Acting Public Works Director/City Engineer Gus Psihoyos recommends award of the contract to the low bidder, Tschiggfrie Excavating Co., in the amount of $217,100.85, which is 5.5% over the engineer's estimate. TO: SUBJECT: Award of the Port of Dubuque Storm Sewer Improvements - Phase IV Project (CIP 410401: Port of Dubuque Storm Sewer Improvements - Phase IV) INTRODUCTION The enclosed resolution provides for the award of the Port of Dubuque Storm Sewer Improvements - Phase IV Project. DISCUSSION The Port of Dubuque Storm Sewer Improvements - Phase IV Project involves the construction of an 8-foot wide by 6-foot high box culvert from the junction box north of the Portside Building, east and south to the Ice Harbor. Following the completion of Phase IV, the Port of Dubuque collector storm sewer will be complete from the Ice Harbor to Pine Street and the Star Brewery. Additional storm sewer will be required west of Bell Street and north of 5th Street when it develops. To install the storm sewer, the contractor must excavate through the edge of the petroleum plume limits, As a result, a portion of the excavated soil will be delivered to the Dubuque Metro Landfill. Testing revealed that the contamination is below the threshold that would require special attention by the landfill. The landfill can use the soil as cover or fill material. Therefore, the cost to deposit the soil will be the $30.78 per ton fee established for rubbish. Following project initiation, Engineering determined that it would be in the best interest of the City to pay the landfill fees outside of the Contractor's contract. The Contractor would be paid to haul the material only. Based on the testing done by engineering consultants Terracon and Preston Engineering, the estimated amount to be deposited at the landfill is 1,394 tons, Sealed bids were received on August 26, 2004. Tschiggfrie Excavating Co. of Dubuque, Iowa, submitted the low bid in the amount of $217,100.85. This amount is 5,5% over the engineer's estimate. A summary of the bids received is as follows: Tschiggfrie Excavating Co. W.C, Stewart Construction, Inc. Fondell Excavating, Inc. $217,100,85 298,266.95 377,019.00 RECOMMENDATION I recommend that the contract be award to Tschiggfrie Excavating Co. in the amount of $217,100.85. Remaining funds following the project will be utilized for additional phases that will be required as development occurs west of Bell Street. ACTION TO BE TAKEN I recommend that the City Council adopt the attached resolution awarding the Port of Dubuque Storm Sewer Improvements - Phase IV Project to Tschiggfrie Excavating Co. $217,100.85. Whereas, notice of hearing on plans, specifications, form of contract, and estimated cost was published as required by law. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the said plans, specifications, form of contract and estimated cost are hereby approved as the plans, specifications, form of contract and estimated cost for said improvements for said project. Passed, adopted and approved this 7111 day of September, 2004. Attest: RESOLUTION NO. 354-04 AWARDING CONTRACT Whereas, sealed proposals have been submitted by contractors for the Port of Dubuque Storm Sewer Improvements - Phase IV pursuant to Resolution No. 315-04 and notice to bidders published in a newspaper published in the City of Dubuque, Iowa on the 6111 day of August, 2004. Whereas, said sealed proposals were opened and read on the 26111 day of August, 2004, and it has been determined that the bid of Tschiggfrie Excavating Co. of Dubuque, Iowa, in the amount of $217,100.85 was the lowest bid for the furnishings of all labor and materials and performing the work as provided for in the plans and specifications. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the contract for the above improvement be awarded to Tschiggfrie Excavating Co. and the Manager be and is hereby directed to execute a contract on behalf of the City of Dubuque for the complete performance of the work. BE IT FURTHER RESOLVED: That upon the signing of said contract and the approval of the contractor's bond; the City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful bidders.
