That the City Attor- ney be and he is hereby directed to defend the defendants in the above entitled cause of action pending in the United States Dis- trict for the Northern District of Iowa, Eastern Division and that his efforts heretofore made in the defense of said came be and the same are hereby ratified and con- firmed and the said City Attorney 1 is further directed to do any and all things necessary for the proper defense of said cause and neces- sarily incidental thereto. That in view of the unusual nature 01 this Htigation and in view of the fact !hot said action poses numerous and com- plex problems and in view of the fact that the defense of said cause will require extensive expenditure of time and energies pursuant thereto, it is the decision of the City Council that the defense of said cause be considered beyond the scope of the employment of said City Attorney and beyond the scope of his salary and therefore it is the judgment of the City Council that the said City Attor- ney be paid additional compensa- tion for the defense of said actiou which compensation fixed at the rate fixed and allowed by the Iowa State Bar Association Fee Sched- ule. This agree- ment is for financial state partici- pation in tbe installation of traffic signals at the intersection of 32nd Street and Central Avenue. The agreement stipulates that the city initially shall pay the com- plete cost of the installation- The city has completed installation of this project and upon execution of the attached agreement will be able to receive from the state 22% of the cost of the installation. Having worked on the conver- sion of the third floor 8 years ago, I was quite sure that we had a good base on which to make im- provements. The floor joists which we inspected were between 2%" and 3" wide and a full 12" deep. They were spaced 16" on center and were made of northern pine. We estimate on this basis that the joists will carry over 90 pounds per square foot. Mayor & City Council Gentlemen: On the 28th day of October, 1969, Amelia Stecher filed claim against the City of Dubuque alleging per- sonal injuries as the result of a fall on October 18, 1969 and alleging that on said date when she was walking from her home at 1843 White Street to the Donovan's Food Market at 18th and Central and when she crossed the crosswalk at 18tb and Central and put her right foot on the curb, her knee gave way and she, being unable to re- gain her balance, fell on her back, and said fall resulting in a fracture of her right hip. Claimant alleges that her foot turned on an unlevel part of the curb where she stepped on tbe curb and claims negligence on the part of the City of Dubuque, Iowa. I have made an Investigation of this matter, have conferred with Special Session, March 23, 1970 99 the representative of the claimant, Mrs. LeRoy Birch, have examined the site of the alleged incident and it is my opinion that the fall and injuries of Amelia Stecher was due to factors other tban the negligence of the City of Dubuque and there- fore recommend denial of said claim.
