NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Appendix A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by amending Ordinance 63-97, which adopted regulations for the property described below and located at Cedar Lake Plaza, 395 Cedar Cross Road in a PUD Planned Unit Development District with a PC Planned Commercial designation to allow a carwash as a permitted use, with conditions as stated below, to wit: Lot 1, Lot B, Lot C, Lot D, Lot E and Lot F, of Cedar Lake Plaza and to the centerline of the adjoining public right-of-way, all in the City of Dubuque, Iowa. Section 2. Pursuant to Iowa Code Section 414.5 (2001), and as an express condition of the reclassification, the undersigned property owner(s) agree(s) to the following conditions, all of which the property owner(s) further agree(s) are reasonable and imposed to satisfy the public needs that are caused directly by the zoning reclassification: A. Use ReQulations. The following regulations shall apply to all uses made of land in the above- described PUD District: 1) Principal permitted uses of the PC Planned Commercial development shall be limited to: a) Public or quasi-public utilities including substations - [47]. b) Mortuarylfuneral home - [6]. c) General office - [14]. d) Medical office/clinic - [36]. e) Dental/medical lab - [8]. [ ] Parking group as per Section 4-2 of the Zoning Ordinance. 2) Accessory uses shall include any use customarily incidental and subordinate to the principal use it serves. B. Lot and Bulk ReQulations. Development of land in the PUD District shall be regulated as follows: All building and structures in the Planned Commercial development shall meet bulk regulations set forth in the Zoning Ordinance for the C-2 Neighborhood Shopping Center District, with the exception that building height shall be limited to 25 feet. C. Performance Standards. The development and maintenance of uses in this PUD District shall be established in conformance with Section 3-5.5 of the Zoning Ordinance and the following standards: 1) Proposed public streets in the Planned Commercial development shall be designed and built to City Engineering specifications. 2) Erosion control devices shall be provided during all phases of construction of the Planned Commercial development. 3) Parking requirements for allowed uses in the PC developments shall be as per the parking group for the designated use, in accordance with Section -4-2 of the Zoning Ordinance. Ordinance No. Page 3 -04 4) Sidewalks shall be provided adjoining all public streets, including Starlight Drive and Cedar Cross Road. 5) Storm water detention facilities will be installed as per City Engineering requirements. 6) Building pads shall be maintained below the grade of Cedar Cross Road and Starlite Drive. 7) Final site development plans shall be submitted in accordance with Section 4-4 of the Zoning Ordinance of the City of Dubuque, Iowa, prior to construction of any buildings. No commercial building shall be constructed unless it was included in final site development plans submitted on a building-by-building basis as the site develops and approved by the Zoning Advisory Commission and City Council. The development and maintenance of a self-service carwash in this PUD District shall be established in conformance with Section 3-5.5 of the Zoning Ordinance, the above-cited performance standards for all uses in this PUD District, and the following additional standards: 1) The carwash must be located in the southeast corner of the Cedar Lake Plaza Planned Commercial District. 2) Curb cuts to Cedar Cross Road shall be restricted to one south of Lake Ridge Road. 3) Live screening shall be provided on the south and west sides of the carwash property as per City Standards. 4) Hours of operation shall be limited between 6:30 a.m. and 10:00 p.m. 5) Outdoor light fixtures shall utilize cutoff luminaries. D. Open Space and Recreational Areas Open space and landscaping in the PUD District shall be regulated as follows: 1) A screen of deciduous and evergreen trees shall be planted along Starlite Drive and Cedar Cross Road to act as a buffer between the proposed Planned Commercial Development and the adjacent existing residential development. Evergreen screening to be 6 feet in height within three growing seasons shall be planted 5 feet on center in this buffer. 2) Those areas not designated on the conceptual plan for development shall be maintained as open space, as defined by Section 8 of the Zoning Ordinance, by the property owner and/or association. Signs in the PUD District shall be allowed in the Planned Commercial development in accordance with the C-2 sign regulations of Section 4-3.11 of the Zoning Ordinance. F. Transfer of Ownership Transfer of ownership or lease of property in this PUD District shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the district. G. Reclassification of Subject Property. The City of Dubuque, Iowa, may initiate zoning reclassification proceedings to the AG Agricultural District in accordance with Section 6 of the Zoning Ordinance if the property owner(s) fail(s) to complete or maintain any of the conditions of this ordinance. H. Modifications. Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Section 6 of the Zoning Ordinance. I. RecordinQ. A copy of this ordinance shall be recorded at the expense of the property owner(s) with the Dubuque County Recorder as a permanent record of the conditions accepted as part of this reclassification approval within thirty (30) days after the adoption of this ordinance. This ordinance shall be binding upon the undersigned and his/her heirs, successors and assigns. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Commission of the City of Dubuque, Iowa. Section 4. The foregoing amendment shall take effect upon publication, as provided by law. Kritz, Associate Planner 1.1 7¿ TO: SUBJECT: Amendment to Cedar Lake Plaza Planned Commercial District INTRODUCTION The Cedar Lake Plaza Planned Commercial District was established in 1996. The district allows for mostly retail and service-oriented commercial land uses. The applicants wish to amend the list of permitted uses to include self-service car wash, Attached to this memo is Ordinance No. 63-97 that regulates the permitted uses in the Cedar Lake Plaza Planned Commercial District. DISCUSSION The applicants are requesting that the Planned District for Cedar Lake Plaza be amended to allow self-service carwash as a permitted use. Self-service carwashes are currently allowed as a permitted use in the C-3 General Commercial, Commercial Recreation, and all industrial districts. Self-service carwashes are also allowed as a conditional uses in C-2 and C-4 Districts. The applicants are proposing to develop a four-bay self-service carwash similar to their existing facilities on Pennsylvania Avenue and southeast of the intersection of U.S. 61/151 and U.S. 52. The applicants anticipate constructing the carwash in the southeast corner of Cedar Lake Plaza adjacent to Cedar Cross Road, Access to the carwash would be from Cedar Cross Road. The current list of allowed uses for the Cedar Lake Plaza development is a mixture of C-2 and C-3 uses. The PUD ordinance for Cedar Lake Plaza requires that all final site development plans be approved by both the Zoning Advisory Commission and the City Council. If the proposed amendment to allow a self-service carwash to the list of permitted uses for this Planned Commercial District were approved, the Zoning Advisory Commission and City Council would again see the project prior to construction as an action item on their agendas. RECOMMENDATION Planning Staff recommends that the Zoning Advisory Commission review the standards for approving Planned Unit Development Districts. They are planning to locate this in the Cedar Lake Plaza where our current business is located. Our business consists of medical care for patients with neurological diseases, This includes sleep disorders and epilepsy. Our neurodiagnostic center is equipped with 4 sleep labs and a neurodiagnostic lab consisting of electroencephalogram, which are neurological tests that diagnose sleep disorders and various types of epilepsy respectively. These types of tests require a quiet environment and also prohibit such things as bright lights and noises since that would interfere with the study, We function 24 hours a day as a sleep lab, We are doing daytime sleep studies and also nighttime sleep studies. To put a car wash in our vicinity would mean that there would be a very bright lighted area 24 hours a day with constant noise from vacuum cleaners and from the traffic. I also see patients clinically during the day and that also requires a quiet environment so I can intensely listen to the needs of our patients for treatment and diagnosis. We were told by Mr, Hansel, who developed this area and sold us the property, that the buildings that would be put in this area would be compatible to what is already in the area, which includes our building and East Dubuque Savings Banle Allowing construction of a car wash in this area would not be compatible structurally or esthetically, It should be constructed in an area with buildings of similar structure. If this car wash is allowed in this zone then there would be no control of what other building types would follow. Therefore, in conclusion it is not an acceptable situation for us in tenns of our business and what it serves and not compatible with the esthetics of the environment we are in. In addition, it goes against the promises by the developer who made the comment