Special Assessment_695, 697 Caledonia Street_HerrigMarch 29, 2011 RE: Assessment 695 1 /2 and 697 1 /2 Caledonia Dubuque, Iowa 52001 RECEIVED 11 APR 15 PM 1 :03 City Clerk's Office Dubuque, IA On or about May 5, 2010, I discovered that two of my tenants, one at 695 1 /2 and one at 697 1 /2 Caledonia St., had brought pets (cats) into their apartments contrary to their leases. Upon issuing a 3 day notice to remove the cats, being in violation of their leases, they both elected to give me their 30 day notices to vacate. Tenant at 695 /2 Caledonia, without my knowledge, elected to move first and left behind odd items and garbage at the curb. Notice was given to remove the items /garbage or be subject to removal and city charge and assessment. Upon receiving the notice I immediately, along with a helping hand /laborer, proceeded to go to the unit and load the items and remove same which we did. Two days later upon visiting the property, the tenant downstairs at 695 Caledonia St., reported to me that the city was up, Ted Stackis, and picked up the garbage. I was surprised and said "what garbage "? He informed me that the tenant upstairs at 697 Caledonia St., moved out the day after 695 1 /2 Caledonia St. and left items /garbage behind at the curb as well. The City (Ted Stackis) would not have known that I had picked up the first tenants garbage that I received notice on, and therefore was under the impression that I hadn't done anything. Meanwhile without checking with me and not realizing TWO tenants were moving, two different piles of garbage were set out by two different tenants very close together. In addition, I was in the process of wrapping the windows and doors with aluminum coil, and therefore had two aluminum doors and one large 4'X4' aluminum storm window setting on the side of the building and one 1800 ton air conditioner setting on the porch that Mr. Stackis also took for the metal /aluminum value. Downstairs tenant observation! I would like the assessment at said property forgiven and removed from my property, per city councils order. I feel I did not have due process of law.
