RESOLUTION NO. 48-00
RESOLUTION APPROVING PLAT OF PROPOSED VACATED CHAVENELLE
ROAD
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated December 21,1999, prepared by IIW Engineers & Surveyors, p_C_,
describing the proposed vacated portion of Chavenelle Road; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the plat dated December 21, 1999, prepared by IIW Engineers
& Surveyors, P.C., relative to the real estate hereinabove described be and the same is
hereby approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat for and on behalf of the City of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer,
drainage, gas, telephone, tv. cable, and electric lines as may be authorized by the City of
Dubuque, Iowa.
Section 3. That the City Clerk be and is hereby authorized and directed to file
said plat and certified copy of this resolution in the office of the Recorder, in and for
Dubuque County, Iowa.

ORDINANCE VACATING THE PORTIONS OF CHAVENELLE ROAD AND
ASSOCIATES DRIVE
Whereas, Medical Associates Realty, L.P. has requested the vacating of portions
of Chavenelle Road and Associates Drive; and
Whereas, IIW Engineers & Surveyors, P.C. has prepared and submitted to the City
Council a plat showing the vacated portions of Chavenelle Road and Associates Drive and
assigned lot numbers thereto, which hereinafter shall be known and described as Lot C of
Medical Associates Subdivision and Lot C of Medical Associates Subdivision No.2, in the

portions of Chavenelle Road and Associates Drive are no longer required for public use,
except for utility easements as noted, and vacating of said portions of Chavenelle Road
and Associates Drive known as Lot C of Medical Associates Subdivision and Lot C of
Medical Associates Subdivision No.2 in the City of Dubuque, Dubuque County, Iowa
should be approved.
NOW THEREFORE, BE IT ORDAINED
DUBUQUE, IOWA:
BY THE CITY COUNCIL OF THE CITY OF
Section 1. That the real estate described as Lot C of Medical Associates
Subdivision and Lot C of Medical Associates Subdivision No.2 in the City of Dubuque,
Iowa, be and the same is hereby vacated.
Section 2. The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer,
drainage, gas, telephone, tv. cable, and electric lines as may be authorized by the City of
Dubuque, Iowa.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT C OF
MEDICAL ASSOCIATES SUBDIVISION AND LOT C OF MEDICAL ASSOCIATES
SUBDIVISION NO.2, DUBUQUE, IOWA
Whereas, the Medical Associates Realty, loP. has requested the vacating of
portions of Chavenelle Road and Associates Drive.
Whereas, IIW Engineers & Surveyors, P.C. has prepared and submitted to the City
Council a plat showing the vacated portions of Chavenelle Road and Associates Drive and
assigned lot numbers thereto, which hereinafter shall be known and described as Lot C of
Medical Associates Subdivision and Lot C of Medical Associates Subdivision No.2 in the
City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that these
portions of Chavenelle Road and Associates Drive are no longer required for public use,
except for utility easements as noted, and vacating and sale of said portions of alleys and
streets known as Lot C of Medical Associates Subdivision and Lot C of Medical Associates
Subdivision No.2 in the City of Dubuque, Dubuque County, Iowa should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot C of
Medical Associates Subdivision and Lot C of Medical Associates Subdivision No.2 in the
City of Dubuque, Iowa.
Section 2. That the conveyance of Lot C of Medical Associates Subdivision and
Lot C of Medical Associates Subdivision No.2 in the City of Dubuque, Iowa to the Medical
Associates Realty, L.P. be contingent upon the payment of$300, plus platting, publication
and filing fees.
Section 3. The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer,
drainage, gas, telephone, tv. cable, and electric lines as may be authorized by the City of
Dubuque, Iowa.
Section 4. That the City Clerk be and is hereby authorized and directed to cause

Vacating Petition - Chavenelle Road and Associates Drive
INTRODUCTION
This is in response to a request from Medical Associates Realty, L.P. for vacating
portions of Chavenelle Road and Associates Drive which currently exist as public
rights-of-way,
DISCUSSION
.
The attached plat shows that the grassed median areas would be vacated and sold to
Medical Associates. The purpose of the vacating is to locate two on-premise center
identification signs for Medical Associates and other tenants of their commercial park.
The sign would be required to conform to the City's Sign Ordinance, and would also
require ¡;¡ermission from the Iowa Department of Transportation, because of the sign's
proximity to the right-of-way of the Northwest Arterial. The sign would be 40 feet
maximum in height, 17 feet 8 inches wide, consisting of 300 square feet of sign face.
A preliminary artist rendering of the proposed sign is attached.
The area to be vacated is divided into lots numbered Lot C of Medical Associates
Subdivision and Lot C of Medical Associates Subdivision No, 2. Lot B of said
subdivisions will remain public right-of-way for Chavenelle Road and Associates Drive,
Perpetual easement rights will be reserved on the vacated parcels for construction and
maintenance of utilities.
Medical Associates would maintain the two median areas, and as such the selling price
has been established at the City's minimum vacating fee of $300.00, together with
the costs of surveying and platting.

RECOMMENDA TION
The City has no plans for the utilization of the median portions of Chavenelle Road and
Associates Drive to be vacated, except for reserving the utility easements as noted.
I would recommend that the areas indicated by Lot C of Medical Associates
Subdivision and Lot C of Medical Associates Subdivision No.2 on the attached plats
be vacated, and that a public hearing be set for the disposition of the City's interest
in the subject areas on February 21, 2000. I would further recommend that the
purchase price be established at $300,00, plus platting, publication and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the enclosed
resolutions and ordinance,
