City Engineer Gus Psihoyos is recommending acceptance of the public improvements,
with the exception of the storm water detention facilities, that the developer, Callahan
Construction, has recently completed on North Westbrook Drive, South Westbrook
Drive, Trails Edge Drive, Pebble Creek Drive and Commerce Park in Westbrook
Subdivision — Phase 1. Maintenance of said improvements shall be the responsibility of
the owner, Callahan Construction, for a period of two years from the date of
acceptance. The storm water detention facilities may be accepted after 80% of the lots
in the entire Westbrook Subdivision are developed and adequate erosion control
measures are installed on the remaining 20% of the Tots.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed material provides for City Council acceptance of the public improvements
on North Westbrook Drive, South Westbrook Drive, Trails Edge Drive, Pebble Creek
Drive, and Commerce Park which the developer, Callahan Construction, has recently
completed in Westbrook Subdivision — Phase 1.
As a condition of subdivision plat approval through Resolution No. 385 -03, the
developer of Westbrook Subdivision — Phase 1 was required to install certain
improvements including street paving with curb, sanitary sewer main, watermain, storm
sewers and catch basins, detention facilities, and boulevard street lighting and to
dedicate these improvements to the City upon completion.
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On December 7, 2010, Callahan Construction requested City's acceptance of the
improvements in Westbrook Subdivision — Phase 1. Upon inspections in March and
April, 2011, it has been determined that the public improvements required by Resolution
385 -03 have been completed, with the exception of the storm water detention facilities,
in accordance with plans approved by the City Council and in conformance with City
specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements
with the exception of the storm water detention facilities. Maintenance of said public
improvements shall be the responsibility of the owner, Callahan Construction, for a
period of two (2) years from the date of acceptance by City Council. The storm water
detention facilities may be accepted after 80 percent of the lots in the entire Westbrook
Subdivision are developed and adequate erosion control measures are installed on the
remaining 20 percent of the lots.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements, with the exception of storm water detention facilities, in Westbrook
Subdivision — Phase 1.

ACCEPTING PUBLIC IMPROVEMENTS IN WESTBROOK SUBDIVISION — PHASE 1
Whereas, pursuant to Resolution 385 -03, certain public improvements were
installed by the developer of Westbrook Subdivision — Phase 1.
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements for Lots 1 through 48 of Block 1, Lots 1 through 10 Block
3, and Lots F, G, H, I, J, and K of Westbrook Subdivision, except the stormwater
detention facilities, be and the same is hereby accepted.
Section 2. - That - maintenance- of said public improvements shall be the
responsibility of the owner, Callahan Construction, for a period of two (2) years from the
date of this resolution.
