City Engineer Gus Psihoyos recommends City Council approval of the execution of two
change orders totaling $284,029.70 amending the construction contract with Tschiggfrie
Construction for the Lower Bee Branch Creek Restoration Project to include the
installation of a hike /bike trail rest area and lighting along the hike /bike trail from the
Audubon Overlook north to the railroad facility on Garfield Avenue. Pursuant to the
terms of the River Enhancement Community Attraction and Tourism Grant Agreement,
the City is obligated to construct these items.
On August 16, 2011 the City Council adopted Resolution 336 -10 awarding the
construction contract for the Lower Bee Branch Creek Restoration Project to Tschiggfrie
Excavating in the amount of $10,836,588.85. Because Tschiggfrie's base bid exceeded
the estimate by $2.1 million, the alternate bid items for the hike /bike trail rest area and
lighting were not included. At the time of project award, it was noted that the alternate
bid items would warrant further consideration depending on the available contingency
as construction proceeded toward completion.
At the City's request, Tschiggfrie provided Change Order No. 20 ($22,957.70) and
Change Order No. 21 ($261,072.00) which would add the bike path rest area and
hike /bike trail lighting required per the RECAT Grant Agreement. The attached drawing
shows the location of the improvements. The proposed cost of the change orders are
based primarily on the unit prices submitted when the project was initially let last
summer with slight adjustments based on material costs, changing the fixtures to LED,
changing the light poles to include banner & planter baskets, and changing the light
poles so that they can accommodate a drip irrigation system that will save on
maintenance costs and cut down on water use. In addition, the number of electric
service pedestals was increased to ensure that the electrical outlets at each light pole
can accommodate festival -like events along the trail.
The unit prices reflect what the City would expect to pay. There is no reason to expect
better prices if the proposed work was re -bid. And while the lighting and bike rest area
could be constructed following the completion of the Lower Bee Branch Creek
Restoration Project, there are obvious benefits of coordinating their installation with the
trail to be constructed as part of the current contract.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memo is to seek authorization to approve the execution of two
change orders amending the construction contract with Tschiggfrie Construction for the
Lower Bee Branch Creek Restoration Project to include the construction of a hike /bike
trail rest area and lighting along the hike /bike trail.
BACKGROUND
On May 3, 2010 the City Council adopted Resolution 150 -10 approving the proposed
plans and specifications for the Lower Bee Branch Creek Restoration Project. The bid
documents included several alternate bid items including trail lighting and a bike rest
area.
On August 16, 2011 the City Council adopted Resolution 336 -10 awarding the
construction contract for the Lower Bee Branch Creek Restoration Project to Tschiggfrie
Excavating in the amount of $10,836,588.85. Because Tschiggfrie's base bid exceeded
the estimate by $2.1 million, the alternate bid items for the hike /bike trail rest area and

On October 4, 2010 the City Council adopted Resolution 390 -10 authorizing the Mayor
to sign and submit a River Enhancement Community Attraction and Tourism (RECAT)
grant application to Vision Iowa for RECAT Program Funding for the Bee Branch Creek
Restoration Project. The RECAT program is designed to assist communities in the
development and creation of multiple purpose attraction or tourism facilities. Eligible
projects are recreational and entertainment attractions that are open to the general
public, and relate to, connect with, and enhance a river, lake, or river corridor. Projects
must be located within a city. Up to one -third of the total project cost can be requested
from RECAT. The funding sought was for planned and proposed amenities to enhance
the Bee Branch Creek Restoration Project. The application included the construction of
Lower Bee Branch Creek Restoration Project Alternate Bid Items for the trail lighting
and bike path rest areas.

On March 9, 2011, the State Vision Iowa Board awarded $2,250,000 in RECAT funds
for amenities associated with the Bee Branch Creek Restoration project.
On April 4, 2011 the City Council adopted resolution 114 -11 approving the RECAT
Grant Agreement and authorizing the City Manager to execute the Grant Agreement.
Per the agreement, the City must construct the amenities outlined in the RECAT grant
application.
DISCUSSION

rest area north of 16 Street and install trail lighting along the hike /bike trail already
included in the construction contract for the Lower Bee Branch Creek Restoration
Project.

BUDGET IMPACT
With the adoption of the FY2012 CIP budget for the Bee Branch Creek Restoration
Project (CIP #7201654), funds were established for the lighting and the hike /bike rest
area.
ACTION TO BE TAKEN
I respectfully request authorization to execute the attached Change Order No. 20 and
Change Order No. 21 amending the construction contract for the Lower Bee Branch
Creek Restoration Project to include the installation of a hike /bike trail rest area and
lighting along the hike /bike trail to be constructed as part of the Lower Bee Branch
Creek Restoration Project.
