4(a) TO ESTABLISH THE GRANDVIEW AVENUE PARKWAY DEMOLITON
DISTRICT.
Whereas, the Historic Preservation Comrnission has recommended an
amendment to Chapter 11 (Building Regulations) of the City of Dubuque Code of
Ordinances regarding demolition districts; and
Whereas, the City of Dubuque established demolition districts to allow for the
City Council's review of demolition permit applications that might impact buildings of
historic or architectural significance in these districts; and
Whereas, the City has appointed the Historic Preservation Comrnission to review
demolition permit applications in demolition districts; and
Whereas, the City Council finds that the recommended amendments to Chapter
11 are consistent with the goals and objectives of the City's Comprehensive Plan and
the purpose and intent of the City's Code of Ordinances; and
Whereas, a Historic Preservation Consultant retained by the City of Dubuque has
identified the area as being architecturally and historically significant
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA: .
Section 1. Chapter 11 (Building Regulations) of the City of Dubuque Code of
Ordinances is hereby amended by arnending Section 11-4(a) Application of Section to
establish Grandview Avenue Parkway Demolition District as follows.
Section 11-4(a) Application of Section: The provisions of this section shall apply
to all buildings located in whole or in part within the following described
demolition districts:
(9) Grandview Avenue Parkway: Generally described as the right-of-way of
the Grandview Avenue Parkway from Delhi Street to Southern Avenue and
all adjacent lots to said right-of-way, as shown on the official Grandview
Avenue Parkway Demolition District Map identified by the signature of the
Mayor, attested by the City Clerk: together with the date of adoption of this

Ordinance. The Official Grandview Avenue Parkway Demolition District
Map shall be located in the office of Planning Services.
Section 1. That the foregoing arnendment has heretofore been reviewed by the

provided by law.

Commissioner Olson noted that the Commission would like to see the existing condition
of the siding undemeath the asphalt brick siding.
Motion by Mozena, seconded by Wand, to approve the application as presented, with
the exclusion of the windows. Motion was denied by the following vote: Aye - None;
Nay - Mozena, Coty, Loney Bichell, Gibbs, Olson, Stuart and Wand.
Chairperson Wand noted that Mr. Redding should set up a time to have the
Commission investigate the current condition of the siding underneath the asphalt brick
siding. The Commission discussed looking at the condition of the wood at various
locations on other sides of the building. The Commission agreed by consensus to send
some Commissioners to view the siding.
DESIGN REVIEW: Application of Joe O'Donnell for a Certificate of Appropriateness to
enlarge windows on east side addition at 507-509 Chestnut located in the W. 11th
Street Historic Preservation District.
Joe O'Donnell presented his application to the Historic Preservation Commission. He
noted that the existing framed wing addition currently is not being used. He noted that
the existing addition has small windows and that he would like to enlarge the window
openings to maximize the view. He indicated that the infill between the windows
currently is particleboard. Mr. O'Donnell explained that the windows will only be located
on the south and east sides and the north side will remain with no windows. He
indicated that he will be installing more windows than currently exist. He went on to
explain that the windows will be composed of vinyl. He showed an exarnple of the
windows that will be installed.
Motion by Wand, seconded by Gibbs, to approve the proposal as subrnitted and to
maximize the window size. Motion was approved by the following vote: Aye - Mozena,
Coty, Loney Bichell, Gibbs, Stuart and Wand; Nay - None.
ITEMS FROM PUBLIC:
Public Meetina .on Proposed Grandview Avenue Demolition District:
Chairperson Wand notified people in attendance of the procedure for the public
rneeting. He asked Tammy Pfab to be the first to speak because she is one of the
people that originally brought the petition to the Historic Preservation Commission.
Tammy Pfab, 235 N. Grandview, spoke in favor of the request. She discussed updates
from the previous meeting in which she presented the original petition. Mrs. Pfab noted
that she has received six more additional "yes. responses and five additional .no.
responses. She indicated that currently, they have 44 people in opposition and 105
people in favor, and the rernaining people were undecided, unconcerned or unable to
contact. She wanted the Historic Preservation Commission to address questions that