several times that there would be no buildings allowed in this area that would be incompatible with the structural characteristics of the buildings that are already established, .. Application to Amend the PUD Planned Unit Development to allow a car wash as a permitted use Dear Mr. Stiles and Members of the Commission: I am writing in my capacity as President of the Turnberry Condominium Owners Association to convey that the Association, by a unanimous vote of its Board of Directors, opposes the above-referenced Application. As you know, Turnberry is located on Woodland Ridge, and abuts the property which is the subject of the Application. I think it's fair to say that many of the Association's members purchased their property in Turnberry relying on the current permitted uses under the PUD Ordinance 63-97. In reviewing the permitted uses, we note that there is no current pennitted use that is remotely "automotive" in nature, and we do not believe that the proposed use is consistent with the current permitted uses. To recommend approval of the Application would, in our view, constitute nothing less than spot zoning, and which would be unfair to the adjoining owners, as well as to the current owners of property within the PUD such as Dr. Sterrett and East Dubuque Savings Bank. Secondly, we have concerns about light and noise pollution, the latter ITom blower motors and vacuum, and about trash accumulation. Finally, the curve of Cedar Cross Road where the applicants request a curb cut already has four curb cuts, a City street and a parking lot opening directly onto Cedar Cross Road, all within a very short distance. It seems to us that the City should have some safety concerns about adding an additional curb cut to what is already a congested area. Dear Mayor Duggan and Dubuque City Council Members: We are writing to you as private citizens and residence of Dubuque to express and convey our opposition to the above referenced zoning amendment. My wife and I reside at 585 Woodland Ridge which is a part of Turnberry Condominium properties that adjoins the Cedar Lake Plaza area on the west. Our primary concerns and opposition to this proposed amendment are twofold in nature. First, we, along with many other residential and business owners, made investments in our residence and!or business based on the zoning that was in effect at the time of making said investment. Specifically, we make reference to the current zoning of Cedar Lake Plaza that was done in 1997. City Ordinance No. 63-97 clearly and specifically set forth the conditions of reclassification of this property to C2 Neighborhood Shopping Center District. As was very explicitly pointed out by Mr. Richard Schiltz, a member of the Zoning Advisory Commission, all permitted uses of the PC Planned Commercial development were thoroughly examined and anything remotely connected to " automotive" was not included. We would ask this board what has changed in the past seven years? Mr. Anderson and his associate have said they would only ask for the area of their proposed business to be amended. Mr. Schiltz also pointed out that this would likely be the first step toward more erosion of the original intent of the ordinance as established in 1997. We would suggest that Mr. Anderson's request to amend a portion of the Cedar Lake Plaza would be a classic example of "spot" zoning. We believe that we as investors and residence have a right to expect that our investments will be protected by the zoning ordinances that were in effect at the time of our purchase. Secondly, we believe there is a sufficient safety concern to preclude the approval of this amendement request. Cedar Cross Road currently carries over 12,000 vehicles daily and is increasing at the rate of approximately 3% annually. Those of us who travel Cedar Cross on a regular basis see the dangers of adding more congestion and traffic to an already hazardous area. We can only imagine what the dangers will be of pulling out of the proposed car wash, attempting to make a left turn onto Cedar Cross Road. Without trying to sound prophetic, we can assure you that it is an accident waiting to happen. We would respectfully request that you at least do an engineering traffic study before you approve this amendment request. In closing, we think this is the wrong business in the wrong location. Dear Mayor Duggan and Dubuque City Council Members: I am writing to you in my capacity as President of the Turnberry Condominium Owners Association to convey that the Association's Board of Directors and our homeowners unanimously oppose the above-referenced zoning amendment. Turnberry is located on Woodland Ridge Drive, Lake Ridge Drive and Starlight Drive. Cedar Lake Plaza is at the comer of Starlight Drive and Cedar Cross Road and adjoins