Dear Mr. McCann:
In accordance with the City Development Board's request at its May 13, 2004,
meeting, Dubuque has undertaken the following efforts to encourage the owners of
parcels 13J, 13K, 13L, 13M, Parcel 1 and that part of Parcel 2 lying north of Asbury
Road to voluntarily sever from Dubuque and annex to Asbury once this annexation is
complete. See Attachment 1 for a map identifying the affected parcels.
1. On May 14, 2004, I issued a media release which stated that Dubuque "will
work with the Citv of Asburv and affected propertv owners to implement the
condition requested. The Citv has alwavs been supportive of this compromise
and offered it at the Board's public hearina in Dubuaue on April 1". See
Attachment 2 for a complete copy of the media release.
2. On June 1, 2004, I sent letters to the owners of each of the affected parcels
which stated that "Dubuaue encouraaes vou to favorablv consider severina vour
propertv from Dubuaue and annexina to Asburv. The Citv of Dubuaue will help
in anv wav that we can to facilitate that process." See Attachment 3 for copies
of the letters.
3. On June 7, 2004, the Dubuque City Council passed a resolution authorizing the
Mayor "to convev to the Mavor of Asburv that the Citv of Dubuaue will make all
reasonable aood faith efforts to work with the affected propertv owners... and
to have those parcels voluntarilv annex to Asburv." The resolution also
authorized me to initiate discussions with the Mayor of Asbury and the affected
property owners "to secure an aareement providina for the severance of the
above listed parcels and their annexation to Asburv. ' See Attachment 4 for a
copy of the resolution.
4. On June 8, 2004, Dubuque Mayor Terrance M. Duggan sent a letter to Asbury
Mayor Rick Anderson "to seek the Citv of Asburv's cooperation in facilitatina
severance from Dubuaue and annexation to Asburv" of the affected parcels.

The letter further stated that "Citv Manaaer Michael Van Milliaen will contact
vou shortlv to schedule an initial meetina to confirm that the Citv of Asburv is
willina to annex these parcels: and if so, Mr. Van Milliaen would like to discuss
with vou coordinatina discussions with affected propertv owners to implement
this transition. ' See Attachment 5 for a copy of the letter.
5. Also on June 8, 2004, I contacted Asbury Mayor Rick Anderson and a meeting
was arranged for June 11, 2004, to discuss the severance and annexation of
the affected parcels. See Attachment 6 for a copy of the memorandum
summarizing my discussions with Mayor Anderson on June 8, 2004.
6. Before the meeting with Mayor Anderson on June 11, 2004, Dubuque prepared
two different form letters that property owners could sign. One form letter
requested severance from Dubuque and the other form letter requested
annexation to Asbury. See Attachments 7 and 8 for copies of the letters.
7. On June 11, 2004, I met with Mayor Rick Anderson. Also present were
Dubuque Corporation Counsel Barry Lindahl and Asbury City Administrator
Beth Bonz. At the meeting, I pledged that Dubuque would do whatever it
reasonably could to accomplish the City Development Board's objectives. I
also gave Mayor Anderson the form letters. I confirmed with Mayor Anderson
that Asbury was willing to annex the properties if they were severed and I
requested that the Asbury City Council adopt a resolution to that effect. I also
advised Mayor Anderson that Corporation Counsel Barry Lindahl, Planning
Services Manager Laura Carstens and J would be willing to participate in any
meetings Asbury had with the property owners if Asbury so desired. Mayor
Anderson stated that Asbury would arrange the meetings for the property
owners and let me know if Asbury needed assistance from Dubuque. I
reiterated that Dubuque was very interested in facilitating this process and
would like to have one or more representatives participate in these meetings.
8. On June 17, 2004, I sent a letter to Mayor Anderson confirming our June 11,
2004, discussions and providing him with additional copies of the
severancelannexation letters for property owners to sign. Attachment 9 is a
copy of my letter of June 17, 2004, to Mayor Anderson.
9. On July 21, 2004, Dubuque received a letter from Asbury indicating that Asbury
had contacted the affected property owners. The letter transmitted copies of
voluntary annexation requests from the owners of Parcels 13J, 13K, 13L and
13M. Mayor Anderson's letter also included a copy of a letter dated July 5,
2004, from Terry Bahl and Marty Bahl (the owners of Parcel 1) indicating their
willingness to meet and discuss the annexation. Attachment 10 is a copy of
Mayor Anderson's July 21, 2004, letter with enclosures.
10. On July 22, 2004, Bill Bahl, representing the Bahl Family Partnership, (owner of
Parcel 2), contacted me and asked for a Dubuque representative to attend a