were presented in a flyer that was distributed anonymously to the property owners in
the proposed district. She also requested the right to have an opportunity to rebut the
comments being made in the public meeting.
John Herrig, 13750 Surrey Lane, noted that he owns property at 620 S. Grandview. He
asked the Commission to clarify what a demolition district is, and how this proposal
carne about.
Chairperson Wand noted that the Commission received a petition from property owners
requesting the creation of a demolition district. Chairperson Wand noted that he would
address the flyer at this time, which will address some of the questions Mr. Herrig had.
In the flyer, it noted that the last demolition district was created in the 1970s.
Chairperson Wand clarified that the Downtown Demolition District was established by
the City Council in 2001.
He noted that the flyer indicated that the demolition district would help prevent the
parkway from being removed. He noted that the parkway would not be reviewable by
the Historic Preservation Commission, because demolition districts only pertain to
structures that require a demolition permit.
He then clarified the process and the Commission's role in reviewing demolition
permits. He noted that the Comrnission only provides a recommendation to the City
Council, and that final approval is granted by the City Council.
He also addressed the issue regarding a property that has been burned. He noted that
fire damage to a building would possibly require a demolition permit and may in fact
have created so much darnage as to make a determination of not being architecturally
historically significant anymore.
Commissioner Olson noted that demolition permits for doing interior demolition are not
reviewable by the Historic Preservation Commission.
John Herrig, 13750 Surrey Lane, noted that he is opposed to the demolition district
because he did not want his property owner rights limited.
Terry Eckhart, 160 S. Grandview, spoke in favor of the dernolition district. She noted
that she is concerned because of the Highway 20 irnprovements and off-rarnps that
have been installed. She noted that these areas have been targeted by gas stations as
possible uses, and that when commercial properties begin intruding into residential
neighborhoods, it creates a domino effect.
Judith Hannon, 430 S. Grandview, spoke in favor. She indicated that the City is a tourist
destination and that she does not want to see the residential neighborhood turn into a
strip mall. She noted that there is review with building permits; however, that does not
allow review for a demolition permit currently. She indicated that Grandview Avenue

has a high volume of traffic making it attractive to cornmercial businesses. She also
noted that a flyer being placed on her doorstep on a Friday night was offensive because
there was no name associated with it.
Marvin Heiderscheit, 368 S. Grandview, spoke in opposition to the demolition district.
He noted that if property owners want to convert their property to commercial, that they
can only do it if they receive a rezoning, which requires review by the City. c
Francine Banwarth, 985 S. Grandview, spoke in favor of the demolition district. She
noted that North Grandview homes are disappearing. She noted that currently, they
have a screened in porch, and that in the near future, they would like to change it. She
indicated that she has no objection to appearing before the Historic Preservation
Commission and City Council to request obtaining a demolition permit to receive that
approval.
Richard Cade, 190 S. Grandview, spoke in opposition to the demolition district. He
noted that he did not want to have any more regulations on his property.
Kathy Lehman, 393 N. Grandview, spoke in favor of the proposed demolition district.
She indicated that the proposed demolition district will help save the architecture and
present designs of the buildings throughout the residential neighborhood.
Helene Magee, 611 S. Grandview, spoke in favor of the proposed dernolition district.
She noted that she moved from St. Louis and lived on a very prominent street in a
neighborhood with beautiful architecture. She indicated that S. Grandview is by far
more beautiful and graceful with the existing architecture than the properties in St.
Louis.
Frank Belcastro, 285 N. Grandview, stated that he is here to represent himself and his
wife, Joan Belcastro, one of the originators of the petition. He noted that they are in
favor of the proposed demolition district. He indicated that the City's role should be to
preserve Dubuque's history. He indicated that the proposed demolition district will help.
preserve the neighborhood and gives the neighbors some warning of demolitions that
may occur. He noted that the public good should prevail over the minor inconveniences
that the proposed demolition districts may incur on some property owners. .
Jim Kuhl, 345 N. Grandview, spoke in favor of the proposed demolition district and.
concurred with all the existing comments made in favor. .
Mary Kay Bondy, 95 S. Grandview, noted that she is in opposition to the proposed
demolition district.
Jean Heiderscheit, 368 S. Grandview, spoke in opposition to the proposed demolition
district She questioned whether or not property owners would be notified if a proposed
demolition would happen in their neighborhood. Chairperson Wand noted that the
Commission does not send out notice to the surrounding property owners, and that they