our Turnberry Condominium property. Cedar Cross Road currently carries over 12,000 vehicles daily with an anticipated volume increase of3% each year. It is one of the main thoroughfares between US Highway 20 and housing developments to the south. Dubuque residents also use this road as part of a shortcut to US Highways 151 and 61. We are concerned that any curb cuts on Cedar Cross Road into Cedar Lake Plaza will impede the heavy flow of traffic and will be a safety hazard to motorists. The requested curb cut for the car wash entrance is on the radius of a street curve and at the beginning of a narrowing of Cedar Cross Road. We respectfully request that an engineering traffic study be made to detennine the effects of traffic turning into a Cedar Lake Plaza car wash located on Cedar Cross Road. " ~ ,'. :1 J The current zoning of Cedar Lake Plaza was done in 1997. City Ordinance No.63-97, as an express condition of the reclassification of this property to a C2 Neighborhood Shopping Center District, includes a list of specific businesses that would be allowed under the PC Planned Commercial Development. None of the listed businesses permit a car wash or any automotive related business. Property owners such as Tumberry Condominiums, Sterrett Neurology and Neurodiagnostic (sleep clinic) Clinic and East Dubuque Savings Bank made location decisions based on the City Ordinance No.63-97. It is unfair to these property owners to change the Ordinance after they have invested in land and buildings that are a part of or adjacent to Cedar Lake Plaza. Weare concerned about the affects of noise and lighting from the proposed car wash. Residences located on the eastside of Cedar Cross Road, Tamarack and Obeche Courts, will be subject to a high level of noise from high pressure sprayers, dryers and vacuum cleaners. Many of these homes are a split-level design and upper floor living areas are eight feet above grade and will look down on the Cedar Lake Plaza car wash. Noise and lighting will funnel from the concrete wash bays and asphalt driveways facing east directly into the back yards and windows of these residences. There is an identical problem for the properties on the westside of the car wash, namely Sterrett Clinic and Tumberry Condominiums. Noise and lighting will again be trumpeted from the concrete car wash building to our patios, decks and windows. Developers have committed to the Zoning Commission to reduce lighting and install sound barrier plantings but there is little we can do if these are not effective. A residential neighborhood is a poor fit for a car wash. Car Wash businesses belong in heavily commercial areas. The Anderson/Schaul Car Wash in Keywest is next to a gas station and their Pennsylvania Street location is across the street from an industrial park. Residences behind their Pennsylvania Street car wash, on Northrange Court, are approximately 20 feet below the grade of the car wash driveway and are spared much of the noise above them. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed location and operation of the proposed carwash. He expressed a willingness to address neighborhood concerns. The applicant submitted a proposed site location labeled "Lot Z" in the southeast corner of Cedar Lake Plaza. Staff reviewed the history of zoning changes on the parcel and reviewed the existing list of permitted uses for the Planned Commercial District. There were several public comments concerning the potential adverse impacts created by the carwash, including noise, lighting and traffic. Letters and petitions from property owners in opposition were received and filed by the Commission. The percent of opposition is 64.6% with 5.9% within the PUD and 58.7% within 200 feet. The Zoning Advisory Commission discussed the request, noting that the proposed location of the carwash will help buffer surrounding residential dwellings. The Commission also discussed several conditions to further mitigate adverse impacts. The carwash must be located in the southeast corner of the Cedar Lake Plaza Planned Commercial District. 2. Curb cuts to Cedar Cross Road shall be restricted to one south of Lake Ridge Road. 3. Live screening shall be provided on the south and west side of the carwash property as per City Standards. 4. Hours of operation shall be limited between 6:30 a.m. and 10:00 p.m. 5. Outdoor light fixtures shall utilize cutoff luminaries. Based on a District Court ruling in Dubuque, a PUD amendment is not a rezoning. Therefore, the percentage of opposition does not require a super majority vote of City Council to approve the request. A simple majority vote is needed for the City Council to approve the request subject to the recommended conditions. A super majority vote is necessary to change any of the recommended conditions.
