Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating the rezoning would facilitate
construction of a new single-family home.
Staff reviewed surrounding zoning and land use and noted the property was annexed
into the City in 2000.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the property
immediately adjacent to the subject parcel is currently developed as two single-family
homes.
Recommendation
Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property was annexed into the City in 2000. The
subject property has been used for agricultural purposes both before and after
annexation.
Physical Characteristics: The subject property is located at the southeast comer of Old
Highway Road and Cousins Road. The property generally drains to the southeast and
is bordered on both the south and east by existing single-family homes.
Concurrence with Comprehensive Plan: This rezoning implements the
Comprehensive Plan's Land Use Goal 1.2 and 1.5.
Impact of Request on:
Utilities: City water and sewer is not available to this lot at this time. The subject
property will be served by a private well and septic system.
Traffic Patterns/Counts: The subject property will have frontage on both Old
Highway Road and Cousins Road. Based on IDOT 2001 counts, Old Highway
Road carries approximately 2,400 average daily vehicle trips. There are no counts
available for Cousins Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided the proposed septic system is installed in accordance with applicable
standards. .

Adjacent Properties: Staff does not anticipate any adverse impact to adjacent
properties.
CIP Investments: None proposed.
Staff Analysis: The applicant has requested rezoning of the subject parcel from AG
Agricultural to R-1 Single-Family Residential. The subject property is located in the
southeast corner of Old Highway Road and Cousins Road. The subject property is
bordered to the east south and south by existing single-family homes.
The subject property is not currently served by City water and sanitary sewer. Planning
staff has consulted with both Engineering and Water Department staff, who have
indicated that until such time as utilities are available to the site, that a septic system
and well will be necessary to serve the single-family home. The City Health Department
will inspect the septic system to insure compliance with applicable standards.
The City's water main along Old Highway Road currently extends to a point that serves
the small trailer park approximately one-half mile to the east of the subject property.
Depending on when the single-family house is built, if there is water service available,
they will be required to hook on. If water service is not available, then a well can be
utilized with review and approval through the County of Dubuque.
Planning staff recommends the Zoning Advisory Commission review the criteria for
reviewing rezoning requests.

ORDINANCE NO. 39-04
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED NEAR THE SOUTHEAST CORNER OF OLD
HIGHWAY ROAD AND COUSINS ROAD FROM AG AGRICULTURAL DISTRICT TO
R-1 SINGLE-FAML Y RESIDENTIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property as
shown in Exhibit A, and to the centerline of the adjoining public right-of-way, all in the
City of Dubuque, Iowa from AG Agricultural District to R-1 Single-Family Residential
District; and
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
