The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's engineer, Nick Lange of Buesing & Associates, spoke in favor of the
request reviewing the subdivision, noting that it was an in -fill site with water, sanitary
sewer available and appropriate zoning.
Staff reviewed surrounding zoning and land use, existing condition of Liberty Avenue,
that the subdivision meets the required 40 points for sustainable practices. Staff also
noted that the Fire and Engineering Departments had reviewed the existing Liberty
Avenue street conditions and access.
There were several public comments in opposition, citing concerns for existing
conditions, width and safety of Liberty Avenue, and that it wasn't adequate to support 15
new homes.
The Zoning Advisory Commission discussed the request, noting that the submitted
preliminary plat is in substantial compliance with the Unified Development Code and
that the existing access is sufficient.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, waiving the paving width of the proposed public street from 31 feet
to 27 feet, and allowing a single access length of 1,950 feet, when Engineering
standards limits cul -de -sacs to 1,300 feet.

Physical Characteristics: The subject property is located at the end of Liberty Avenue.
The lot is relatively flat near Liberty Avenue and then slopes downward to the
northwest.
Recommended Motion: Motion to approve the submitted preliminary plat of Liberty
Subdivision as it is in substantial compliance with City of Dubuque Unified Development
Code.
Conformance with Comprehensive Plan: This 2030 Future Land Use Map designates
the subject parcel for single or two - family residential. The submitted preliminary plat
involves the following Comprehensive Plan Goals: Land Use and Urban Design
Element Goals: 1.2, 1.5, 1.10, 5.3, 6.2, 7.2, 7.8, 9.2 and 9.4.

Impact of Request on:
Utilities: Existing City utilities are adequate to serve the proposed 15 -lot
subdivision.
Traffic Patterns: The proposed 15 single - family building lots will generate
approximately 143 additional vehicle trips. Access to and from the proposed
subdivision will be by way of Liberty Avenue.
Public Services: Existing public services are adequate to serve the proposed
subdivision.
Environment: Staff does not anticipate any significant impact to the environment
provided the sustainable measures proposed by the applicant are installed and
maintained appropriately, that appropriate erosion control is provided during all
phases of construction, and storm water control is provided in compliance with
adopted City Codes and regulations.
Adjacent Properties: Planning staff anticipates that the most likely impact to
adjacent property will be an increase in vehicle trips traveling on Liberty Avenue,
and an increase in the ambient noise and light levels.
Proposed Sustainable Development Tools: (1) 27 -foot wide street (reduced
impermeable area); (2) concrete street (reduce heat island effect); (3) street trees;
(4) infill development; (5) LED street lights; (6) infiltration of storm water in
detention basin, and (7) Iowa Green Streets criteria.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted preliminary plat of Liberty Subdivision subdivides
approximately three acres of property at the east end of Liberty Avenue into 15 new
single - family lots. A new public street will be constructed and will extend approximately
550 feet to the north from the existing Liberty Avenue.
The proposed public street will be built to a 27 -foot width of paving within a 50 -foot
right -of -way. Sidewalks will be constructed on both sides of the street as lots are
developed. Parking will be restricted to one side of the street. The majority of the 15
proposed lots will be just under 5,200 square feet in area. The proposed homes will
meet the City's setback requirements for single - family residential districts.
Water service is provided by an extension of the existing water main in Liberty Avenue.
Sanitary sewer will be provided from an existing sanitary sewer main that is available at
the north end of the site and will be extended to the south within the new proposed
right -of -way.

The proposed subdivision provides for a storm water detention basin, Lot B, to
accommodate the additional storm water generated by the impervious surface created
by the 15 new homes and proposed public street.
The Unified Development Code requires that each new subdivision utilize sustainable
development tools and achieve a 40 point score from a list of sustainable development
tools. The applicant will achieve the 40 point total by utilizing the following sustainable
practices:
1. 27 -foot wide street, which reduces the amount of impervious area in the
development. (5 points)
2. The proposed street will be a concrete street that reduces the heat island effect .
(5 points)
3. The applicant will be planting street trees within the parkway between the sidewalk
and the back of curb. (5 points)
4. The proposed subdivision is located on an infill lot. The City Planner has
determined that this is an appropriate sustainability measure . (5 points)
5. An LED street light will be used on the new cul -de -sac. Fifty percent energy
savings with twice the life span compared to the City's standard street light. The
City Engineer has determined this is an appropriate sustainability measures .
(5 points)
6. Storm water will be allowed to infiltrate in the bottom of the detention basin. The
City Engineer has determined this is an appropriate sustainability measure. (5
points)
7. The proposed subdivision will be in compliance with State of Iowa Green Streets
criteria (10 points).
Total: 40 points.
One issue that was raised by staff during the review of this preliminary plat is that
Liberty Avenue will be the only access for existing and new residents to enter and leave
the area. The area surrounding and including Liberty Avenue was annexed to the City
in the early 1970s. The roadway was constructed to serve the subdivision that was
originally platted as Clark Subdivision. The street is approximately 20 -foot in width
within a 40 -foot right -of -way. The existing street is 1,450 feet long. The proposed cul-
de -sac street will add approximately 500 feet for a total length of approximately 1,950
feet. The Engineering Department has a cul -de -sac standard of 1,300 feet. The City
has had a policy of looking for a secondary access when a street length exceeds 1,300
feet and /or more than 30 -40 housing units.
Planning staff is not recommending that a secondary access be required for two
reasons. First, the total number of residences after construction will be 30 homes,
which is not unusual number of residences to be served by a single access. Second,
there isn't a practical alternative for a second access. The surrounding area is fully
developed and the only roadway nearby is a private drive owned by Stonehill Care
Center.

