Amendment CDBG RESOLUTION NO. 32-00 RESOLUTION APPROVING AN AMENDMENT TO THE CITIZEN P ARTICIP A TION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM. Whereas, the City Council ofthe City of Dubuque, Iowa adopted a Citizen Participation Plan ( the "Plan") which set forth a process for citizen involvement in the development of the City's Community Development Block Grant (CDBG) program on September 8, 1992; and Whereas, the City Council has amended the Plan from time to time; and Whereas, the Community Development Advisory Commission has proposed to the City Council an amendment to the Plan to change the review process for the Annual Action Plan and the Consolidated Plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section I. That Section II of the Citizen Participation Plan is hereby amended by repealing said Section and by adopting a new Section II in lieu thereof, as follows: "Section II. Development of the Consolidated Plan and Annual Action Plans The Community Development Advisory Commission will hold a series of public meetings during the development of the Consolidated Plan andlor Annual Action Plan that would include identification of community housing and non-housing needs, prioritization of needs, strategy development to meet identified needs and budget recommendations to implement those strategies. Citizen access opportunities, as identified in Section V of this Plan, shall be utilized to increase participation in Consolidated Plan development. The Community Development Advisory Commission shall hold at least one public hearing, as outlined in Section V of this Plan, prior to publication of a draft plan for comment and shall provide not less than a 30 day public comment period before final action. The Consolidated Plan andlor Annual Action Plans shall be adopted by the Community Development Advisory Commission and forwarded to the City Manager. The City Council shall act on the proposed Consolidated Plan andlor Annual Action Plan. Adoption by Resolution of the City Council is required prior to submission to HUD. A summary of the draft Consolidated Plan andlor Annual Action Plan shall be published in one or more newspapers of general circulation, and for citizen distribution, prior to the commencement of the 30 day public comment period. The complete document shall be available for review as outlined in Section V of this Plan. Any public comments received during the comment period or at the public hearings shall be considered and shall be summarized and attached to the Consolidated Plan andlor Annual Action Plan prior to submission to HUD. This shall include a summary of any comments or views not accepted and the reasons therefore." Section 2. That said Amendment shall become effective immediately and the remaining sections of the Plan will remain in effect as previously adopted. Section 3. That the Plan as amended shall be filed in the Community and Economic Development Department as required by the U.S. Department of Housing and Urban Development. This amendment was discussed and approved by the Community Development Advisory Commission on January 18, 2000. BACKGROUND Federal rules require that every five years the City prepare and file a Consolidated Plan whereby the community establishes a unified vision for community development activities. During the five-year planning period, an Annual Action Plan is prepared each year prior to receipt of its CDBG entitlement. The five year Consolidated Plan and each year's Annual Action Plan guide the City's use of Community Development Block Grant (CDBG), HOME and other federal funds which are made available from the U.S. Department of Housing and Urban Development (HUD). The Consolidated Plan andlor Annual Plan are adopted following a public participation process which includes a published notice, a public comment period, and a public hearing. A city must follow its adopted plans as it expends entitlement funds. If its revenues or activities change, the city must amend. The Citizen Participation Plan identifies the process for citizens to participate in the development ofthe Consolidated Plan, each Annual Action Plan, the annual Performance Report and any substantial amendments for the Community Development Block Grant (CDBG) program. Currently, the Consolidated Plan and the Annual Action Plan process are combined in the City of Dubuque's Citizen Participation Plan. The Community Development Advisory Commission holds a public hearing prior to publication of a draft plan for comment and provides not less than a 30 day public comment period before final City Council action. The Consolidated Plan and/or Annual Action Plans are adopted by the Commission and forwarded to the City Manager for inclusion in the annual City budget each December. The 30 day comment period begins after the budget is published for distribution and public review and concludes at the public hearing with the Commission and the City Council. Final adoption of the Consolidated Plan and/or Annual Action Plan occurs at the final public hearing and adoption of the City's annual budget in March of each year. Adoption by Resolution of the City Council is required prior to submission to HUD. . . . . " DISCUSSION The City Council will be holding a public hearing with the Community Development Advisory Commission on the Annual Action Plan for FY 2001 on February 23, 2000. However, the hearing will not include consideration of the five year Consolidated Plan as the plan is still being created. The Community Development Advisory Commission will be holding public meetings through April for preparation of the Consolidated Plan, with submission to HUD required by May 15,2000. This process will incorporate the work of the Housing Action Conference planned for February II as well as other public input opportunities related to economic development and neighborhoods. Since the Annual Plan and Consolidated Plan are not being prepared simultaneously, an amendment to the Citizen Participation Plan is needed. The attached amendment includes the proposed changes to the Citizen Participation Plan. The amendment would alter the current review process to allow the Annual Plan and Consolidated Plan to be developed separately by removing references to the City's annual budget hearing. The 30 day comment period would still occur prior to final action by the City Council. The Consolidated Plan and Annual Action Plan would require adoption by resolution, but an additional public hearing by the City Council would not be required. A mark-up copy of the proposed amendment is attached. The proposed amendment also updates the Citizen Participation Plan by adding Advisory to the name of the Commission. This change was made by the City Council after the Citizen Participation Plan was originally adopted in 1992. RECOMMENDA nON I recommend that the City Council approve the above-described amendment to the City's Citizen Participation Plan. The Community Development Advisory Commission voted to approve the proposed changes and to recommend them to the City council at its January 18 meeting.
