(Iowa Glass) and by James E. Newman in connection with the above project. The acquisition of these properties is necessary for the construction of the University Avenue Extension to Highway 20. The City Council has previously authorized the City to enter into negotiations with the property owners for the voluntary acquisition of the property. To date, efforts to acquire the property by voluntary acquisition have not been successful. In order to complete the project in a timely manner, it is now necessary to request the City Council authority to commence formal proceedings for the acquisition of the property by eminent domain. IN THE CITY OF DUBUQUE, IOWA WHEREAS, the City of Dubuque .(City) intends to acquire certain real property owned by Elm Real Estate, LC.
