SUBJECT: Tyler Road - Acceptance of Warranty Deed
Tyler Road has been a dead-end street for many years without a cul-de-sac for turning
traffic. Hoover School traffic and City refuse, collection and snow removal equipment
have difficulty maneuvering at the dead-end without entering private driveways.
The School District offered the property to the City at a cost of $1 0 if the City would
construct a cul-de-sac to replace the dead-end. This construction was completed in
August 2004.
Acting Public Works Director/City Engineer Gus Psihoyos recommends the City Council
accept a warranty deed from the Dubuque Community School District for a right-of-way
purchase on Tyler Road.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Tyler Road - Acceptance of Warranty Deed
INTRODUCTION
Enclosed is a resolution accepting a warranty deed for a right-of-way purchase
on Tyler Road.
DISCUSSION
Tyler Road has been a dead-end street for many years without a cul-de-sac for
turning traffic. The closest intersection (Erie Court) is three residential lots south
of the dead-end pavement. Hoover School traffic and City refuse, collection, and
snow removal equipment have difficulty maneuvering at the dead end without
entering private driveways.
The school district has offered the property to the City at a cost of $10 if the City
would construct a cul-de-sac to replace the dead end. This construction was
completed in August, 2004.
Enclosed is a warranty deed for the parcel needed for the cul-de-sac paving
project and to provide necessary grading for the installation of sidewalks.

RECOMMENDATION
The above property has already been purchased by the City, and the Warranty
Deed should be accepted by the City Council. I would recommend adoption of
the enclosed resolution accepting the deed.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
warranty deed from the Dubuque Community School District.

RESOLUTION ACCEPTING A CONVEYANCE OF LOT A OF BLOCK 8
IN METTEL-LiNK ADDITION IN THE CITY OF DUBUQUE, DUBUQUE
COUNTY, IOWA
Whereas, the City of Dubuque entered into an Acquisition Agreement with
the Dubuque Community School District pursuant to which the Dubuque
Community School District agreed to convey Lot A of Block 8 in Mettel-Link
Addition in the City of Dubuque, Dubuque County, Iowa, as shown on the
Acquisition Plat thereof; and
Whereas, the Dubuque Community School District has executed a
conveyance of said property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby
approves of, accepts, and consents to the Warranty Deed from the Dubuque
Community School District, copies of which are attached hereto, as acquired by
Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection
herewith.

For the consideration of Ten and 00/100 Dollar ($10.00) and other
valuable consideration, Dubuque Community School District does hereby convey
to the City of Dubuque, Iowa, the following described real estate in Dubuque
County, Iowa:

County, Iowa
This land is being acquired for public purposes and a Declaration of Value
is not required according to Iowa Code Section 428A.1.
Grantors do hereby covenant with Grantees, and successors in interest,
that Grantors hold the real estate by title in fee simple; that it has good and lawful
authority to sell and convey the real estate; that the real estate is free and clear
of all liens and encumbrances, except as may be above stated; and Grantors
covenant to warrant and defend the real estate against the lawful claims of all

Re: Tyler Street Cul-de-sac
Dear Mr. Psihoyos,
The idea of a cul-de-sac at the end of Tyler Street, adjacent to our Hoover School
property was initiated by the Hoover PT A Group and Hoover Principal, Steve Geisert.
This was done in February of 2004.
The reasoning was that many Hoover parents use Tyler Street as a drop off-pick up
area, Since this is a dead end street with no cul-de-sac the parents turn around to drop
off students on the school side of the property, by both driving into as well as backing
into neighboring driveways.
This would be an improvement in traffic flow and safety in the Tyler Street area if
constructed.
The District is willing to donate land, as necessary, for this project.
