(MWH) Budget Increase Request This memorandum is to request execution of Budget Increase Request for Continued Environmental Consulting Services between MWH America's, Inc. (MHW) and the City for the Water Pollution Control Plant (WPCP) Modifications Project. This proposal request relates to the continued environmental engineering services necessary for the mercury spill and the former petroleum product underground storage tank (UST) at the WPCP site. This change order request in the amount of $23,400 provides for the following for mercury- related, clean -up costs: $13,800 Final oversight, verification sampling and analysis, and reporting activities related to remediation of mercury impacted trickling filter media and structures. $ 5,600 Cost allocation assistance for remediation between historic mercury release and the recent spills. $ 4,000 General consulting assistance associated with the closure reporting for the former on -site underground storage tank and other assigned tasks. This budget increase request will be paid for by using contingency funds from the construction project, with a current balance of $1,882,565.68. (MWH) appreciates the opportunity to submit this proposal to provide continuing environmental engineering assistance to the City of Dubuque, lowa (City) relating to the mercury spill and the former petroleum product underground storage tank (UST) at the City's water pollution control plant (WPCP) site. Because of the number of samples collected and submitted for rush analysis during remediation of the south trickling filter, and the additional time required on site by MWH personnel, the previously authorized budget has been exhausted. This proposal is intended to include 1) final oversight, verification sampling and analysis, and reporting activities related to remediation of mercury impacted trickling filter media and structures; 2) assistance to the City regarding potential cost allocation for remediation costs between historic mercury releases and the recent spills; and 3) general consulting assistance associated with the closure reporting for the former on -site UST and other tasks as requested by the City. More detailed descriptions of the proposed activities for these three general tasks are outlined below. Task 1— Mercury Remedlation Sampling and Reporting Activities to be conducted under this task are intended to complete the sampling and analysis and final reporting for the mercury remediation in the trickling filter basins. Activities to be conducted by MWH include the following: • Prepare the final report summarizing the response action activities, field screening and analytical results, and disposal of materials from the trickling filters and surrounding soil. Provide the draft report to the City and others, as directed, for review. MWH will relay outstanding analytical results to North Shore and forward any additional correspondence from the IDNR. ■ Provide additional regulatory assistance for coordinating final disposal of trickling filter media or other waste related to the remediation. • Process final laboratory invoices. • Process final travel and equipment costs. ■ Protect management for MWH on -site activities. No additional on -site time is anticipated; however, MWH will also provide support and interaction with the IDNR, as requested by the City. Task 11— Cost Allocation Assistance Under this task, MWH will participate in a meeting with the City and other site contractors to develop a basis for a proposed allocation of costs related to the investigation and cleanup of mercury in and around the trickling filters. MWH understands the purpose of the meeting is to identify costs related to historic spills versus those resulting from the September 2010 spill. It is assumed the meeting will be held for one day in Dubuque, Iowa and will be attended by Randy Kroneman of MWH's Des Moines, Iowa office. MWH will also provide support to the City, as requested to review the report being prepared by Exponent, Inc.; and identify specific waste streams generated during the remedial activities. Task 111 — UST and General Assistance MWH will review the Tier 2 Site Cleanup Report (Tier 2 SCR) report to be prepared and submitted to the IDNR by Seneca, Inc. (Seneca), for the leaking UST formerly located northeast of the WPCP administration building, and provide comments to the City. Based on the analytical results of sidewall soil samples collected by Seneca during the over excavation of impacted soil, the site failed to meet the IDNR Tier 1 screening levels; therefore, a Tier 2 evaluation is required. MWH will also provide comments on any other related activities proposed by Seneca or requested by the IDNR MWH understands an extension for submitting the Tier 2 report was requested and granted by the IDNR. The Tier 2 report is due January 1, 2012. The proposed activities will be conducted under the supervision of an Iowa- Certlfed Groundwater Professional; and in compliance with requirements of Chapter 135 of the Iowa Administrative Code (IAC), and associated IDNR guidance documents. Under this task, MWH will also provide general consulting services for the WCPC as requested by the City. These activities are assumed to include collection of up to six sediment samples from drain traps in the WPCP on -site laboratory. The samples will be submitted for analysis of total mercury and the results provided to the City. Other activities may include • Mr. Steve Sampson Brown recommendations for disposal or management of materials generated or discovered during the WPCP renovation. ESTIMATED COSTS The tasks will be completed on a time -and- materials basis in accordance with the October 18, 2010 Consulting Services Agreement (CSA) and MWH's current "Fee Schedule," attached. Iowa / Kansas Program Fee Schedule Effective January 1, 2011 * Adjusted in conjunction with the federal allowable rate. • Associated project expenses, including telecommunications (equipment, local and long distance charges), facsimile, computer and word processing equipment, first class postage, network charges, and in -house reproduction and printing of plans, reports, and other documents (black & white, up to 11x17 inches, up to 5 copies) will be invoiced at $9.75 per total labor hour, in lieu of detailed invoicing of the specified items. • A surcharge of fifty (50) percent will be added to hourly rates for expert witness testimony, participation, preparation time, hearings, depositions, etc. • Rates for Computer -Aided Design and Drafting equipment, when required, will be Invoiced at the rate of $15.00 per hour. • A surcharge for Contractors Pollution Liability Insurance coverage on Remedlation/Construotion activities will be negotiated for each contract where required. • The above rates are subject to change January 1 of each year.
