The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
On April 7, 2004, the Zoning Advisory Commission held a public hearing on the
University of Dubuque's request to amend ID District to allow both a new parking lot and
a proposed roadway on the campus, and to rezone property from R-1 Single-Family
Residential District to ID Institutional District.
The applicant spoke in favor of the request, reviewing the proposed rezoning of three
parcels from R-1 Single-Family Residential to Institutional District. The applicant
reviewed the proposed parking lot at the southwest comer of McCormick and Finley
Streets, and the proposed University Park Drive from U.S. Highway 20 to the Cassatt
and Donnell Halls parking lot. The applicant also reviewed screening and lighting for
the proposed roadway.
Staff reviewed the University's application, reviewing the history of zoning request on
the south campus.
There were several public comments regarding the proposed roadway, voicing
concerns regarding noise, traffic, loss of privacy and property value if the roadway is
built in the location proposed by the University of Dubuque.

The Zoning Advisory Commission discussed the request, noting that the requested
rezoning of these parcels from R-1 to ID is necessary to facilitate construction of a 70-
space parking lot that will help with the parking demand in and around the campus.
NOTE: The Commission discussed potential impact of the proposed roadway on
adjacent property owners. A majority of Commissioners shared concerns expressed by
the neighbors about the impact the proposed roadway will have on the use and
enjoyment of adjacent property. The Zoning Advisory Commission decided to hold a
separate public hearing on the proposed roadway on June 2. This item will be on the
City Council's June 21st agenda.
Recommendation
Bya vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the requested rezoning form R-1 to ID and amend the Institutional District to
allow a new parking lot at McCormick and Finley Streets.
A simple majority vote is needed for the City Council to approve the request.

Dear Honorable Mayor Duggan and Members of the Dubuque City Council:
The University would like to take tIñs opportunity to thank you for the support you have shown
during the development of the South Campus. You have helped us transform our vacant land
adjacent to US 20 into the most beautiful university housing, soccer park and entry way in the
region. The hundreds of posÏtÎve comments we have received lead us to believe that we have also
provided Dubuque with a beautiful landscape that all citizens can be proud oí
Recently the University has applied to amend its Institutional District to include an extension of
University Park Drive that will connect the housing located on South Campus to the housing
located on North Campus and to add a 70 car parking lot at the corner of McCormick and Finley
Streets.. During the course of the public hearing at the Zoning Commission the Zoning
Commission voted to split the two projects apart and to vote on them separately. At tIñs time the
University would like to remove consideration of the University Park Drive ftom the current ill
amendment request. The University is only requesting that the City Council review the zoning
ftom R-l to ill and the parking lot at their May 17 meeting. The University is continuing to
work with the Zoning Commission on the extension of University park Drive and plans to bring
that project to the City Council in the near future.

Purpose: To amend the ID Institutional District for the University of Dubuque to allow

Property History: The property to be rezoned from R-1 Single-Family Residential to ID
Institutional District to facilitate development of a new parking lot at the corner of
McCormick Street and Finley Street was previously used for single-family homes.
Physical Characteristics: The property where the proposed parking lot will be located
near McCormick and Finley Streets generally slopes to the west.
Conformance with Comprehensive Plan: This project implements the
Comprehensive Plan's Land Use Element: Goal 8.1 and 8.3.
Staff Analysis:
Streets: The proposed parking lot will have access to Finley Street and the private
drive that runs by Chalmers Field.

Sidewalks: As part of the construction, the new parking lot sidewalks will be
constructed along McCormick and Finley Streets.
Parking: The proposed parking lot at the southwest corner of McCormick and
Finley Streets will provide parking for 70 vehicles.
Lighting: New outdoor lighting will be required to utilize cut-off luminaries to reduce
the impact to adjacent properties.
Signage: No signage has been proposed as part of this ID plan amendment.
Bulk Regulations: The layout of both the new parking lot will be in substantial
compliance with the attached exhibit.
Permeable Area (%) & Location (Open Space): The amount of permeable area will
be somewhat reduced with the proposed parking lot. The" Engineering Division will
review of this project, if approved, for compliance with City Standards for storm
water control.
Landscaping/Screening: Screening of the parking lot will be required both where it
fronts on McCormick Street as well as screening from adjacent residential
properties.
Phasing of development: None proposed.
Impact of Request on:
Utilities: Existing utilities are adequate to handle the proposed projects.
Traffic Patterns/Counts: 2001 average daily trips for Devon Drive total
approximately 4,000 vehicle trips. Algona Street carries approximately 2,600 ADT.
Public Services: Existing public services are adequate to serve the proposed
projects.
Environment: Staff does not anticipate adverse impacts to the environment
provided adequate erosion control is provided during all phases of construction,
and adequate storm water control is provided as part of the development of the
proposed project.
Adjacent Properties: The proposing parking lot will significantly change the view
from the remaining single-family homes fronting on West Street and Finley Street.

