Applicant: RJS Development, Inc.
Location: 3230 Dodge Street
Description: To rezone property from CS Commercial Service & Wholesale District to
C-3 General Commercial District.
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your
review.
Discussion
The applicant spoke in favor of the request,' reviewing the history of site and the
proposed construction of a multi-tenant commercial building.
Staff reviewed the surrounding zoning and land use, noting that the request would
expand on an existing C-3 District.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the requested C-
3 General Commercial zoning is consistent with the surrounding zoning and land use.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City
Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

The subject property has been used for a freight transfer faoility until
Physical Characteristics: The subject parcel is approximately one acre in size and has direct
access to the frontage road serving U.S. Highway 20. The property is relatively flat but does
drain to the southwest.
Concurrence with Comprehensive Plan: this rezoning request implements the
Comprehensive Plan land Use Element: Goal 2.2, 7.1 and 7.2.
Impact of Request on:
Utilities: Existing utilities are adequate to'serve the subject site.
Traffic Patterns/Counts: The subject property has direct access onto the frontage road
that serves U.S. Highway 20. U.S. Highway 20 is considered a major arterial and
carries approximately 32,000 vehicle trips a day.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment provided
adequate erosion control is provided during all phases of development.
Adjacent Properties: Staff does not anticipate any adverse impact to adjacent property,
as the rezoning request to C-3 General Commercial is less intense than the current CS
zoning. The subject parcel is also adequately screened from adjacent property to the
east.

CIP Investments: The State of Iowa and the City of Dubuque are currently in the
process of upgrading the major intersections along U.S. Highway 20. The first phase of
the projeot has been completed with the interconnection of all traffic signals. The
second phase of improving the capacity of the individual intersections is currently
underway.
Staff Analysis: The applicants are requesting rezoning of the subject parcel from CS
Commercial Service and Wholesale Distriot to C-3 General Commercial District. Recently,
the owners of the property have demolished the old freight transfer facility that has been on
this site for many years. The proposed rezoning to C-3 General Commercial is intended to
facilitate development of a new multi-tenant oommercial structure on this site.
The requested rezoning to C-3 General Commercial would represent an expansion of the
existing C-3 Distriot immediately west of the subject parcel. There is an existing multi-tenant
commercial building and a gas station/convenience store to the west, and the east side is
bordered by Center Grove Cemetery. This parcel is zoned R-4 Multi-Family Residential
District. The property to the south of the subject parcel is zoned CS Commercial Service
and Wholesale District, and is ocoupied by Grove Tool.
The proposed rezoning to C-3 General Commercial is consistent with the Comprehensive
Plan and consistent with surrounding zoning and land use. The common property line
between the cemetery and the proposed site is adequately screened with existing trees and
shrubs.
Planning staff recommends the Zoning Advisory Commission review Section 6-1-1 of the
Zoning Ordinances that establishes criteria for the review of rezoning requests.

ORDINANCE NO. 48-04
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 3230 DODGE STREET
(U.S.HIGHWAY 20) FROM CS COMMERCIAL SERVICE AND WHOLESALE
DISTRICT TO C-3 GENERAL COMMERCIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from CS Commercial Service and Wholesale District to C-3 General
Commercial District; and:
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
