AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 2239-2241 CENTRAL
AVENUE FROM R-2A ALTERNATE TWO-FAMILY RESIDENTIAL DISTRICT TO
C-4 DOWNTOWN COMMERCIAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from R-2A Alternate Two-Family Residential District to C-4 downtown Commercial
District, to wit:
Lot 5 Tivoli Addition, and to the center line of the adjoining public right-of-way, all
in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.

Property History:
There is a two-family residential structure on the property.
Physical Characteristics: The subject property is adjacent to a residential structure to
the north. An alley exists to the rear of the site.
Concurrence with Comprehensive Plan: The subject property was not included as
part of the 1995 Comprehensive Plan.
Impact of Request on:
Utilities: The property can be adequately served by City sewer and water service.
Traffic Patterns/Counts: Central Avenue is considered a principle arterial and is
also part of U.S. Highway 52. Based on 1997 IDOT traffic counts, approximately
15,400 average trips per day.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff do not anticipate any adverse impacts to the environment
provided appropriate erosion control is practiced during any construction.
Adjacent Properties: Expansion of the drug store will create a drive-thru/parking
area adjacent to the residential structure to the north.
CIP Investments: None proposed.
Staff Analysis: The applicant proposes the removal of the existing two-family
residential home to allow expansion of Hartig Drug Store at 2225 Central Avenue. The

applicant intends to expand the Hartig Drug Store and add a drive-thru and parking
area on the north side of the current drug store. The applicant is requesting rezoning of
the subject parcel from R-2A Alternate Two-Family Residential District to C-4 Downtown
Commercial District.
The C-4 Downtown Commercial District is intended to accommodate older commercial
areas of the city. If this property is rezoned and the structure expanded, a six foot side
yard setback would be required to the adjoining residential property. In addition, six
foot high screening would be required along the property line of an adjoining residential
property to the north. Expansion of the commercial property would require approval of
the site plan and building plans by City staff prior to construction. In addition, a
conditional user permit for the drive-thru facility will need to be approved by the Zoning
Board of Adjustment.
The proposed rezoning to C-4 Downtown Commercial would be an expansion of an
existing commercial district. Expansion of commercial opportunities in existing
commercial corridors is appropriate where infrastructure can support the growth. The
required buffering of the site may help reduce the impact to the adjacent residential
structure.
Staff recommend that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance which establishes criteria for the rezoning of property in the City of
Dubuque.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that a similar request was approved for
the adjacent lot in 1993. Staff reviewed the surrounding zoning and screening
requirements for commercial districts.
The Zoning Advisory Commission discussed the request, noting that a conditional use
permit will be required prior to development of the drive-thru facility at the drug store.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
