SUBJECT: Water Pollution Control Plant Modifications Project
Strand Associates, Inc. - Additional Services for Davis -Bacon Compliance
This memorandum is to seek your approval and execution of Amendment No. 3 to the July 19,
2010 Agreement for Construction - Related Services between the City of Dubuque and Strand
Associates, Inc. (Strand) for the Water Pollution Control Plant (WPCP) Modifications Project
(Project).
In December, 2010 the State Revolving Fund (SRF) clarified its Davis -Bacon federal wage
compliance requirements for all projects funded with SRF monies. SRF has determined that
borrowers will be held responsible to ensure Davis -Bacon compliance and that they may
contract with an entity to assist them with compliance activities.
Currently the Engineering Department and Water Pollution Control Plant do not have available
staff resources to conduct the necessary compliance reviews. Due to the large project scale
and the expected 200+ workers on -site during peak work periods, this activity will be a time -
intensive effort.
Since Strand Associates already has full -time personnel on the project, the most efficient
manner is to have Strand add this activity to their scope of work. Strand has provided the
attached Amendment 3 which provides for the following Davis - Bacon - Related Services:
Compare payrolls to wage determinations to ensure that adequate wages and fringe
benefits are paid.
Conduct periodic on -site, random interviews of contractor's employees.
Complete and submit necessary forms and reports to the Iowa Finance Authority (IFA).
BUDGET IMPACT
Strand's proposed fee of $49,000 will be paid for out of the contingency funds for the Water
Pollution Control Plant Modifications Project (CIP 7101837).
ACTION TO BE TAKEN
The execution of Amendment No. 3 to the July 19, 2010 Strand Associates agreement is
requested.

This is Amendment No. 3 to the referenced Agreement.
Under Scope of Services, ADD the following:
"Davis- Bacon - Related Services
1. Complete and submit to the Iowa Finance Authority (IFA) IFA Forms A and C.
2. Complete and submit to OWNER the "Final Davis -Bacon Compliance Report"
checklist for signatures and for OWNER's submittal to the IFA.
3. Conduct on -site interviews with contractor's employees, on an approximately
quarterly basis (one day on -site per quarter) starting in the first quarter of 2011
and ending during the second quarter 2013, to obtain information regarding their
pay, fringe benefits, and related data. Standard Form (SF) 1445 will be
completed for each interview.
4. Review weekly certified payrolls from contractor. Compare contractor's certified
payrolls, interview information, and Davis -Bacon wage requirements. Report
discrepancies to the contractor and OWNER.
5. Provide project management and communications with OWNER, IFA,
contractors, and others pertaining to Davis -Bacon requirements."
Under Compensation, ADD the following to the second table:
"Davis- Bacon - Related Services
$ 49,000 Hourly plus expenses"
