The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request to expand the proposed office /community building and add three (3) apartments on a second level. Staff reviewed the request, noting that off - street will still exceed that required by the UDC with the addition of three apartment units. There were several public comments in opposition regarding storm water runoff, development density and the need to construct a turnaround at the end of Beverly Street. The Zoning Advisory Commission discussed the request, reviewing the size of the proposed office /community /apartment building, 25 -foot setback, and whether adding three apartments to the second building was feasible. After conclusion of the Commission meeting, the applicant contacted the Planning Services Department regarding a request to reduce the setback from 25 feet to 20 feet on the north side property line. A Planning Services Department letter regarding this verbal request is enclosed. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request as originally submitted. Approval was granted for two 24 -unit apartment buildings and associated parking lots and a single -story clubhouse /office building. The Commission recommended approval of the PUD and the conceptual plan for the development, as submitted. At their June 20, 2009 City Council meeting, the Council approved the PUD, as submitted. DISCUSSION Subsequent to zoning approval and construction of the first 24 -unit apartment building and a portion of the surface parking lot, Mr. Kluck has asked to amend the PR district. His intention is to add a second story to the clubhouse /office building that will accommodate three residential units. Also, he has asked to increase the size of the clubhouse /office from 27' by 45' (1,215 square feet) to 35' by 60' (2,100 square feet) and reposition the building five feet closer to the north side property line. This would mean that the building is setback 20 feet from the north side property line instead of the 25 feet that was originally indicated on the conceptual plan. The parking lot configuration will remain the same, with 86 total off - street parking spaces, 54 of which are located inside of the apartment buildings. By adding three residential units above the clubhouse /office building the total number of units will increase from 48 to 51. This translates to approximately 1.7 parking spaces per unit. A standard multi - family residential development is required to provide a minimum of 1.5 parking spaces per unit. The rest of the site, including the access from University Avenue, the location of the main apartment buildings, and the landscaping will remain the same as was approved on the original conceptual plan. The increase in density, demand on parking and traffic, if the three residential units are added, will be negligible. However, shifting the two- Kluck University Avenue PUD Amendment Page 2 story building slightly further to the north may have more of an impact on the adjacent residential property at 2762 Beverly Drive. A. Use Regulations. The following regulations shall apply to all uses made of land in the above - described PR Planned Residential District: 1. Principal permitted uses shall be limited to 51 housing dwelling units. 2. No secondary or contingency uses shall be permitted. 3. Accessory uses shall include any use customarily incidental and subordinate to the principal use it serves. Kluck Condominiums — University Avenue Page 2 B. Lot and Bulk Regulations. Development of land in the PR Planned Residential District shall be regulated as follows: 1. Proposed buildings shall be located in substantial conformance with the approved conceptual development plan dated May 12, 2011. 2. Building #1 must be set back a minimum of 80 feet from the east side property line and 30 feet from the west side property line. 3. Maximum building height of 50 feet shall be allowed as measured from the first floor elevation to mid point of the peak of the roof. C. Performance Standards The development and maintenance of uses in this PR Planned Residential District shall be regulated as follows: 1. Parking Regulations a. Off - street parking shall be provided based on the approved conceptual plan with 32 spaces provided on surface lots and 56 spaces in underground parking. b. All vehicle - related features shall be surfaced with either asphalt or concrete. c. Curbing and proper surface drainage of storm water shall be provided. d. All parking and loading spaces shall be delineated on the surfacing material by painted stripes or other permanent means. e. The number, size and design of parking spaces shall be governed by applicable provisions of City of Dubuque Ordinances enforced at the time of development of the lot. f. The number, size, design, and location of parking spaces designated for persons with disabilities shall be according to the local, state, or federal requirements in effect at the time of development. 2. Site Lighting a. Exterior illumination of site features shall be limited to the illumination of the following: i. Parking areas, driveways and loading facilities. ii. Pedestrian walkway surfaces and entrances to building. Kluck Condominiums — University Avenue Page 3 iii. Building exterior. b. Location and Design 3. Landscaping i. No light source shall provide illumination onto adjacent lots, buildings or streets in excess of 1.0 foot candle. ii. All exterior lighting luminaries shall be designed and installed to shield light from the luminaries at angles above 72- degrees from vertical. iii. Fixtures mounted on a building shall not be positioned higher than the roofline of the building. iv. All electrical service lines to posts and fixtures shall be underground and concealed inside the posts. a. Plant Materials. The open space of each lot shall be planted with permanent lawn and ground covers, shrubs and trees. It is the intent of these regulations that the development of required open spaces shall reflect a high quality of environmental design. The following provisions shall apply. i. Landscape plans are required as part of submittals for site plan review. Landscape plans are to include type, number and size of proposed plantings. Landscaping shall be designed in compliance with Section 4 -4 of the Zoning Ordinance. ii. Within one (1) year following completion of construction, or by the date that a building is issued an occupancy certificate by the Building Services Department of the City of Dubuque, whichever first occurs, required landscaping shall be installed. 4. Storm Water Conveyance The developer shall be responsible for providing surface or subsurface conveyance(s) of storm water from the lot to existing storm sewers or to flow line of open drainageways outside the lot in a means that is satisfactory to the City of Dubuque. Other applicable regulations enforced by the City of Dubuque relative to storm water management and drainage shall apply to the subject property. 