Two primary concerns have been raised by neighboring residents regarding the existing
Liberty Avenue. First, the number of additional vehicle trips generated by the new
subdivision, and second, the impact of construction traffic on the existing roadway.
The 15 additional single - family homes can be expected to generate approximately 9.5
vehicle trips per home per day based on the Institute of Traffic Engineers Trip
Generation Manual. This equates to approximately 143 daily trips. When combined
with the existing 14 single - family homes on Liberty Avenue (using the same ITE rate),
an additional 134 average daily trips is projected for a potential of 277 average daily
trips using Liberty Avenue. While this traffic volume is not uncommon for a small
roadway such as Liberty Avenue, the number of vehicle trips is a substantial increase to
the existing residents who live along Liberty Avenue.
A related concern raised regarding the number of vehicle trips is the lack of visibility
where Liberty Avenue transitions to an east/west direction. The Engineering
Department can investigate this corner and potentially could install signage to warn
motorists, if warranted. Another option is to reconstruct the corner to improve visibility,
which would include purchasing additional right -of -way.
The second issue is the potential for damage to the existing roadway from the passage
of heavy trucks associated with construction of the 15 new single - family homes. The
Engineering Department has indicated that as with any new development, there is the
potential for damage to existing City infrastructure, including streets. The City
Engineering Department and Public Works Department will monitor the roadway during
and after construction to determine if any damage has been done to the roadway.
The Fire Department has requested that because of the width of the existing Liberty
Avenue, that on- street parking be restricted from the north side of the street. The City
Council has the authority to restrict parking on City streets. This request can come from
the Fire Department, Engineering Department or citizens.
The submitted preliminary plat of Liberty Subdivision is in substantial compliance with
Section 11 of the Unified Development Code, and staff recommends the Zoning
Advisory Commission approve the preliminary plat as submitted.

This letter is in response to correspondence you had with City Manager Michael Van
Milligen regarding the property at 961 Liberty Street and a proposed 17 -lot subdivision
to be built on the subject property. I have attached to this letter a copy of the preliminary
plat received on March 2 that shows the proposed lot layout and street connection.
My understanding is that you learned of this subdivision through one or more media
sources advertising this site as one of four in the city for a new program being
administered by East Central Iowa Intergovernmental Association (ECIA).
The submitted preliminary plat has not yet been reviewed by staff, the Zoning Advisory
Commission or the City Council, which is required by the City's Municipal Code. The
developers are obviously anxious to be part of the program sponsored by ECIA;
however, the advertising of the proposed subdivision does not represent any formal
approval by the City of Dubuque.
The subject property is currently zoned R -1 Single - Family Residential, which does allow
single - family homes. The platting of a subdivision must be reviewed by the Zoning
Advisory Commission and the City Council prior to commencement of grading, utility
extensions, etc. As part of the review of a proposed subdivision, Planning staff gathers
input from City Engineering, Fire, Water and Building Services Departments as part of a
staff report that is presented to both the Zoning Advisory Commission and City Council.
Your correspondence with City Manager Mike Van Milligen included concerns regarding
the existing Liberty Street's ability to handle the traffic from an additional 17 homes.
Ultimately, whether Liberty Street is adequate will be decided by the City Council as
part of the review of the subdivision. However, City Engineering can be petitioned by
the existing residents along any street in town to request improvements to the City
street. The City's five -year capital improvement program typically does include the
reconstruction and widening of city streets.
Another issue you raised was regarding parking along the street. Currently, as you are
aware, there is no restriction on the parking of vehicles along the street. The residents

along Liberty Street could contact the City Engineering Department about restricting
parking to one side along Liberty Street to ensure adequate travel width. The City
Manager or City Council may approve on- street parking restrictions.
Your letter also brought up issues about erosion coming from the Stonehill area and
causing problems with an existing sewer line. This issue has been referred to the City
Engineering Department which will investigate and address any issues they find. In
terms of the proposed subdivision worsening the problem, drainage issues are
reviewed as part of any new subdivision, and will be addressed as part of this proposed
subdivision.
The preliminary plat will be reviewed by the Zoning Advisory Commission at their April
6, 2011 meeting that is held at the City Council Chambers in the Historic Federal
Building at 6 p.m. The City Council will also review this preliminary plat most likely at
their April 18, 2011 City Council meeting.
Subdivision plats are an action item on both the Zoning Advisory Commission and City
Council agendas. Action items limit input to the Zoning Advisory Commission or City
Council, staff and the applicant. Input from the public is generally not allowed. The
Chairperson of the Zoning Advisory Commission can allow input from interested parties,
but it is up to the Chairperson. Generally the Mayor and City Council do not allow input
on action items other than from staff, the applicant and the Council. If you would like to
address the Council on this item when it comes before them, it is best to contact the
City Clerk's Office and talk to City Clerk Jeanne Schneider on how best to address the
Council on this item.

