Dear Congressman Nussle:
I write to ask that you refrain from adding your name to a letter being circulated by
Representative Pickering calling upon the FCC to conduct an expedited proceeding to
conclude that IP enabled services are interstate in nature.
State and local government officials do not believe that alilP services are interstate in
nature and that it is dangerous for Representative Pickering to make such a conclusion
before a full record is established on the subject. There is much more at stake than
mere definitions or classification in this debate. The finding that alilP services, such as
VoIP, are purely interstate in nature could jeopardize numerous important public policy
objectives such as universal service, consumer safeguards and state and local tax
authority,
It is interesting to note that the Senate Commerce Committee, when faced with this
same issue in marking up Senator Sununu's VolP bill, concluded that not alilP services
are interstate. The Senate reserved certain rights and authority to state and local
governments in order to protect consumers.
We believe that following a full debate on the issue that the House of Representatives
will reach the same conclusion, Please do not sign Representative Pickering's letter.

Thank you for your letter regarding the costs incurred by the
City of Dubuque in operating floodwall pumping stations during
the flooding disaster in May 2004. I am glad to have the benefit
of the details of this particular situation.
In order to be more responsive to your concerns, I have taken the
liberty of contacting the Federal Emergency Management Agency and
the Army Corps of Engineers regarding this matter. I will be
back in touch with you as soon as the responses are received in
my office.