5. Exterior Trash Collection Areas a. The storage of trash and debris shall be limited to that produced by the principal permitted use and accessory uses of the lot. Kluck Condominiums — University Avenue Page 4 b. All exterior trash collection areas and the materials contained therein shall be visually screened from view. The screening shall be completely opaque fence, wall or other feature not exceeding a height of 10 feet measured from the ground level outside the line of the screen. Screens built on sloping grades shall be stepped so that their top line shall be horizontal. Exposed materials used to construct the opaque screen shall be similar in appearance to materials used for exterior building walls. All exterior entrances to a screened trash area shall be provided with a gate or door of similar design to that of the screen. If a 10 -foot high screen fails to shield the exterior trash collection area from view from points inside or outside of the property, evergreen plantings may be required in addition to the screening. Evergreen plant materials shall be selected and designed so that they will screen the area from all off -site visibility within five (5) years. 6. Final site development plans shall be submitted in accordance with Section 4 -4 of the Zoning Ordinance prior to construction of any buildings. D. Open Space and Recreation Areas Open space and landscaping in the PR Planned Residential District shall be regulated as follows. Those areas not designated on the conceptual development plan shall be maintained as open space, as defined by Section 8 of the Zoning Ordinance of the City of Dubuque, Iowa, by the property owner and /or association. E. Sign Regulations 1. Signs in the Planned Residential District shall be regulated in accordance with the R -4 Multi - Family Residential Zoning District sign regulations of the Zoning Ordinance. 2. Variance requests from sign requirements for size, number and height shall be reviewed by the Zoning Board of Adjustment in accordance with Section 5 -3 of the Zoning Ordinance. F. Other Codes and Regulations 1. Service Lines. All electric, telephone, cable, or other similar utility lines serving the building and other site features shall be located underground. 2. G. Transfer of Ownership Transfer of ownership or lease of property in this PR Planned Residential District shall include the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the district. H. Occupancy Permits No occupancy permit shall be issued by the City of Dubuque for property included in the subject planned unit development district until full compliance with this ordinance has been achieved. I. Recording A copy of this Ordinance shall be recorded at the expense of the property owner(s) with the Dubuque county recorder as a permanent record of the conditions accepted as part of this reclassification approval. This ordinance shall be binding upon the undersigned and his /her heirs, successors and assigns. Section 2. Your request was to amend the PR District to permit you to enlarge and reposition the community /office building on the north portion of your lot, and to add three upper story units to the building. The Commission approved your request with two conditions: 1) The community /office building be setback 25 feet from the north side property line, and, _ 2) The community /office building not exceed 65 feet in length. Associate Planner Kyle Kritz notified me that you intend to ask the City Council at the June 20, 2011 public hearing for your request to permit you to site the community /office building 20 feet.from the north side property line instead of the 25 foot setback required by the Zoning Advisory Commission. Because this request would not comply with a condition that was made by the Zoning Advisory Commission, it will require that a super majority (a minimum of six Council Members) of the City Council members vote to approve your request. Anything short of a super majority will constitute a denial of the request to amend your Planned Commercial District. I believe the City Council could approve the request with the conditions imposed by the Zoning Advisory Commission over and above your request, or they could deny your request, or they could remand your request to the Zoning Advisory Commission for another public hearing. Also, please note that Iowa law requires that all conditions must be agreed to in writing prior to the City Council public hearing on your request. If no written agreement is in place this would also trigger the "six vote" rule. It is also required that you submit a new concept plan prior to the City Council meeting clearly showing the proposed community /office building footprint and setback. This will enable the City Council to consider an- accurate concept plan and allow City staff to draft an ordinance that accurately reflects your request and can be used in the future to insure site plan compliance. My wife, young son, and I are homeowners on Beverly Avenue just two houses away from the construction. I have concerns regarding the proposed addition of three apartments above the complex recreation center. 1. No site plan or indication of intent has been provided to the neighborhood. I am not necessarily opposed to changes in my area but they should conform to zoning requirements. I would like to avoid a situation similar to the new apartments across from Jamaica Me Tan on University Avenue, where the complex obviously violates city regulations and obviously detracts from the value of properties around it. I cannot know the intent of Kluck Construction until they have provided the neighborhood with accurate plans. 2. The site has already been mishandled with runoff and erosion issues in our neighbor's yard, which is adjacent to the construction. I also am concerned that promised landscaping will not be performed to provide separation from the apartments and the single family dwellings in our neighborhood. 3. I am concerned that parking will not be adequate to serve all renters and guests of the complex, particularly in the winter. I fear parking will overflow into our already crowded street adding to congestion. 4. A variance has already been granted to allow the first building to be closer to University Avenue than would normally be allowed. This was to permit room for both all buildings on the site. Why is the city considering additional variances for this site? The complex is already exceeding the capacity of the site as laid out by city zoning laws. As my family grows my wife and I, both well paid professionals, will look for a larger home. If the City of Dubuque cannot regulate new construction such that existing adjacent property owners maintain or enhance the value of their property then we will make the decision to relocate to the county. Please oppose zoning variances for the Kluck Apartment Complex on University Avenue.
