Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the requested rezoning, the property
location and his intent to develop a residence for 12 men. He indicated he held a neighborhood
meeting at Comiskey Park.
Staff reviewed the requested rezoning, noting that in addition to rezoning the property, a
conditional use permit is also required for the proposed facility.
There were several public comments regarding concerns about the impact of the proposed
residence on the value of surrounding property, the proximity to similar facilities on the North
End, and the safety of children in the neighborhood.
The Zoning Advisory Commission discussed the request, noting that the facility will serve a
different population than existing facilities on the North End and that the proposed zoning is
compatible with the surrounding area.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The property was subdivided circa 1890 as part of the original
Langworthys Addition into three Tots and a single - family home was built on the center lot in
1900. The properties continue to accommodate a single - family home.
Physical Characteristics: The property consists of three level 5,000 square foot lots located
at the corner of 25 and Elm Streets. The property is bounded at the rear by an improved
City alley and has sidewalks on both the Elm Street and 25 Street frontages. Two of the
lots currently are vacant and the center lot accommodates a two -story frame single - family
home.
Concurrence with Comprehensive Plan: The Comprehensive Plan calls for this area to
remain single- and multi - family, mixed -used residential. The Comprehensive Plan
recommends buffering incompatible uses and providing a mix of housing options within the
community.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns /Counts: At this location, Elm Street is not heavily traveled and,
therefore, the Iowa Department of Transportation has not provided traffic counts for
this area

Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.
Adjacent Properties: The addition of a single -room occupancy rooming and boarding
house, at this location, should have very limited impact on traffic and demand on
parking in the neighborhood. The property will, however, increase the residential
density over and above the adjacent, primarily single - family development. The
property will also buffer the residential use to the north from the existing commercial
parking lot to the south.
CIP Investments: None proposed.
Staff Analysis: The applicant is proposing to rezone a total of 15,000 square feet of
property located at the corner of Elm and 25 Streets from R -2A Alternate Two - Family
Residential to OR Office Residential District to accommodate a single -room occupancy
rooming and boarding house. The applicant has stated that the plan is to develop an
approximately 12 room facility.
The property currently consists of 3 lots. The lot closest to the corner of 25 and Elm
Streets currently is vacant. The center lot accommodates a two -story single - family frame
residence and the third lot to the north is also vacant. The applicant intends to redevelop
the lots to accommodate a rooming house and locate the required parking behind the
facility along the alley that is accessed from 25 Street. The addition of a 12 room SRO at
this location should have very limited impact on overall traffic and demand on parking in the
neighborhood. However, the rooming house represents a relatively dense residential
development that will be located directly adjacent to what is primarily single- and two- family
residential development.
Please note that, if the request to rezone is approved, the property owner will have to
submit a site plan and acquire a conditional use permit from the Zoning Board of
Adjustment. The Zoning Board of Adjustment has the ability to place conditions on the
proposed facility such as limiting the number of rooms or requiring additional parking.
Staff recommends that the Zoning Advisory Commission review the criteria established in
Section 9 -5 of the Unified Development Code regarding reclassification of property.

The OR District is intended to serve as a transition zone between commercial and single -
and two- family residential areas permitting adaptive reuse of existing building stock,
which will normally be residential in character. This OR District is not intended to have
any application in undeveloped or newly developing areas of the City or on land made
vacant through intentional demolition. Development standards remain flexible to allow
conservation and reuse of existing buildings. This district should be located in areas
abutting arterial and/or collector streets which are, because of location and trends, suit-
able for development of low intensity office uses, and high intensity residential uses.
5 - 7.1 Principal Permitted Uses
The following uses are permitted in the OR District:
