Vehicle Damage
This is a claim in which the claimant alleges that her vehicle sustained tar damage after
she drove on Broadway Street, during a construction project.
According to the report of Gus Psihoyos, Acting Public Works Director, this claim relates
to the 2004 Asphalt Paving Project that is being done by River City Paving Company.
Although there were "Fresh Oil" signs posted at the beginning and end of the project
area, the contract with River City Paving Company called for the standard form of
contracts and bonds with the City, which require the contractor to hold the City harmless
from any claims of damage resulting from the work.
It is therefore the recommendation of Gus Psihoyos to forward this claim to River City
Paving Company for its investigation. The Legal Department concurs with this
recommendation.

SUBJECT: Claim Against the City of Dubuque by Amy Pitz
This claim relates to the 2004 Asphalt Paving Project that is being done by River
City Paving Co, A Division of Mathy Construction. The contract called for the
standard form of contracts and bonds with the City, which require the contractor
to hold the City harmless from any claims of damage resulting from the work.
Therefore, it is the recommendation of the City Engineering Division that this
claim for damages be forwarded to River City Paving Co. for further
consideration/processing.
Please note that "Fresh Oil" signs were posted at the beginning and at the end of
the project area.
