Van Milligen, City Manager SUBJECT: Amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District Economic Development Director Bill Baum recommends City Council adoption of an amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District and that a public hearing be set for August 2, 2004. This amendment identifies the Stealth Race Car property as a possible acquisition site that may be needed for street access and/or to facilitate development as it adjoins the larger, former Dubuque Hardwoods site and would create a 4-way intersection at Adams Street. The proposed Plan amendment and resolution adopting the amendment are attached. The City Council will hold a public hearing on the amendment August 2, 2004. Background On June 21,2004, the City Council approved a Resolution of Necessity finding that an amendment of the Urban Renewal Plan for the Greater Downtown Urban Renewal District would further redevelopment efforts that met the purposes and objectives of the Plan. Staff prepared an amendment to the urban renewal plan for the district per the directive of the City Council. The Plan amendment was reviewed by the Long Range Planning Advisory Commission at a meeting held July 21, 2004. The Long Range Planning Advisory Commission has forwarded its recommendations to the City Council affirming that the proposed Plan amendment is consistent with the City's Comprehensive Plan for redevelopment of the greater downtown area. An opportunity was provided on July 15, 2004 for consultation with the affected taxing entities as required by State law. No comments were received from the taxing bodies regarding the proposed amendment. Discussion The proposed amendment to the Greater Downtown Urban Renewal Plan will make the following changes: 1) Language will be added to Section G. Land Acquisition and Disposition of the Plan to indicate that property has been identified for possible acquisition/disposition. 2) A map will be included as an attachment to identify the Stealth Race Car property as a possible acquisition. The property identified may be needed for street access and/or to facilitate development as it adjoins the larger, former Dubuque Hardwoods site and would create a 4-way intersection at Adams Street. Recommendation I recommend that the attached amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District be adopted. Adoption of the amendment will support both public and private redevelopment efforts in the greater downtown area consistent with the purposes and objectives of the Urban Renewal Plan and also in accord with the Port of Dubuque Master Plan and Design Standards and the Downtown Master Plan. Whereas, on June 21,2004, the City Council of the City of Dubuque, Iowa authorized the preparation of an Amended and Restated Urban Renewal Plan (the "Plan") for the Greater Downtown Urban Renewal District (the "District"); and Whereas, the City of Dubuque's primary objective in amending this Plan is to provide opportunities for further redevelopment and reinvestment in the District; and Whereas, the Long Range Planning Advisory Commission has reviewed the proposed Plan amendment and has found that said document is consistent with the Comprehensive Plan for the development of the City of Dubuque as a whole and has transmitted its findings to the City Council; and Whereas, a consultation process has been undertaken with affected taxing entities in accordance with Chapter 403 of the Code of Iowa with no written objections or recommended changes to the Plan received; and Whereas, the City Council, in accordance with Chapter 403 of the Code of Iowa, has held a public hearing on the proposed Plan amendment after public notice thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District, attached hereto and made reference to herein, be approved. Section 2. That the City Clerk of the City of Dubuque, Iowa is hereby authorized and directed to file a certified copy of this Resolution along with the Amendment in the office of the Dubuque County Recorder. LAND ACQUISITION AND DISPOSITION The City of Dubuque is prepared to acquire and dispose of property in support of the development and redevelopment of the District within the parameters set forth below. 1. Land Acquisition: The City may acquire property for private development or redevelopment by contractual agreement or by right of eminent domain. The City reserves the right to acquire, by negotiation or eminent domain, property rights required for the construction or reconstruction of streets and public utilities, or any other public facility or improvement. No propertiec me identified for I acquicition in thic Plan. Potential acquisition parcels are identified on Attachment F Acquisition/Disposition Map. 2. Land Disposition: Publicly held land will be sold for the development of viable uses consistent with this Plan, and not for purposes of speculation. Land will be disposed of in accordance with the requirements set forth in Chapter 403 of the Iowa Code, Urban Renewal Law. Developers and redevelopers will be selected on the basis of the quality of their proposals and their ability to carry out such proposals while complying with the requirements of this Plan. Developers and redevelopers will be required by contractual agreement to observe the Land Use Requirements and Planning and Design Criteria of this Plan. The contract and other disposition documents will set forth the provisions, standards and criteria for achieving the objectives and requirements outlined in this Plan. The merged plan did not identify any property as acquisition parcels for economic development purposes, Discussion The City is interested in acquiring the Stealth Race Cars property, owned by Terry and Linda Weidemann, located along 5th Street at the entrance to the Port of Dubuque, The property will likely be needed for street access and/or to facilitate development as it adjoins the larger, former Dubuque Hardwoods site and would create a 4-way intersection at Adams Street. The attached Resolution directs staff to prepare an amendment to the Greater Downtown Urban Renewal Plan and to forward the proposed plan to the Lon9 Range Planning Advisory Commission for their review and comment. This is required by Chapter 403 of the Iowa Code along with a consultation process that involves all affected taxing entities, Those taxing entities, the County, School Board and community college, have an opportunity to comment on the proposed plan prior to the required public hearing, but they cannot block adoption of the plan. City Council public hearing on the proposed amendment to the Greater Downtown Urban Renewal Plan will be scheduled for August 2, 2004, The Long Range Planning Advisory Commission will review the amendment at their July meeting, and staff will conduct the consultation with the taxing entities prior to the public hearing, Recommendation I recommend the City Council adopt the attached Resolution of Necessity that begins the process of amending the Greater Downtown Urban Renewal Plan, The amendment will allow the City to acquire property in the Port of Dubuque for redevelopment purposes. A RESOLUTION OF NECESSITY FINDING THAT AN AMENDMENT TO THE URBAN RENEWAL PLAN FOR THE GREATER DOWNTOWN URBAN RENEWAL DISTRICT IS NECESSARY IN THE INTEREST OF THE RESIDENTS OF THE CITY OF DUBUQUE, IOWA. Whereas, the City Council of the City of Dubuque adopted an Urban Renewal Plan for the Greater Downtown Urban Renewal District on April 19, 2005 by Resolution 170-04 to stimulate and guide public and private investment within the District; and Whereas, the City Council of the City of Dubuque has determined that an amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District will provide redevelopment opportunities which will further the purposes and objectives of the Urban Renewal Plan for the Greater Downtown Urban Renewal District; and Whereas, the City of Dubuque shall undertake the urban renewal actions specified in the Urban Renewal Plan, pursuant to the powers granted to it under Chapter 403 of the Iowa Code, Urban Renewal Law, and Chapter 15A of the Iowa Code; and Whereas, Chapter 403 of the Iowa Code requires that before an urban renewal plan may be modified, the City Council must adopt a resolution of necessity and provide for a process of review and consultation prior to adoption of an amended and restated plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1, That an amendment to the Urban Renewal Plan for the Greater Downtown Urban Renewal District is necessary and appropriate to facilitate the proper growth and development of the community in accordance with sound planning and local community objectives, Section 2, That the City Manager is authorized and directed to prepare an Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District, to forward said Plan to the City's Long Range Planning Advisory Commission for review and comment and to begin the consultation process required by law with affected taxing entities, Section 3. That the City Clerk is directed to publish notice of a public hearing on the adoption of an Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal District to be held on August 2, 2004 at 6:30 p.m, in the Carnegie-Stout Public Library Auditorium, 360 W, 11th Street, Dubuque, Iowa 52001 and that said notice shall generally identify the area covered by the Amended and Restated Plan and the general scope of the amendment. Section 4.