they only provide a recomrnendation to the City Council for requests for demolition
permits.
Rosemary Kieffer, 70 N. Grandview, spoke in opposition to the proposed dernolition
district. She referred to several attempts to have residential properties rezoned to
commercial only to be denied.
Brian Ruden, 821 S. Grandview, spoke in opposition to the proposed demolition district.
He referred to an addition that he built on his residence and that it required him to
obtain a building permit and meet zoning setback requirements. He felt that there are
adequate regulations and he did not want any more restrictions/conditions placed on his
property.
Cinda Welu, 2609 Broadway Street, spoke in favor of the demolition district. She noted
that demolition districts are a way to help preserve the residential neighborhood
character.
Erich Vierkant, 210 N. Grandview, spoke in opposition to the proposed demolition
district. He noted that he has received the regulations for the demolition district process
frorn the Planning Department. He noted that if a property has been identified to be
architecturally and historically significant, that the property owner is required to submit
economic criteria for approval. He noted that some of these economic criteria require
personal information.
Joan Frommelt, 100 N. Grandview, referred to a situation when the YMCA was
discussing the possibility of purchasing her home for a driveway. She noted that they
have decided not to sell their home to the YMCA and that if the property were to be
demolished, that it would have been devastating to the Grandview Avenue
neighborhood north of Highway 20.
John Swanton, 186 N. Grandview, presented a petition to the Historic Preservation
Commission that has 43 signatures in opposition to the proposed demolition district.
He referred to the existing zoning and building requirernents that currently regulate
property in the city of Dubuque. He stated that he feels that the demolition district is
being created because of the Grandview Avenue Methodist Church building~ He
indicated that some homes have been removed; however, new houses have been built
in their place.
Bob Tauke, 864 S. Grandview, spoke in opposition to the proposed dernolition district
and agreed with John Swanton's remarks.
Ann Anderson, 235 S. Grandview, noted she moved from the north side of Dubuque
because of intrusion of commercial properties, and the installation of billboards on
property. She noted that she moved to South Grandview because of its residential
character and she feels that the demolition district will help prevent this neighborhood
from being altered.

