Inc.; and
WHEREAS, pursuant to said re-
solution a copy of !be Redevelop-
er's Statement for Public Disclo-
sure and a copy of the proposed
form of Contract for Sale of Land
for Private Redevelopment was
placed on file in the office of the
City Clerk for public inspection;
and
WHEREAS, the City Council of
Dubuque, Iowa, overruled any and
all objections, oral and written,
to the proposal to dispose of said
interest of the City of Dubuque
in the above described real es-
tate to Ecumenical Housing, Inc.;
now therefore
BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Mayor and
City Clerk be and they are hereby
authorized to enter into a Contract
for Sale of Land for Private Re-
development in accordance with
the terms of the Disposition Do-
cuments governing such sale with
Ecumenical Housing, Inc. for the
real estate known as Lot A and
Lot 2 of Block 16 in Dubuque
Downtown Plaza in the City of
Dubuque, Iowa, containing 12,811.31
square feet, subject to survey.
Section 2. That said parcel of
real estate shall be sold for $4.09
per square foot for a total price
of $52,398.28 subject to final sur-
vey of the land to be conveyed.

1. That the selling price of said
real estate shall be Five Thousand
($5,000.00) Dollars per acre or a
total purchase price of $36,030.00
Dollars and that the option pay-
ments shall not be deemed nor
be applied upon the purchase price.
2. That the term of this option
shall be for a two (2) year period
and the "Optionor" reserves the
right to not renew said option by
giving ninety (90) days prior writ-
ten notice to the expiration of said
original term of said option and
such cancellation or refusal to ex-
tend the option shall be made by
"Optionor" to the "Optionee" in
writing. The "Optionor" may ex-
tend said option for an additional
two (2) year period.
3. That the consideration for this

lars per acre per year payable
annually in advance.
4. That in the event the said
option is exercised by the "Op-
tionee" the "Optionee" agrees to
commence construction of a plant
within one (I) year of dellvery
of deed and further agrees to com-
plete such construction within two
(2) years of delivery of deed.
5. That the construction of said
improvements shall conform to all
City Codes and Ordinances.
6. In the event of exercise of
said option, the "Optionor" shall
convey said premises by Quit
Claim Deed subject to existing
easements, for sewer, water and
all utilities and the "Optionor" re-
serves an easement for the location
and maintenance of such utilities,
together with the right of ingress
therein and egress therefrom for
the purpose of repair and main-
tenance thereof.
7. The "Optionor" reserves an
easement over Lot 1 of Block 14
Riverfront Subdivision No.3 for
possible extension of sanitary se-
wer, storm sewer and water main
and said easement shall be for
fifty (50') feet as construction ease-
ment and for twenty (20') feet
as utilities easement.

it will not interfere and should
have no effect on the proposed

Mr. Delos Dorweüer stated that
Kennedy Road is in a business
area and was more concerned
about some light poles in the Key
Knolls area !IIat seem to be prov-
ing to be a ennstant traffic ha-
zard and requeated if the hazard

bers are federal, state, county and
city elected and appointed officials,
organized for the purpose of guid-
ing, developing, approving and
publicizing transportation plans for
this area.

necessary for the present and fu-
ture use of people and the stimu-
lation of creativity for the orderly
growth of the City of Dubuque,
the State of Iowa, and the United
States of America in mankind's
quest for knowledge and freedom.
Section 3. That the Mayor and
the City Manager are hereby au-
thorized and directed to proceed
and to undertake all measures
deemed appropriate to secure the
support, endorsement and partici-
pation of Federal and State agen-
cies and private groups for the
Five Flags Center as a Bicen-

WHEREAS, Dubuque, the oldest
city in the State of Iowa and with

and the Stars and Stripes of the
United States of America, is lo-
cated in the only Iowa area of
involvement with the American Re-
volutionary War; and
WHEREAS, in recognition of the
rich, historical heritage of Dubu-
queland and for the occasion of
the two hundredth birthday cele-
bration of the founding of this na-
tion, there is proposed to be inte-
grated into the Five Flags Center
as an essential ingredient a per-
manent, full-scale multi-media and
sound facility to portray in sights
and sounds during the bicenteuoial
year, two hundred years of the
past of the Upper Mississippi and
the story of the men, women and
children who gave it life; and
WHEREAS, the Five Flags Cen-
ter Executive Committee has un-
animously recommended that the
Five Flags Center composed of
a restored architecturally and his-
torically significant theater and
site, a promenade, an exhibit-arts
hall, and a multi-media and sound
facility together with other appro-
priate site improvements be de-
signated as a Bicenteuoial Center;
and
WHEREAS, the Iowa American
Bicenteuoial Commission has ap-
proved the Five Flags Cooter "as
being significant and having the
potential of contributiug to the re-
cognition of the 2OOtb birthday of
the United States by the citizens
of Iowa"; and
WHEREAS, the City Council of
the City of Dubuque has strougly
endorsed the proposed Five Flags
Center and has recommended the
Project to the entire commnnity
as worthy of its support to pro-
vide a facility which will encourage
the cultural, recreational, ooter-
tainment and citizen participation

Attorney to institute Eminent Do-
main proceedings against Richard
V. Hansel, for the purpose of se-
curing a permanent easement
through his property for a sanitary
sewer line.
Pursuant to your orders, the City
Attorney's office prepared the ne-
cessary proceedings to institute
Eminent Domain proceediugs and
same were filed on the 13th dsy
of February, 1973 and on the 14th
day of February, 1973, the CIty
Attorney's office was advised that
said Richard V. Hansel had exe-
cuted a Grant of Easement for
the sanitary sewer tine for sani-
tary sewer purposes and, accord-
ingly, said Eminent Domain Pro-
ceed.ing.s should be discontinued.

The City of Dubuque Plauoing
and Zoning Commission has held
a public hearing on proposed or-
dinances to establish a Hospital-
Medical Zoning District and to
amend the Official Zoning Map
to apply the regulations of that
District to property of the three
local hospitals and to adjacent me-
dical facilities.
It was noted at the public hear-
ing that the Commission's legal
notice advertisement contained an
error in the Hospital~Medical Dis-
trict regulations, specifically Sec~
tion 2., paragraph (h), item 1. The
correction of this discrepancy was
noted at the public hearing to coin-
cide with the language of the at-
tached Ordinance and of the legal
notice advertisement for the CIty
Council public hearing.
The Commission has considered
that the proposed Hospital-Medical
District is consistent with earlier
studies and recommendations that
it has made. The concept of a
hospital-medical zoning district
was first considered in the early
drafts of the new City zoning or-
dinance and has been the basis
for all subsequent actions by the
Planning and Zoning Commission.
The present proposal for amend-
ing Ordinance No. 3-34 more ade-
quately reflects the intent of the
original concept by virtue of its
uniform applicability to all three
local hospitals and through its re-
gulation of accessory and support-
ing land-uses in accordance with
their compatibility to the hospital
district. In this regard, as inter-
preting prior actions of the Plan-
ning and Zoning Commission, the
proposed Hospital-Medical District
is a more appropriate amendment
to the present zoning ordinance.
The action of the Planning and
Zoning Commission was to approve
the Hospital-Medical District Ordi-
