SUBJECT: Amendment to Purchase of Services Agreements - Historic District Public
Improvement Projects
Housing and Community Development Director David Harris recommends City Council
approval of amended agreements for the Downtown Neighborhood Council Inc. and
Langworthy District Neighborhood Association. The amendments will provide for
completion of their Historic District Public Improvement projects by May 30, 2005. The
other sections of the original agreements will remain in force.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Amendment to Purchase of Services Agreements-
Historic District Public Improvement Projects.
INTRODUCTION
The purpose of this memorandum is to request approval of an amendment to the
Purchase of Service Agreements with Downtown Neighborhood Councillnc and
Langworthy District Neighborhood Association for the Historic District Public Improvement
projects.
BACKGROUND
In December 2003, the City Council approved the following Historic District Public
Improvement projects: $20,906 with the Downtown Neighborhood Council Inc. for
installation of trash receptacles, park benches, planters and street trees in the Jackson
Park Historic District; and for $7,907 for the Langworthy District Neighborhood Association
for installation of planters in the Langworthy Historic District.
These agreements expired on June 30, 2004. Both organizations requested an extension
of the agreements until May 30, 2005 to allow completion of the projects. The Community
Development Advisory Commission voted to approve the time extension at their meeting
on October 13, 2004.
RECOMMENDATIONS
I recommend that the City Council approve the attached amended agreements for the
Downtown Neighborhood Councillnc and Langworthy District Neighborhood Association.
The amendments will provide for completion of their Historic District Public Improvement
projects by May 30 2005. The other sections of the original agreements will remain in
force.
ACTION STEP
The action step for the City Council is to approve the attached amendments and authorize
the City Manager to sign on behalf of the City.

COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
AMENDMENT
This Amendment to the Purchase of Services Agreement dated the - day of
October, 2004 is entered into by and between the City of Dubuque, Iowa, a municipal
corporation organized and existing under the laws of the State of Iowa (hereinafter
referred to as "Recipient") and Downtown Neighborhood Council Inc., with its principal
place of business in Dubuque, Iowa (hereinafter referred as the "Subrecipient")
WITNESSETH:
Whereas, the Recipient awarded Subrecipient $20,906 in Community
Development Block Grant (CDBG) funds for the installation of historic trash
receptacles, park benches, planters and street trees in the Jackson Park Historic
District by June 30,2004; and
Whereas, the Subrecipient has requested an extension of the grant agreement
until May 30, 2005 to allow completion of the project, and
Whereas, the Community Development Advisory Commission has approved the
extension on October 13, 2004.
NOW THEREFORE, in consideration of the terms of the mutual agreements
hereinafter set forth, the parties agree as follows;
1. That Section IV. DATES OF COMMENCEMENT AND COMPLETION is
hereby repealed and a new Section IV is hereby adopted as follows:
"Section IV. DATES OF COMMENCEMENT AND COMPLETION
The services to be provided under this Agreement must be
completed not later than May 30, 2005.
2. All other terms and conditions of the Purchase of Service Agreement
shall remain in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment to the
Purchase of Service Agreement as of the - day of October 2004.