Tom Siegert, 390 S. Grandview (Siegert Funeral Home), spoke in opposition to the
proposed demolition district. He agreed with all the other people in opposition to the
proposed demolition district. He noted that he did not want to have additional
regulations if he wanted to alter his property in the future.
Tom Benda, 1160 S. Grandview, noted that he is opposed to the proposed demolition
district. He also indicated that his office is at 310 N. Grandview. He stated that he did
not want any further review if he wanted to modify his property.
Chris Bode, 579 S. Grandview, spoke in favor of the proposed dernolition district. He
noted that there have been good points made by people both in favor and opposition.
He stated he does not see how the demolition is not beneficial to property owners. He
noted that the residential area needs to be saved, and the proposed demolition district
will help ensure demolitions permits are reviewed.
Mike Gibson, 160 S. Grandview, noted that he is in favor of the proposed demolition
district. He noted that property owners need to not only look at the present, but the
past as well as the future. He noted that the city of Dubuque has lost several properties
over the years. He said that he sees Grandview Avenue as a community property. He
- indicated that he sees his house as not his, but that it belongs to the community as a
whole. He noted that all the visitors that come to Dubuque view Grandview Avenue to
see the many different styles and types of architecture. He indicated that the property
owners are land stewards and should help maintain and save their property for future
generations to enjoy.
Erich Vrerkant, 210 N. Grandview, spoke in opposition to the proposed demolition
district.
Chairperson Wand helped clarify the demolition district requirements. Chairperson
Wand then closed the public input session.
Cathy Schmidt, 606 S. Grandview, noted that she is in favor of the proposed demolition
district.
Greg Gayman, 226 S. Grandview, said he felt that the entire reason for the proposed
demolition district is because Of the Grandview Avenue Methodist Church. He noted
that he wanted to have the map redrawn to exclude the church.
Chuck Northrup, 409 S. Grandview, spoke in opposition to the proposed demolition
district.
Tarnmy Pfab rebutted some of the comrnents that were made. She noted that the
current system works in reference to the zoning requirernents and building permits that
would need to be pulled for property; however, they do not prevent the demolition of
properties. She indicated that Grandview Avenue is a thoroughfare through the

neighborhood, and that there is potential for commercial expansion. She noted that
what people do to their property also affects their neighbor's property and property
values.
Staff Member Wernimont noted that all of the information presented to the Historic
Preservation Commission will be forwarded on to the City Council. He indicated that the
minutes from this meeting will also be forwarded on, which will identify property owner's
remarks.
Chairperson Wand asked the Commission to present their views in regard to the
proposed demolition district.
Commissioner Stuart said that there seems to be a misconception as to what requires a
demolition permit. He also noted that there may be no legal protection regarding the
actual parkway itself, but it may have some political protection if the demolition district is
presented. He noted that the proposed boundaries that are drawn up are reasonable.
Commission Olson noted that the boundaries created were based on the Grandview
Avenue parkway.
Commissioner Mozena said that he understands both sides of the argument. He noted
that the real emphasis is on the historic structures. in the neighborhood. He indicated
that the proposed demolition district only opens up the dernolition permit for public
conversation.
Commissioner Gibbs noted that he is a steward to his property. He also said that
people have their own private property rights and that they are important.
Commissioner Coty said that he believes in the history of Dubuque and he moved frorn
Chicago to Dubuque because of this. He referred to what the Downtown Dubuque
used to be and all the loss of historic structures. He noted that the property owners are
not notified of demolition directly; however, the demolition district process actually gives
adjacent property owners the opportunity to provide public input into the demolition
district process. He added that currently, all the property owner would have to do is pull
a demolition permit and the building could be taken down without any notice-to anyone.
Commissioner Loney Bichell noted that she agrees with both sides. She indicated that
when people come to Dubuque or when visitors and friends of property owners corne to
Dubuque, they take them to the historic areas of Dubuque, and not to the west end of
town. She noted that planning now is for the future and to help save these properties
for future generations to come.
Chairperson Wand thanked everyone in attendance for their input. He went on to
reiterate that the demolition district only allows further review of demolition permits. He
indicated that there are around 60-75 properties that have been identified as

architecturally significant out of the 200+ properties, and that no garages have been
identified as significant.
Motion by Mozena, seconded by Olson, to recommend the City Council create the
Grandview Avenue Demolition District. Motion was approved by the following vote:
Aye - Olson, Mozena, Coty, Loney Bichell, Gibbs, Stuart and Wand; Nay - None.

