Plaintiff for a claim against Defendant states:
NOTICE

1. This is a mortgage foreclosure action under Chapter
654 of the Iowa Code. The mortgaged property is not used for an
agricultural purpose, as defined in Section 535.13 of the Iowa
Code.
2.
Plaintiff is a Wisconsin Banking Corporation with an
office at 25 East Pine Street, Platteville, Wisconsin. The
property, which is the subject of this action, is located in the
City of Dubuque, Dubuque County, Iowa.
3. On the 9th day of June, 2003, Defendant, David J. Lape,
executed and delivered to Plaintiff in Dubuque, Iowa, a written
Mortgage Note (Note) in the amount of $20,599.67 with interest
thereon at the adjustable rate of 5.59% per annum, a copy of
which is attached hereto as Exhibit "A."
4. To secure the said note, Defendant made, executed and
delivered to Plaintiff a Mortgage upon the following described
real estate:
The South ~ of Lot 174 in East Dubuque, an
Addition in the City of Dubuque, Iowa,
according to the recorded plat thereof.
Situated in Dubuque County, Iowa.
A copy of the Mortgage is attached as Exhibit "B." The Mortgage
was recorded in the office of the Dubuque County, Iowa, Recorder
on June 23, 2003, as Instrument No. 15938-03.
5. Defendant has been provided with due Notice of Default
and opportunity to correct default. A copy of said notice is
attached as Exhibit "C."
6. The payments on the Note are past due and Plaintiff
has elected and does hereby reaffirm its election, pursuant to
the terms of the Note, to accelerate the time of payment of the
Note and Mortgage and does hereby declare the entire
indebtedness immediately due and payable.
7. The indebtedness now due and payable under the Note
and secured by said Mortgage consists of: a) an unpaid
principal balance of $19,882.52; b) interest of $379.01 as
provided in the Note on the unpaid balance to July 20, 2004; c)
late charges in the total amount of $51.00 as of July 20, 2004;
and d) interest as provided in said Note on the unpaid balance
to the date of judgment herein, which interest accrues at the
rate of $3.03 per day from July 20, 2004.
8. The Mortgage provides that in the event of default,
suit and foreclosure the mortgagee's attorney's fees shall be
paid by the mortgagors. Plaintiff's attorney attaches the
affidavit for such fees as is required by statute.
9. The Mortgage provides for the payment of the cost of
any title search procured for the purposes of foreclosure and
that Plaintiff has procured such search at the cost of $185.00.
10. Defendant is not nor has been at any time within the
preceding six months, a member of any of the armed forces of the
United States of America and is not entitled to in any way or
manner to the benefit or relief provided by the Soldiers and
Sailors Civil Relief Act.
11. Defendants, the CBE Group, Inc., City of Dubuque, and
State of Iowa, have or claim to have some lien upon or interest
in the premises described above. Whatever lien or interest said
Defendants may have is junior and inferior to the lien of
Plaintiff's mortgage as described above.
12. Plaintiff waives its rights to a deficiency judgment
in this matter.
WHEREFORE, Plaintiff prays:
A. Judgment against Defendant, David J. Lape in rem
against the above-described real estate for the sum of
$19,882.53 plus late charges in the total amount of $51.00, plus
interest as provided in the note and mortgage on the unpaid
balance from July 20, 2004, to the date of judgment herein
(which interest accrues at the rate of $3.03 per day), plus
reasonable attorney's fees, plus abstracting costs and expenses
determined by the Court and for such other and additional costs
as may be incurred by Plaintiff.
B. Judgment and Decree establishing Plaintiff's real
estate mortgage upon the following described real estate, to
wit:
The South ~ of Lot 174 in East Dubuque,
an Addition in the City of Dubuque,
Iowa, according to the recorded plat
thereof. Situated in Dubuque County, Iowa,
as a first and superior lien upon the above-described real
estate, and foreclosing said real estate mortgage for the full
amount of the aforesaid judgment, interest and costs.
C. Judgment establishing its mortgage lien as of June 23,
2003, and that the lien, claim, right, title and interest upon
the mortgage premises of the Defendants in this action be
adjudged and decreed to be junior, inferior and subject to
Plaintiff's first mortgage lien and that the Plaintiff's first
mortgage lien be adjudged and decreed to be prior, superior and
paramount as against the Defendants herein, and as against any
and all persons claiming by, or through the Defendants with
respect to the real estate which is the subject matter of this
action; that Plaintiff's first mortgage be foreclosed and that
the equity of redemption of the Defendants herein be barred and
foreclosed, subject only to such rights of redemption as may be
provided by statute; that a special execution issue from this
Court directing the sale of said mortgaged premises or so much
thereof as may be necessary to satisfy said judgment, interest
and costs, and the Court further adjudge and decree that should
any of said real estate be sold and not redeemed within the
manner and time provided by law or within one year from the date
of sale that this Court issue a writ of possession to the
Sheriff of this County authorizing, empowering and directing
said Sheriff to remove any and all persons therefrom and put the
purchaser under this foreclosure in possession thereof.
D. Judgment that in the event Plaintiff shall pay any
taxes or special assessments which are or may become a lien
against the real estate or advance any other sums as protected
disbursements secured by said real estate mortgage, including,
but not limited to, insurance, abstracting expenses, and other
expenses as provided for in this mortgage, Plaintiff be given an
additional lien against the real estate for the amounts so
advanced.
E. Such other and further relief as may be just and
equitable in the premises.
