Gronen Claimant Date of Claim Date of Loss Nature of Claim Gronen, Penny A. 12/20/99 damage to car 11/19/99 '¡'his is a claim for damages to the claimant's automobile, which it sustained when a construction worker directed the driver through fresh tar and yellow paint at a construction site on West Third Street. According to the report of Public Works Director Michael Koch, the time and location of the incident indicates that the work was being done by Horsfield Construction, whose contract with the City of Dubuque requires that it be responsible for any claims that arise out of the work being done pursuant to that contract. Koch, Public Works Director !Jf.L)(~ Claim of Ms. Penny Gronen TO: SUBJECT: This claim relates to the City Booth Street paving project which was done by Horsfield Construction. The contract called for the standard form of contracts and bonds with the City, which require the contractor to hold the City harmless from any claims of damage resulting from the work. Therefore, it is the recommendation of the City Engineering Division that this claim for damages be forwarded to Horsfield Construction for further consideration/processing. MAK/vjd Attach. ~