The Historic Preservation Commission agreed by consensus to send property owners in
the proposed dernolition district a notice of when the proposed Grandview Avenue.
Demolition District will be reviewed by the City Council.
1339 Alta Vista Street
Dave Messner discussed his historic property at 1339 Alta Vista. He noted that he
currently lives outside of the historic districts and that he would like to request Revolving
Loan Funds in order to help restore the wood siding on his 1906 colonial home.
Commissioner Mozena wanted to discuss possible funding for property owners that live
outside of historic districts to restore their property. Staff Member Carstens noted that
the revolving loan fund was created to help with the 700 structures located in the
historic preservation districts. She noted that at one time, there was some discussion
about extending the funding to landmark properties. Chairperson Wand noted there are
limited funds for the properties located in existing historic districts. The Commission
discussed creating funds for properties located outside of historic districts. The
Commissioners also discussed they have concerns about giving funding to properties
that are not regulated by the Historic Preservation Commission.
The Commission discussed the possibility of allowing city landmarks the ability to take
advantage of historic preservation incentives from the City. They indicated this will
allow individual property owners outside of historic districts the possibility of having their
property designated as a City landmark, and therefore, having access to City funds with
review by the Historic Preservation Commission. Staff Member Wernimont reviewed
the process for designating a property as a city landmark. The Commission discussed
that they would like to have more information on city landmarks and the process at their
next meeting.
Motion by Wand, seconded by Olson, to recommend the City Council add city
landmarks as an eligible property for all of the financial incentives administered by the
Historic Preservation Cornrnission that are allowed in the Historic Districts. Motion was
approved by the following vote: Aye - Olson, Mozena, Coty, Loney Bichell, Gibbs,
Stuart and Wand; Nay - None.

Demolition Districts
What is a Demolition District?
A demolition district is an area of the city composed of structures that have historical or
architectural value. In demolition districts, a demolition permit must be reviewed by the
Historic Preservation Commission and City Council before demolition can occur. Not all
structures located in demolition districts have architectural or historical significance. The
City of Dubuque currently has 8 demolition districts.
How is it different from a Historic Preservation District?
In historic districts, the Historic Preservation Commission has the power and authority to
regulate exterior changes being made to structures. In the demolition districts, the
Historic Preservation Commission do not review exterior changes to the buildings.
What is a Demolition Permit?
A Demolition Permit is a building permit granting permission for the applicant to demolish
a building.
When do I need a Demolition Permit?
You may need to obtain a Demolition Permit from the Building Services Department if
you are proposing to demolish all or part of.a building or structure.
How long does the application process take?
The demolition review process usually takes approximately 30-60 days from date of full
application to the Historic Preservation Commission.
What criteria are considered when reviewing a Demolition Permit?
The Commission must review all of the information submitted by the applicant and make
a determination as to the folJowing:
(1) Whether the building proposed for demolition has historic or architectural significance
to the community; and
(2) Whether denial of the proposed demolition permit would prevent the property owner
from earning a reasonable economic retum on the property.
If the Commission finds that denial of the application would prevent the property owner
from eaming a reasonable economic return on the property, or that the building does not
have any historical or architectural significance to the community, the CommissiorJ must
recommend approval of the application.
If the Commission finds that denial of the application would not prevent the property
owner from eaming a reasonable economic retum on the property and that the building

We are very fortunate to live on one of Dubuque's most beautiful streets, the Grandview
Avenue Parkway. Our part of Grandview Avenue is the location of the famous Peony Trail
sponsored by Mrs. E. B. Lyons, wife of the noted Dubuque businessman and
conservationist.
As you may be aware, some lovely older structures along Grandview Avenue have
already been lost and new attempts have been made to lose even more. We wish to
preserve the beauty and residential nature of this neighborhood by designating the Peony
Trail portion of Grandview Avenue from Delhi Street to Southern Avenue as a Demolition
District. This would include the trail itself and the properties on both sides of Grandview
Avenue.
What is a Demolition District? This is explained on the attached sheet. Basically, it means
that in order to demolish a building you need to obtain a special permit. We feel this would
be a great asset to our area and one of the few protective measures we can take to help
preserve this unique historic area of our city.
A meeting will be held to discuss this matter on Wednesday, January 28, at Washington
Junior High School. We will meet in the cafeteria at 7 p.m. If you are unable to make the

