Duggan and Members of the City Council 1 DATE: September 21,2004 RE: Claim Against the City of Dubuque by Mike Bisdorf Claimant Date of Claim Date of Loss Nature of Claim Mike Bisdorf 09/16/04 09/02/04 Vehicle Damage This is a claim in which the claimant alleges that as he pulled his boat up to the dock at Schmitt Harbor, his boat was scratched by a piece of metal that was exposed on the dock, which had previously been covered by carpeting. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, the first knowledge that the Operations & Maintenance Department had of this defect was when Mr. Bisdorf called to report the incident. Once Mr. Klostermann received the damage report, an Operations & Maintenance crew was dispatched that same day and the dock was repaired. It is therefore the recommendation of John Klostermann to deny this claim since the City had no prior knowledge of the defect. The Legal Department concurs with this recommendation. Mr. Bisdorf alleges that his boat was damaged while using the Schmitt Harbor boat dock. We received our first notice of the missing carpet on the dock when Mr. Bisdorf called to report the damage. Once we received the damage report I dispatched a crew and repaired the dock the same day. Our records show that our first knowledge of this defect is when Mr. Bisdorf called to report the incident. It is therefore my recommendation to deny the claim due to the lack of prior knowledge. If you need any additional information concerning this claim, please contact me.
