The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed lot split and noting that it will facilitate the sale of the chapel. Staff reviewed the submitted plat, noting that the Commission is reviewing this lot split because Lot 1 of 1 has no frontage. There were no public comments. The Zoning Advisory Commission discussed the request, noting that there is a platted easement for access to Lot 1 of 1 and the plat is in all other respects in compliance with the Subdivision Regulations. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Lot 1 accommodates a chapel with 21 parking spaces and is approximately one acre in size. Lot 2 accommodates a mortuary and 88 associated parking spaces and is approximately two acres in size. The subdivision of this lot will enable the chapel to be sold separately from the mortuary. Lot 1 is substandard in that it does not have frontage on a platted City street. There is a small wedge of property directly south of Lot 1 that separates it from the Asbury Road right-of-way. This lot is accessed through a platted shared access easement that is 28 feet wide through the mortuary property on Lot 2. The subdivision of these lots and the position of the buildings on the two new lots is compliant with all other City standards. Staff recommends that the Zoning Advisory Commission approve the simple plat to divide Lot 1 in Kitchen Family Properties, subject to waiving Section 42-19 Blocks and Lots for lot frontage. Whereas, there has been filed with the City Clerk a Plat of Survey Lot 1 of Lot 1 of Lot 2 of Lot 1 of Kitchen Family Properties in the City of Dubuque, Iowa; and Whereas, said plat provides 0 feet of frontage for Lot 1 of Lot 1, where 50 feet of frontage is required by Section 42-19(b) of the Subdivision Regulations; and Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission and has its approval endorsed thereon; and Whereas, said Plat of Survey has been examined by the City Council and they find that it confirms to the statutes and ordinances thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1 of Lot 1 to have 0 feet of lot frontage, where 50 feet is required. Section 2.
