Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, noting that the existing carwash is not profitable and that he proposes to change the use oto an auto sales lot. Staff reviewed the surrounding zoning and land use, the zoning requirements for an auto sales lot, and that a variance and a conditional use will be necessary from the Zoning Board of Adjustment if the rezoning is approved. There were no public comments. Masterpiece on the Mississippi The Zoning Advisory Commission discussed the request, reviewing the allowed uses in a C -4 Downtown District and the proximity to residential uses. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The property was used for a number of purposes until 1991 when the property was cleared and a car wash was built. The property has served as a car wash to the present. Physical Characteristics: The property is a level 7,000 square foot lot with 100 feet of frontage along 20 Street and 70 feet of frontage along Washington Street. The property is bordered on the west side by an alley and on the south by a commercial building. The property is fully paved with has driveway access onto Washington Street and the alley. Concurrence with Comprehensive Plan: The Future Land Use map calls for this property to remain mixed - commercial. The Comprehensive Plan recommends providing adequate commercial redevelopment sites and also recommends buffering incompatible uses from each other. Impact of Request on: Rezoning Staff Report — 1987 Washington Street Page 2 Utilities: Existing utilities are adequate to serve the site. Traffic Patterns /Counts: The 2005 Iowa Department of Transportation traffic counts indicate 9,400 vehicle trips per day on 20 Street adjacent to the subject property. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment as the site is full paved. Adjacent Properties: The uses permitted in a C -4 District are generally no more intense than those allowed in the C -2 District. This property is located in a mixed - use area adjacent to a restaurant, convenience store, commercial storage and retail outlet with some residential use beyond. The uses permitted in the C -4 District should have very little additional impact on the adjacent properties. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to rezone an approximately 7,000 square foot parcel located on a corner lot at the intersection of Washington and 20 Streets from C -2 Neighborhood Commercial Shopping Center district to C -4 Downtown Commercial district. The property is located in a mixed -use area and is surrounded by commercial uses. One lot removed from the subject property there are a number of single- and multi - family residences. The subject lot is level, fully paved and has access onto Washington Street and an alley. There is no parking permitted along the subject property on both the Washington and 20 Streets frontages. The applicant's intent is to redevelop the property as an auto sales dealership. In a C -4 District all auto sales dealerships must be granted a conditional use permit through the Zoning Board of Adjustment. Also, auto sales dealerships must be a minimum of 20,000 square feet in lot area. Therefore, this property would also require a variance in lot area from the Zoning Board of Adjustment. Staff recommends that the Zoning Advisory Commission review the criteria established in Article 9 -5 of the Unified Development Code regarding reclassification of property.