Demolition Districts
What is a Demolition District?
A demolition district is an area of the city composed of structures that have historical or
architectural value. In demolition districts, a demolition permit must be reviewed by the
Historic Preservation Commission and City Council before demolition can occur. Not all
structures located in demolition districts have architectural or historical significance. The
City of Dubuque currently has 8 demolition districts.
How is it different from a Historic Preservation District?
In historic districts, the Historic Preservation Commission has the power and authority to
regulate exterior changes being made to structures. In the demolition districts, the
Historic Preservation Commission do not review exterior changes to the buildings.
What is a Demolition Permit?
A Demolition Permit is a building permit granting permission for the applicant to demolish
a building.
When do I need a Demolition Permit?
You may need to obtain a Demolition Permit from the Building Services Department if
you are proposing to demolish all or part of a building or structure.
How long does the application process take?
The demolition review process usually takes approximately 30-60 days from date of full
application to the Historic Preservation Commission.
What criteria are considered when reviewing a Demolition Permit?
The Commission must review all of the information submitted by the applicant and make
a determination as to the following:
(1) Whether the building proposed for demolition has historic or architectural significance
to the community; and
(2) Whether denial of the proposed demolition permit would prevent the property owner
from eaming a reasonable economic retum on the property.
If the Commission finds that denial of the application would prevent the property owner
from eaming a reasonable economic retum on the property, orthat the building does not
have any historical or architectural significance to the community, the Commission must
recommend approval of the application.
If the Commission finds that denial of the application would not prevent the property
owner from eaming a reasonable economic retum on the property and that the building
has historical or architectural significance to the community, the Commission must
recommend denial of the permit application.

Dear Chairperson:
As principal of Washington Junior High School, it is the interest of the parents of my
students that their children attend a school that is located in a setting that has miIÜma!
distractions due to commercial development and that has reasonable traffic control and
pedestrian access.
As I look at the intersection of Grandview and Dodge Street, I could see how this part
of the city would be attractive to commercial development and how the Grandview
Avenue could be looked at as a traffic throughway to Highway 151. Such
development in my opinion would adversely affect the neighborhood setting in which
Washington Junior High currently exists.
Therefore, speaking for myself as principal, I would support the concept of a
demolition district for the properties that are along Grandview A venue as shown on
the map of the proposed Grandview Avenue Demolition District.
As I support this concept, I do understand that there could be instances when the need
of the public good could outweigh the need to maintain the current properties as they
exist along this section of Grandview Avenue. In those circumstances I would trust
that the Commission would make its decision on whether a property should be
demolished based on what is of the greatest benefit to the public.

At the March 18, 2004 Historic Preservation Commission meeting, the Historic
Preservation Commission received a petition from property owners in your
neighborhood requesting to create a Demolition District along the Grandview
Avenue parkway from Delhi Street to Southern Avenue. Please see attached
map.
At the meeting, the Commission took public input in favor and against the
proposed demolition district. After taking public input, the Commission voted to
recommend that the City Council approve the proposed Grandview Avenue
Demolition District. All submitted petitions and meeting minutes will be forwarded
on to the City Council.
This letter is to inform you that the City Council will review the proposed
Grandview Avenue Demolition District at a regular City Council meeting on
Monday May 17, 2004 in the Auditorium (3rd Floor) of the Carnegie Stout Public
Library.
This item is an action item and it is at the discretion of Mayor and the City Council

Dear Planning Services Department,
I live at 600 South Grandview Ave. Lived there for 11 years now and I really like my
neighborhood and neighbors. For you to force me into a deal that does not allow me to
make changes to my property after doing $30,000 worth of repairs on it the last 11 years
is not acceptable. I will not sign the petition for a Demolition District. This landowner is

Dear Mr. Mayor,
My name is Rosemary Kieffer and I live at 70 N. Grandview Avenue. I am against the "Grandview Avenue
Demolition Districf' because:
. It infringes on my rights to lawful determination of the use of my property.
. This would be a duplication of statures already in place governing my property and all of Grandview Avenue.
. Zoning laws and procedures now in effect work successfully.
. Examples of this are the rezoning attempts at
1. Grandview Methodist Church
2. The property at Grandview and West 3rd Street
Because of these above mentioned reasons, I am against the wasting of our tax dollars to implement an
unneeded, duplicated statue.

significant and is opposed by over fifty percent of the property owners in this district as

concemed that this will be approved without their opinions being heard.

