Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request indicating he wants to subdivide the property in
order to facilitate relocation of an area business. The property is properly zoned for the
business.
Staff Member Kyle Kritz indicated that the City reviews lot splits within 2 miles of the City
limits. The submitted plat is consistent with the preliminary plat for Tamarack Business
Park, subject to waving Article IV, except for Section 42-A of the City of Dubuque
Subdivision Regulations. He noted it will provide a relocation site for Mulgrew Oil Company.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted plat is in
substantial compliance with the City of Dubuque Subdivision Regulations.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving Article IV, Design and Improvement Standards,
except for Section 42-A, Blocks and Lots.
A simple majority vote is needed for the City Council to approve the request.

County
INTRODUCTION
The subject property is within two miles of the City of Dubuque, thus the plat is jointly
reviewed by both the County and City of Dubuque. The submitted final plat is
considered a minor subdivision as it subdivides an existing parcel into three lots. Lots 6
and 7 are to be utilized by Mulgrew Oil Company.
DISCUSSION
The submitted final plat of Lot 6, Lot 7, and Lot C Tamarack SE 4th Subdivision
subdivides an existing parcel along Silverwood Drive in the Tamarack Business Park
into two new lots. The two parcels will be occupied by Mulgrew Oil Company which is
relocating from the south side of the Ice Harbor within the area rezoned to the Port of
Dubuque Planned Unit Development District. The submitted final plat is consistent with
the approved Preliminary Plat of Tamarack Business Park.
RECOMMENDATION
Planning Staff recommends that the submitted final plat of Lot 6, Lot 7, and Lot C
Tamarack SE 4th Subdivision be approved as it is in substantial compliance with the City
of Dubuque Subdivisions Regulations, subject to waiving Article IV, Design and
Improvement Standards, except for Section 42-19, Blocks and Lots.

RESOLUTION NO. 388-04
RESOLUTION APPROVING THE FINAL PLAT OF LOT 6, LOT 7 AND LOT C
TAMARACK S.E. FOURTH SUBDIVISION IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a final plat of Lot 6, Lot 7 and
Lot C Tamarack S.E. Fourth Subdivision; and
Whereas, the final plat has been examined by the Zoning Advisory Commission
and has its approval endorsed thereon, with the waiver of Article IV, Design and
Improvement Standards of the Subdivision Regulations, except for Section 42-19,
Blocks and Lots; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks
and Lots.
Section 2. That the final plat of Lot 6, Lot 7 and Lot C Tamarack S.E. Fourth
Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized
and directed to endorse the approval of the City of Dubuque, Iowa, upon said
subdivision plat.
