Dubuque Iowa 52001 563 -580 -7347 �ll1�i 4/41- m 0 m 0 The noise complaint is an annual complaint that usually starts in the spring when the bikes first come out and people start opening their windows. There are quite a few complaints every year but it has really taken root the past couple of years. There are actually some organized groups in the area that target this one specific problem. Besides complaints directly to the PD, City Administration and elected City officials also receive a lot of complaints and they get sent down to us. The Mayor appointed the citizen staffed Safe Community Task Force and that group made noise enforcement, and other "quality of life issues," high priorities for the City to address. The Council adopted the Task Force's recommendations and directed the PD to address them. The complaints come from all over the City. Many of the complaints come from high traffic areas (off of Dodge, Central, JFK), but we also get many from residential areas where people tend to "cruise" when out for a leisurely rides (Grandview, the Point area). There is no "distance" specified in city or state code that we use for mufflers being too loud. It is somewhat subjective but we often use a city block as a rule of thumb for noise. City code specifically lists 200 feet (about the distance of a downtown city block) for excessive stereos, so we use that as a similar reference for exhausts and other noise enforcement. The noise enforcement we are undertaking is for all noise - cars, trucks, street bikes, racing bikes, stereos, etc - not just Harleys and choppers. City & State codes say, "Every motor vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive noise or annoying smoke. Notwithstanding the foregoing, no person shall use a muffler cutout, bypass, or similar device upon a motor vehicle upon a street." By code, straight pipes would be illegal. After - market pipes might be in that grey area, depending on how loud they are and how people drive the bikes. I don't have a number for you on the number of tickets written as I haven't gotten that far into the pile on my desk. I will tell you that I have heard some of the rumors that we stop every bike we see /hear. While we are increasing our efforts, the number of motorcycle muffler tickets is still one of the lower ranked tickets in the monthly totals as compared to other violations, but we are encouraging officers to pay better attention to violations. A lot of it comes down to common sense by drivers. If riders have after - market pipes, or possibly even straight pipes, and drive in a low -key, sensible manner it might not be a problem. If they have loud pipes and tear off at each stop sign or sit at red lights and crack the pipes, they are the ones making it bad for everyone and will probably draw the attention of police. We realize few riders will scrap $1000 pipes to avoid tickets. What we are ultimately hoping for is changes in behavior. As with most things, a few bad apples often ruin it for everyone. This is an area of extra enforcement for us but we have many other duties and responsibilities to attend to, especially this time of year. We will however be doing special enforcement projects where cars are assigned to strictly traffic enforcement, which includes noise enforcement. I would encourage you to tell your friends and clients to exercise discretion when riding through the city. Keep the RPM's low and ease out of stops. It will not only hopefully prevent them from being ticketed, but also may reduce the stigma attached to bikes and hopefully lower the complaints and put this topic on everyone's back burner. We have several bike enthusiasts in the department, myself included, who enjoy the sound of a well tuned bike. That being said, we are also charged with the responsibility to enforce the law, especially those which are deemed a community issue. Absorption Baffles An absorption baffle is constructed from an inner core of louvered or perforated steel tubing that extends clown the length of the muffler. This inner core is wound within an insulated fiberglass mat called packing. As exhaust gases enter into the inner core, the sound waves pass through the louvers or perforations and are absorbed into the packing. The remaining sound waves exit through the mufflers outlet. Removable Baffles In addition to the perforated inner core found on most aftermarket mufflers, removable baffles are available to further reduce a motorcycle's exhaust note. The baffles are normally constructed from a short length of perforated steel tubing that is inserted into the muffler's outlet and secured by a small screw. Although they are not as effective at reducing the intensity of an exhaust note as the other forms of baffles, these smaller baffles have enjoyed some success in quieting the straight pipe exhaust systems that are frequently seen on cruiser motorcycles. Pros and Cons While baffles allow the average motorcyclist to ride through the city without causing alarm or garnering the attention of local law enforcement, they can rob the motorcycle of its performance capabilities. Due to their design, chamber -type baffles are much more restrictive, preventing the exhaust gases from exiting as smoothly and quickly as possible. Replacing the stock chambered muffler with an aftermarket absorption - style muffler straightens the exhaust flow, providing an increase in power. Maintaining an absorption -type muffler is also much simpler, since their design allows for regular replacement of the internal packing. Conversely, complete replacement is the only viable option for a damaged chambered muffler. I have not personally had a run in, but have heard of multiple instances and it has led me to completely avoid the city on either of my motorcycles, and one has the stock Harley exhaust system. Ive heard and read about what is going on. Police targeting motorcycles for exhaust, and to my understanding there is not a set decibel limit for a noise ordinance, and I know I read that it's "at officers discretion ". How can you ticket individuals with no set limit for everyone? I've also heard multiple instances where people are ticketed for not having their exhaust "EPA certified ". I never knew law enforcement was certified in EPA regulations. Other states vehicles go to a certified service shop to make sure their vehicle meets emission standards, where a CERTIFIED service person makes sure they meet standards. Law enforcement is not certified for that. I've heard that people with stock exhaust systems from the manufacturer have even been ticketed. Until this situation is resolved, and the city makes and passes a fair ordinance, I will just not do any business or make any purchases in the city of Dubuque. If you can't treat us motorcycle enthusiasts fairly and not unjustly target us, I won't spend any of my income in the city, and not give you any money through sales tax. I already don't conduct business at the Harley dealer in Dubuque, and will just continue to travel the hour to Waterloo or other cities to make purchases. I am not a resident of the city of Dubuque, but live in the county, and did do a lot of my shopping in Dubuque. Perhaps this issue with the police department will be resolved soon, but most likely it won't and you'll continue to discriminate against a portion of the community.