We recently received notice ITom the Historic Preservation Commission that the City Council will
review the proposed Grandview Avenue Demolition District at the regular meeting on Monday, May 17,
2004. It stated in this letter that this proposal is an action item and it is at the discretion of the Mayor and
the City Council as to whether or not to allow public input. I would like to formally request that public
input is allowed at this meeting.
My wife, Sheila Vierkant, and I, Erich Vierkant, are against this Demolition District proposal.
We feel that there have been some nrisconceptions that have been presented to the people that live on
Grandview during the process of collecting signatures for a petition for Demolition District. It was
presented at the Historical Preservation Commission by Tammy Pfab that she understood that the
median, which is part of the Park Commission, would be protected by this Demolition District. Itwould
not! The pennit process for demolition applies only to buildings or part of buildings. Everyone wishing
to demolish a building or part of a building would have to apply for a pennit and it would be determined
if there was any historical or architectural significance before the building was recommended for or
against demolition.
It was indicated that there would be advance notice by the Historical Preservation Commission or the
Planning Services Department when someone applied for a pennit to demolish a building or part of a
building. It would not provide any formal notice!
The reality of this district that it really doesn't protect anything ITom demolition. It merely puts the
property in question into a process that might prevent you from demolishing a building and building a
new one. It adds cost to the demolishing process; the cost of the permit, the cost of a licensed engineer
or architect to attempt to justify demolition, up to a 90 day delay waiting for recommendation, and the
personal cost of disclosing private information such as the remaining balance of a mortgage or income
tax bracket.
A group of Grandview residents have been collecting signatures against the Demolition proposal and we
feel there is more than enough on this petition to demonstrate that there is a strong opinion against the
proposal. These will be presented to the City Council by one of our group.
We have lived at this address for 30 years and have seen Finley Hospital take over the neighborhood
surrounding the hospital. We understand the fears of the people in favor of the Demolition District. We
feel that Demolition District does not provide the protection that people think it does. We believe the
CUITent zoning laws provide protection against businesses ITom building in our residential neighborhood.
This demolition proposal will only add to costs and regulations.
I would appreciate a response so I know you have received this e-mail and, again, I would ask that you
allow input concerning this issue at the City Council meeting Monday night, May 17.

Dear Mayor Duggan and Councilpersons:
I have received a notice of the plan to place our property within a
proposed "Grandview Avenue Demolition District". I have reviewed the Demolition
Pennit Ordinance, and I do not find that the Demolition District is really any different or
significantly different ftom an Historic District. Once our property is placed within this
district, there are restrictions and restraints that would be put upon our property's use and
right to UBe our property as an owner should be pennitted.
I have visited with the City Building Department and with the Planning
Department, and I do not believe that there is a clear, complete, absolute definition as to
what would constitute a "demolition permit" requirement. Since that definition is not
clear, and since it is not clear as to just what conduct would be subject to the tenns of this
Ordinance, I feel that it would be open to arbitrary interpretations ftom time to time and
that would affect the marketability of property located in the district.
Please do not place our property within the "Grandview Avenue
Demolition District" boundaries and please do not adopt an Ordinance establishing that
Demolition District.
I would welcome an opportunity to express my position to the Council at
the time this matter is presented to the Council; but I recognize that it is scheduled as an
action item and is at the discretion of the Mayor as to whether or not to allow public
input, but if public input is allowed, I would like to be heard.