Staff Analysis: The University of Dubuque is requesting an Institutional District
Amendment to allow construction of a new off-street parking lot at the southwest
comer of McCormick Street and Finley Street. The University of Dubuque had originally
sought approval for extension of University Park Drive. The University has modified
their request to only seek approval for the rezoning to allow construction of the parking
lot at McCormick and Finley Streets. The Zoning Advisory Commission will reconsider
the University's request to extend University Park Drive at the June 2nd Commission
meeting.
The proposed amendment to the University of Dubuque campus is the addition of a
new 70-space parking lot at the southwest corner of McCormick and Finley Streets.
Access to the parking lot is proposed to be from Finley Street and the curved private
drive running along the side of Chalmers Field. The Zoning Ordinance requirements
for parking lots requires three-foot high screening where the parking lot is adjacent to
City rights-of way and adjacent to residential properties. If approved, University of
Dubuque officials will be required to submit detailed Engineering drawings indicating
how storm water will be controlled.
Planning staff recommends the Zoning Advisory Commission review the criteria for
granting Institutional District amendments contained in Section 3-5.5 of the Zoning
Ordinance.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY PROVIDING FOR THE
AMENDMENT OF ORDINANCES 48-02 AND 84-02, WHICH ADOPTED
REGULATIONS FOR THE UNIVERSITY OF DUBUQUE ID INSTITUTIONAL
DISTRICT AND APPROVING AN AMENDED CONCEPTUAL DEVELOPMENT
PLAN FOR THE UNIVERSITY OF DUBUQUE 10 INSTITUTIONAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE. IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque
Code of Ordinances be amended by providing for the amendment of ordinances 48-02
and 84-02, which adopted regulations for the University of Dubuque ID Institutional
District and approving an amended conceptual development plan for the University of
Dubuque ID Institutional District, a copy of which is attached to and made a part hereof,
to wit:
Lot 2, Lot 4, Lot 9 and 10 of Kuehnle Heights, and Lot 2-64 Finley
Waples Burton Addition, and to the centerline of the adjoining
public right-of-ways, all in the Cityof Dubuque, Iowa.
Section 2. That pursuant to Iowa Code Section 414.5 (2001) and as an
express condition of amending the University of Dubuque ID Institutional
District, the undersigned property owner(s) agree(s) to the following conditions,
all of which the property owner(s) further agree(s) are reasonable and imposed
to satisfy the public needs that are caused directly by the zoning
reclassification:

outside the principal building.
No conditional uses shall be allowed.

Development of land in the ID Institutional District shall be regulated as

The proposed parking lot at the southwest corner of McCormick and
Finley Streets shall be located in substantial conformance with the
attached conceptual development plan and all final site development
plans are to be approved in accordance with provisions of the ID
Institutional District regulations.
C.
Performance Standards
The development and maintenance of uses in this ID Institutional District
shall be established in conformance with Section 3-5.2 of the Zoning
Ordinance and the following standards:

The proposed parking lot at the southwest comer of McCormick
and Finley Streets shall provide a minimum of 70 spaces and be
screened from adjacent roadways and residential property.
New outdoor lighting for the parking lot shall utilize 72-degree cut-
off luminaries.
Landscaping shall be provided in compliance with Section 4-5 of
the Zoning Ordinance.
All utilities including telephone and cable television shall be
installed underground.
Final site development plans shall be submitted in accordance with
Section 4-4 of the Zoning Ordinance.
Parking Requirements
The off-street parking requirements for the principal permitted uses for the
herein described ID Institutional District shall be designated by a bracket
enclosed number next to the use, as herein described:

Institutional District as established in Section 4-3.11 of the Zoning

Additional Standards
That all previously approved conceptual development plans are hereby
amended to allow for the attached conceptual development plan.
H.
Transfer of Ownership
Transfer of ownership or lease of property in this ID Institutional District
shall include the transfer or lease agreement a provision that the
purchaser or lessee acknowledges awareness of the conditions
authorizing the establishment of the district
Modifications
Any modifications of this Ordinance must be approved by the City Council
in accordance with zoning reclassification proceedings of Section 6 of the
Zoning Ordinance.
RecordinQ
A copy of this ordinance shall be recorded at the expense of the
property owner(s) with the Dubuque County Recorder as a
permanent record of the conditions accepted as part of this
reclassification approval within thirty [30] days of the adoption of
this ordinance. This ordinance shall be binding upon the
undersigned and all his/her heirs, successors and assignees.
Section 3. That the foregoing amendment has heretofore been
reviewed by the Zoning Commission of the City of Dubuque, Iowa.
Section 4. That the foregoing amendment shall take effect upon
publication, as provided by law.
