Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing location of property and need for rezoning to facilitate re -use of the building for housing. Staff reviewed surrounding zoning and land use, and noted that the area is removed from other C -4 Downtown Commercial areas and that the proposed rezoning to OC allows for a mixture of office, commercial, and residential uses. There was one public comment regarding the availability of off - street parking. The Zoning Advisory Commission discussed the request, noting that the request is compatible with surrounding zoning. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Four structures were built on the Tots circa 1890. The structures consisted of two -story brick buildings with first floor commercial space and upper story residential and continued to be occupied for both commercial and residential uses. Some units within the buildings are currently vacant. Physical Characteristics: The property totals approximately 8,000 square feet and is bracketed by 8th Street to south and 9th Street to the north. The property accommodates 4 two -story buildings that consume almost the entire lot. The buildings face the 8th Street frontage with rear access and some parking along 9th Street. Concurrence with Comprehensive Plan: The Comprehensive Plan calls for this area to be mixed -use commercial and residential. The Comprehensive Plan also promotes the provision of affordable housing and encourages mixed -use. Impact of Request on: Utilities: Existing utilities are adequate to serve the site as it is currently full developed. Traffic Patterns /Counts: The Iowa Department of Transportation 2005 Average Daily Traffic indicates 11,500 vehicle trips per day along 9th Street directly behind the subject Rezoning Staff Report - 515/527/53/537 W. 8 Street Page 2 property and 1,090 vehicle trips per day along the 8th Street frontage in front of the subject property. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment as the site currently is fully developed. Adjacent Properties: Rezoning of this property to OC somewhat reduces the intensity and amount of commercial uses allowed; therefore, it should have limited impact on the adjacent properties. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to rezone 4 lots that accommodate 4 two -story commercial and residential structures from C -4 Downtown Commercial District to OC Office Commercial District. The applicant intent is to rezone so as to allow residential use on the first floor of the buildings. Residential uses are not permitted on the first floor under current C -4 zoning. The buildings formerly had a number of commercial uses on the first floor but have recently been mostly vacant. Conversion of the structures to residential use should have limited impact on the adjacent properties, which are mixed -use; primarily commercial, residential and City parking lot. Conversion of the properties should generate very little traffic or demand for on street parking over and above what first floor commercial use would. It is important to note that in C -4 Districts, there are no mandatory parking requirements. However, if the rezoning is approved, the parking requirements for the OC district will be applicable for any change of use. Like much of the housing in the downtown area, there is little available green space or recreational area for these properties. Staff recommends that the Zoning Advisory Commission review the criteria established in Article 9 -5 of the Unified Development Code regarding zoning reclassification.
