SUBJECT: Animal Ordinance Update
Public Health Specialist Mary Rose Corrigan recommends City Council approval of
Amendments to Chapter 7 of the City Code of Ordinances to make it consistent with
amendments to the Iowa Code.
I concur with the recommendation and respectfully request Mayor and City Council

INTRODUCTION
This memorandum provides suggested amendments to Chapter 7, Animals and Fowl,
of the City Code of Ordinances to make Chapter 7 consistent with amendments to the
Iowa Code.
BACKGROUND
While preparing for renewal of the Humane Society Purchase of Services Agreement, I
reviewed the current animal chapter in the City Code and noted a few sections that
need updating.
The Iowa Code requires that a dog whose owner is known shall be held for a minimum
of seven (7) days, while our City Code requires a minimum of five (5) days.
Section 7-20 states that the City Manager may contract with certain pounds or animal
shelters as defined in the Iowa Code. This limits the City's contracting ability,
particularly if we had to impound a large amount of animals beyond the scope of our
Humane Society Agreement.
DISCUSSION
The following amendments to the City Code of Ordinances will update the Code to be
consistent with the Iowa Code and also allow for contracting with various qualified
agencies for animal impoundment services, should the need arise.
Sec. 7-20. City Manager's Authority:
The city manager is hereby authorized to contract with a person or entity the city
manager determines to be qualified for carrying out the provisions of this article
including the collection, protection and disposition of dogs, cats and other animals and
the collection of fees for licensing and care of seized and impounded dogs and cats.
Sec. 7-24. Disposition Of Unredeemed Dogs Or Cats:
(a) If the owner of a licensed dog impounded pursuant to this article does not
redeem such animal within seven (7) days after the mailing of the notice provided for in
this article, the license shall automatically be revoked and the animal disposed of as
directed by the health officer.
If the owner of a licensed cat impounded pursuant to this article does not redeem
such animal within five (5) days after the mailing of the notice provided for in this article,
the license shall automatically be revoked and the animal disposed of as directed by
the health officer.
(b) Any unlicensed dog or cat not redeemed by the owner within three (3) days after
it has been seized or impounded shall be disposed of as directed by the health officer.
RECOMMENDATION
I recommend approving the attached Ordinance amendments.
CITY COUNCIL ACTION
Adopt the attached Ordinance.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City of Dubuque Code of Ordinances §7-20 is amended to read as
follows:
Sec. 7-20. City Manager's Authority:
The city manager is hereby authorized to contract with a person or entity
the city manager determines to be qualified for carrying out the provisions
of this article including the collection, protection and disposition of dogs,
