The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that the rezoning and the subject
parcel will facilitate expansion of the existing parking from26 spaces to 44 spaces.
Staff reviewed surrounding zoning and land use.
There were no public comments. Two letters in support were received and filed by the
Commission.
The Zoning Advisory Commission discussed the request, noting that the rezoning is a
small expansion of the Institutional District that will positively impact the neighborhood
by providing additional off-street parking spaces.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 2018 GRACE
STREET FROM R-1 SINGLE-FAMilY RESIDENTIAL DISTRICT TO 10
INSTITUTIONAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque
Code of Ordinances be amended by reclassifying hereinafter described property
located at 2018 Grace Street from R-1 Single-family Residential District to ID
Institutional, to wit:
lot 4 Hantelmans Subdivision, and to the centerline of the
adjoining public right-of-ways, all in the City of Dubuque, Iowa.
Section 2. That pursuant to Iowa Code Section 414.5 (2001) and as an
express condition of amending the University of Dubuque 10 Institutional
District, the undersigned property owner(s) agree(s) to the following conditions,
all of which the property owner(s) further agree(s) are reasonable and imposed
to satisfy the public needs that are caused directly by the zoning
reclassification:

The following regulations shall apply to all uses made of land in
the above-described 10 Institutional District:

accessory uses in the above-described ID Institutional District:

time and located not closer than two hundred feet (200')
from the nearest Residential or Office Residential District.
b)
All uses customarily incidental to the principal permitted
uses in conjunction with which such accessory uses
operated or maintained, but not to include commercial use
outside the principal building.
No conditional uses shall be allowed.

Performance Standards
The development and maintenance of uses in this ID Institutional District
shall be established in conformance with Section 3-5.2 of the Zoning

Parking Reauirements
The off-street parking requirements for the principal permitted uses for the
herein described ID Institutional District shall be designated by a bracket
enclosed number next to the use, as herein described:

of the Zoning Ordinance by the property owner and/or association.
Sign Reaulations
The sign regulations shall be the same as that which are allowed in the ID
Institutional District as established in Section 4-3.11 of the Zoning
Ordinance.

Transfer of Ownership
Transfer of ownership or lease of property in this ID Institutional District
shall include the transfer or lease agreement a provision that the
purchaser or lessee acknowledges awareness of the conditions
authorizing the establishment of the district.

Modifications
Any modifications of this Ordinance must be approved by the City Council
in accordance with zoning reclassification proceedings of Section 6 of the
Zoning Ordinance.
Recording
A copy of- this ordinance shall be recorded at the expense of the

permanent record of the conditions accepted as part of this
reclassification approval within thirty [30] days of the adoption of
this ordinance. This ordinance shall be binding upon the
undersigned and all his/her heirs, successors and assignees.
Section 3. That the foregoing amendment has heretofore been
reviewed by the Zoning Commission of the City of Dubuque, Iowa.
Section 4. That the foregoing amendment shall take effect upon
publication, as provided by law.

The University would like to relocate the ROTC offices fi-om there current location at 441
McConnick Street to 2184 Bennett Street to make room for a new parking lot. The other lot to
be rezoned is located at 2018 Grace Street which is adjacent to a small University parking lot.
The University would like to expand this parking lot located at the comer of Grace and Algona
Streets fi-om 25 to 44 spaces when funds become available.

Mid summer greetings - I hope this letter finds you well and that you have had time to enjoy this wonderfully
mild summer weather. Before the fall sports teams begin to arrive on campus, I would like to share some
information about a few of our construction projects and future plans.
The work on phase two of the University Park Village Apartments and the interior renovations of Cassat and
Donnell Halls are on schedule and furniture will be delivered next week. A total of 16 trucks will be arriving at
these two projects to deliver furniture to equip 142 double rooms, 23 5-bedroom apartments and 3 Residence Hall
Director apartments. Each day next week there will be two to four trucks parked for unloading on Bennett Street.
The construction of a new parking lot at the corner of Finley and McCormick Streets will begin with the
demolition of the three houses along McCormick Street just south of Finley Street. Completion of this new
parking lot is planned for early this fall, pending good construction weather. The University is also considering
the expansion of the parking lot at the corner of Grace and Algona Streets toward the East. The house at 2018
Grace Street would be demolished to make room for this expansion. This addition will be attractively designed
and landscaped to provide screening to minimize the impact on adjacent neighbors. Depending on design, this
expansion could accommodate up to 22 additional parking spaces.
The area between the Charles A. Myers Library and Smith Hall will soon be transformed into a new beautiful
plaza complete with new walkways, patio area for the coffeehouse, decorative lighting and many beautiful
plantings. The University is also planning to relocate the ROTC faculty offices from 441 McCormick to 2184
Bennett Street to make room for the new parking lot. Attached is an air photo with the locations of the
parking lot expansion and the ROTC faculty offices highlighted in blue and green respectively.

Staff Analysis: The applicant is requesting rezoning of 2018 Grace Street from R-1
Single-Family Residential District to ID Institutional District. The University of Dubuque
proposes to expand an existing 25-space parking lot to address the contingent
increased demand for off-street parking in and around the University of Dubuque
campus.
The subject property is located on Grace Street and is approximately 7,300 square feet
in size. The property is immediately adjacent to an existing 25-space parking lot and
rezoning of the property would facilitate expansion of that lot from 25 to 44 parking
spaces. Screening of the parking lot from adjacent residential property is required by
the City of Dubuque Zoning Ordinance. The Ordinance requires that where adjacent to
residential property that a three-foot high screen be provided.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinances that establishes criteria for rezoning requests.

Dear Commission:
Thank you for the infonnation you sent to the neighborhood concerning the proposed
zoning change for 2018 Grace Street. Because my property is adjacent and as the
neighbor this most directly affects, I want to make a few comments concerning the
matter. I would be present at the meeting, except that my twin daughters arrive back
ITom Gennany on August 5 after a year's study abroad. I don't want to miss our reunion.
My property is located at 1998 Grace Street, which runs the depth of the lot next to 2018
Grace. Mr. Alan Burr, of the University of Dubuque, contacted me prior to my receiving
the Notice of Public Hearing to discuss the possible parking lot expansion and the
rezoning of the property. He graciously met with me at the site to talk about plans and
welcomed my input. We talked about the slope of the land, how the lot would need to be
raised and leveled and a retaining wall built, and how they would handle drainage from
the lot. We also discussed a privacy fence and landscaping.
It is evident that the University of Dubuque needs additional parking with their continued
growth, previous rezoning notices for parking lots, and the number of vehicles that park
on the streets around the University. Mr. Burr explained that the proposed lot would be
restricted parking for faculty and staff, which is the designation for the current lot on the
comer of Algona and Grace. That lot is relatively quiet all day long, including the
beginning and end of the work day, as well as when the University school year is back in
full swing.
Though I would prefer a vacant lot of plush green grass next to my property, that's
unrealistic in such a high profile location. I appreciate Mr. Burr's efforts to discuss the
matter with me ahead of time, to keep me updated on plans, and to assure me of
collaboration on the amenities of the lot. Therefore, I support the University in its effort
to provide additional parking for their employees.