meeting of the Bahl family representatives with Asbury officials scheduled for
July 28, 2004.
11. On July 28, 2004, Corporation Counsel Barry Lindahl and I attended the
meeting involving Bill Bahl, Terry Bahl, Marty Bahl, Asbury Mayor Rick
Anderson and Asbury City Administrator Beth Bonz. Although no agreement
was reached at the July 28, 2004, meeting for the severance of the Bahl
interests, Dubuque encouraged the parties to continue negotiations.
12. On August 5, 2004, Asbury appealed the City Development Board's decision
approving this annexation. Dubuque has been advised by its legal counsel that
the annexation is not complete until the applicable parts of the record have
been filed and recorded with the Dubuque County Recorder and the Secretary
of State. Dubuque understands that these filing have not, as yet, been made.
Therefore, although Dubuque stands ready to approve severance for those
parcels that have signed applications for annexation to Asbury, it is unable to do
so until the annexation is complete. Further, Dubuque remains committed to
working with Asbury to encourage the severance of Parcel 1 and that part of
Parcel 2 lying north of Asbury Road and annexation of that land to Asbury once
this annexation is completed.
In conclusion, the City of Dubuque respectfully requests that the City Development
Board accept this status report and that the City Development Board make a
finding in the record at its October 14, 2004, meeting that the City of Dubuque has
complied with the Board's request to encourage the voluntary severance of the
affected parcels from Dubuque and the voluntary annexation of these parcels to
Asbury.

State Board Gives Conditional Approval to City's Annexation Plan
The State of Iowa City Development Board approved the following motion by Board member
Dennis Plautz at its meeting Thursday in Des Moines:
"I move that the Board approve NCO4-03 upon condition that the City of Dubuque make every
reasonable effort to secure an agreement with the City of Asbury and the owners of parcels listed
which I will read for the record to provide for severance ofthose parcels from Dubuque and the
annexation of those parcels into Asbury. Those parcels being: l3-j, l3-k, 13-1, l3-m, Parcel I,
and that part of Parcel 2 lying north of Asbury Road. And then further, no later than October 4,
2004, the City of Dubuque report to the Board the status of the City's efforts to secure an
agreement providing for the severance of the above listed parcels and their annexation to
Asbury."
'The City of Dubuque is pleased with the Board's decision, and will work with the City of
Asbury and affected property owners to implement the condition requested," said Mike Van

RESOLUTION IN SUPPORT OF CITY DEVELOPMENT BOARD'S CONDITIONAL
APPROVAL OF VOLUNTARY ANNEXATION OF TERRITORY TO DUBUQUE
Whereas, the City Council of the City of Dubuque, Iowa has approved the
annexation of approximately 704.5 acres of territory to the City of Dubuque, Iowa; and
Whereas, the City Development Board of the State of Iowa has approved the
annexation of this territory to the City of Dubuque, Iowa, upon condition that the City of
Dubuque make every reasonable effort to secure an agreement with the City of Asbury
and the owners of parcels listed in the record, those parcels being: Parcel 13-j, Parcel
13-1<, Parcel 13-1, Parcel 13-m, Parcel 1, and that part of Parcel 2 lying north of Asbury
Road to provide for severance of those parcels from Dubuque and the annexation of
those parcels into Asbury, and then further, no later than October 4, 2004, that the City
of Dubuque report to the Board the status of the City's efforts to secure an agreement
providing for the severance of the above listed parcels and their annexation to Asbury;
and
Whereas, the City of Dubuque intends to make all reasonable, good faith efforts

the affected property owners and the City of Asbury to sever Parcel 13-j, Parcel 13-1<,
Parcel 13-1, Parcel 13-m, Parcel 1, and that part of Parcel 2 lying north of Asbury Road
from Dubuque and to have those parcels voluntarily annexed to Asbury.
Section 2. That the City Manager is hereby authorized to initiate discussions
with the Mayor of Asbury and the affected property owners, and to file a report with the
City Council and the City Development Board no later than October 4, 2004 on the
status of the City's efforts to secure an agreement providing for the severance of the
above listed parcels and their annexation to Asbury.

