Van Milligen, City Manager SUBJECT: Amend the 28E Intergovernmental Agreement with IDNR - Heron Pond Fishing Pier On February 16, 2004, the City Council approved a 28E Intergovernmental Contract Agreement with IDNR for grant funding of $39,000 for the fishing pier project. Cost estimates for the project have increased and IDNR has agreed to increase the grant funding to $61,500. This item appears elsewhere on the Agenda to initiate the bidding process. leisure Services Manager Gil Spence recommends City Council approval of an amendment to the 28E Agreement with IDNR for the Heron Pond Fishing Pier Project. L,"'" S'N"" M'"'9'~ SUBJECT: Amend the 28E Intergovernmental Agreement with IDNR -- Heron Pond Fishing Pier INTRODUCTION The purpose of this memorandum is to request City Council approval of an amendment to the 28E Agreement with IDNR for funding for the Heron Pond Fishing Pier Project. DISCUSSION On February 16, 2004 the City Council approved a 28E Intergovernmental Contract Agreement with IDNR for grant funding of $39,000 for the fishing pier project. Cost estimates for the project have increased and IDNR has agreed to increase the grant funding to $61,500. The attached Amendment 1 provides for increasing the grant funding to $61,500. IDNR has signed the amendment. ACTION STEP The action requested is for the City Council to approve the amendment to the 28E Agreement with IDNR for the Heron Pond Fishing Pier Project. Article V Section 5.3 shall be amended to read: To receive Federal funds ($61,500) from the Department the Contractor shall agree to and certify compliance with all applicable Federal laws, regulations, and policies. The first sentence of Article VII Section 8.2 shall be amended to read: The Department shall pay the Contractor 75% of the actual project costs or $61 ,500 whichever is less for activities shown in the Budget Summary (Appendix A). The budget summary found in Appendix A of the Agreement shall be amended to Budget Summary Contract Recipient Total Project Amount Match Costs $61,500 $20,500 $82,000 75% 25% 100% $3,075 $0.00 $3,075 Retained Amount*** *** See Article IX "Payment" Paragraph 4.
