RESOLUTION NO. 25-00
ACCEPTING SANITARY SEWER AND WATERMAIN IN ASBURY PLAZA -
PHASE 1A
Whereas, pursuant to Resolution No. 137-98, certain improvements including
sanitary sewers and watermain were installed by the developer of Phase IA of Asbury
Plaza.
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that said
improvements in Asbury Plaza - Phase 1A be and the same is hereby accepted.
Section 2. That maintenance of said improvements shall be the responsibility of the
contractors and the owner for a period of two years from this date.

This letter is to notify you that public improvements have been completed for the Asbury
Plaza lots of Culver's, Wendy's, Hardee's, and Hy-Vee. Therefore, Corey Development,
Ltd. is requesting the City of Dubuque accept these public sanitary sewer and watermain
improvements.

Acceptance of Public Improvements in Asbury Plaza - Phase 1 A
INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
which the developer, Corey Development, Ltd., has recently completed in Asbury Plaza -
Phase 1 A.

BACKGROUND
As a condition of subdivision plat approval through Resolution No. 137-98, the developer
of Asbury Plaza - Phase 1 A was required to install certain improvements including sanitary
sewers and watermain and to dedicate the improvements to the City upon completion.
The developer of Asbury Plaza - Phase 1 A has recently completed the improvements and
has formally requested the City's acceptance of the public improvements which have been
installed. These improvements are a part of the approved conceptual development plan
for the area. The streets and storm sewer are proposed to be private in this development.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.

On June 24, 1998, Corey Development, Ltd. requested City's acceptance of the
improvements in Asbury Plaza - Phase 1 A. Legal matters and additional platting
requirements caused the City not to accept the public improvements in 1998. These
issues have, however, all be resolved; and upon inspection by the City, it has been
determined that all of the public improvements required by Resolution No. 137-98 have
been completed in accordance with plans approved by the City Council and in
conformance with City specifications.

RECOMMENDATION
I would therefore recommend that the City Council accept the improvements.
Maintenance of said improvements shall be the responsibility of the contractors and
owner, Corey Development, Ltd., for a period of two years from the date of acceptance
by the City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.