2004 City Council meeting.
On Tuesday, June 8, 2004, at 11 :15 a.m., I called Asbury City Hall to speak with Mayor
Anderson and he was not in the office. I left a message asking him to call me about
annexation.
On June 8 at 1 :08 p.m., Mayor Anderson called me and I was out of the office, but he
left his cell phone number.
On June 8 at about 2:30 p.m., I phoned Mayor Anderson and we agreed to meet, but
first he had to check his calendar.
On June 8 at 2:37 p.m., Mayor Anderson called Office Manager Juanita Hilkin and
arranged a meeting for June 11, 2004 at 3:00 p.m. in my office.
I phoned Mayor Anderson to confirm and he advised that he would bring Asbury City
ClerklAdministrator Beth Bonz and he agreed that I could bring you so we would
understand the legal issues of severance.

Dear Mayor Anderson:
I am writing on behalf of the City of Dubuque to confirm the City of Asbury's cooperation in
facilitating severance from Dubuque and annexation to Asbury of the following parcels shown on
the endosed annexation map that were induded in the Dubuque annexation that was recently
approved by the City Development Board: Parcel 1, That portion of Parcel 2 north of Asbury
Road, Parcel13-j, Parcel 13-k, Parcel 13-1, and Parcel 13-m.
Corporation Counsel Barry Undahl and I met with you and Asbury City Administrator Beth Bonz
on Friday, June 11th at 3:00 p.m- at Dubuque City Hall. The meeting was arranged by my
invitation.
The purpose of this letter is to: [a] confirm the matters discussed at the meeting, [b] set forth the
actions to be taken to accomplish the COB's directive, and [c] reiterate Dubuque's pledge of
cooperation.
At the meeting, I first pledged to do whatever is reasonable to accomplish the City Development
Board's objectives. I then provided you with the following:
1, Copy of the June 8th letter from Mayor Duggan to yourself (enclosed), which you
acknowledged you had received. You provided me with a copy of a letter you had sent back to
Mayor Duggan (enclosed).
2. Copy of the annexation map (endosed).
3. Copy of June 1st letters that I had sent to the owners of the six parcels (endosed),
I confirmed with you that Asbury was wiDing to annex the properties, if they are severed, and then
I asked if the Asbury City Council would adopt a resolution to that affect, You said it would be on
the next Asbury City Council agenda.
I provided you with sample draft letters (endosed) that property owners could sign, the first
asking for severance from Dubuque, and the second requesting annexation to Asbury.

I then told you that Barry Undahl, Planning Services Manager Laura Carstens and I would be
willing to participate in any meetings Asbury had with the property owners, if Asbury so desired.
You advised that Asbury would arrange meetings with the property owners and let me know if
Asbury needed assistance from Dubuque.
I would like to reiterate that the City of Dubuque is very interested in facilitating this process and
would like to have one or more rep~ntatives participate in these meetings.
You also asked what Dubuque was willing to do if all property owners did not want to voluntarily
sever. I advised you that Dubuque would make every reasonable effort to encourage the
property owners to accept the City Development Board's recommendations.
You stated that City Development Board Administrator Steve McCann had told you there was a
year long process that could be used to deal with property owners that would not sever. I
advised that I was not familiar with this process. It is Dubuque's understanding that the City
Development Board wanted to encourage voluntary severance,
You then asked about Parcel13-q. It is my understanding that this parcel was not included in the
City Development Board's directive' and therefore is not one of the parcels for which severance is
being recommended.
The City of Dubuque pledges to make all reasonable, good faith efforts to worlt with the affected
property owners and the City of Asbury to comply with the City Development Board's objectives.
Please contact me with any questions or if Dubuque can be of further assistance.

The City of Asbury has contacted the property owners that were affected by the City
Development Board annexation decision of May 13,2004. The following property
owners have sent written confinnation of interest to annex their properties into the City of
Asbury:
Parcel l3-j (owners - Stanley and Lou Ann Ward)
Parcel 13-k (owner - Karen Cogan)
Parcel 13-1 (owner Wayne Siebert)
Parcell3-m (owners Donald and Luella Cogan)
We have also received correspondence from Terry, Martin and Linda Bahl to meet and
have further discussion regarding the annexation of their property.
The City of Asbury will continue to make all reasonable efforts in cooperating with the
City of Dubuque in this matter.