Subject: Liberty Estates Subdivision
My information is:
I would like to address the Liberty Estates Subdivision. I really feel the need for each of you to look at
the neighborhood on Liberty Ave. There are currently 15 single family homes on the street. The street is
adequate for the numbers of homes currently on Liberty Ave. There is a blind curve about half way up
the street. The street is not your typical street width. On most of the street two cars cannot meet each
other without one of the vehicles pulling over to the side to let the other car go by. And during the
winter months it is only one lane. To the best of my knowledge there has only been one accident on the
street and that was our car hitting a neighbor's car as we were both going around the corner. The
reason for only this one accident in my 29 years living on the street is due to each of the neighbors
respecting each other and driving in a manner for the condition of the street.
Over the years, the City of Dubuque has done a very good job of keeping the street in fairly good repair.
In the past they would sealcoat the street and the last two times it was time for repair they put a layer
of asphalt over the street., Which for the amount of traffic on our street, the asphalt layer has been just
fine. It has been about 2 1/2 years since the last layer of asphalt has been laid down. There are no curbs
on most of the street, so the edges of the street take a beating. The street in several places is starting to
show some signs of softness. This is mainly due to the harsh winter and from trucks like the trash
collection, UPS, Fed X and things that are necessary to a normal neighborhood.
One of my biggest concerns is the amount of increased traffic that the street will be subject to. Adding
16 homes to the very end of Liberty Ave., with two or three vehicles per house is unsustainable. Liberty
Ave. is a dead end street. Only one way in and out of the subdivision that's at the very end of the street.
Just the traffic for the development alone will be more heavy trucks than our street can handle. Just for
the foundations alone for the new houses, there will be about 200 cement trucks going up and down
liberty Ave. First there will be all the equipment that needs to be brought in to start the road and
development. The trucks needed to haul all the rock for the sustainable street, water and sewer lines.
Then they will start to bring in the cement for foundations, lumber for each house, shingles, windows,
plumbing, heating, cabinets, brick, siding, garage doors, and now it's time for more cement trucks for
the driveways. Can anyone tell me how many times the city inspectors will drive up and down Liberty to
inspect for building codes? My point is that the street will be in such poor shape before the first person
even steps foot into their new house.
The new houses are two and three bedrooms homes, meaning that most every home will have kids.
Liberty Ave. has no sidewalks and is just verily wide enough for car traffic.
It was brought to our attention that maybe Liberty needs to be updated to a wider street with
sidewalks. Who will be the ones to pay for such updating? And at this time there is no such plans in the
cities 5 year plan. With all the budget cuts and other needs in the city, I personally don't see Liberty Ave.
as a high priority. So now we are back to having high volume of traffic and pedestrian use on an
inadequate street. The current residents on Liberty should not have to pay for improvements to the
street so that a developer can come in to make a quick buck. By the time the development is complete
he will be long gone and the city will then see the need for improvement to the street. Let's guess who
will be the ones to pay for the developer's financial gain.
Another major concern of mine is the drainage of the runoff water from the development. I have the
only sewer line that is connected to the main line that runs down through the valley behind our house.
Over the past 20 years have worked hard to get the current water that flows down the valley from,
Stone Ridge Town Homes and from Stone Hill Care to stop from washing my sewer line out. Even once
all ready this year I had to add more rock because the snow melt and rain start to eat away in the area
where my sewer line crosses the ditch. I realize that the development is to have a drainage pond to help
slow down the run off but it still will add to the problem in my sewer area.
There is more than just being environmentally sustainable. Sustainability needs to include the way
people are able to live in a neighborhood. When you move that many people into such a small area you
are creating an environment that will not be family friendly. With the lots being just large enough to
pass the city code you can tell the developer doesn't care about the real sustainability of the people who
ends up buying a home in that subdivision. Where will the kids play, in the drainage pond at the end of
the street?
I would be happy to have someone from the city to come up to meet with me to go over my concerns. I
would hope you look at our already established old but very good neighborhood to see how this project
will change our way of life and our future tax burden.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission respectfully requests the City
Council consider making appropriate street improvements to Liberty Avenue in the
eventuality that the proposed Liberty Subdivision is approved and developed. The
proposed subdivision would create 15 new single - family homes, in addition to the
existing 14 homes, that will utilize Liberty Avenue as their sole access in and out of the
area.
The existing Liberty Avenue is substandard in terms of its paving width and sight
distance around the corner before transitioning to an east/west direction.
In addition, the Zoning Advisory Commission supports the Fire Department's
recommendation of restricting on- street parking to the south side of Liberty Avenue
only.
