Duggan and Members of the City Council DATE: November 8, 2004 RE: Claim Against the City of Dubuque by Dona Oberfoell Claimant Dona Oberfoell Date of Claim 10/14/04 Date of loss 10/07/04 Nature of Claim Property Damage This is a claim in which the claimant alleges that while her vehicle was parked on 17th Street, a City of Dubuque auxiliary officer struck her vehicle as the officer was attempting to make an eastbound turn while northbound on a private drive onto 17th Street. According to the report of Kim Wadding, Chief of Police, an investigation of the accident was conducted by Officer Stewart and reviewed by Captain Tom Raschke. The investigation confirmed that the auxiliary officer did strike claimant's vehicle which was legally parked on 1 th Street, as the officer was attempting to turn onto 17th Street from a private drive. It is therefore the recommendation of Chief Wadding to approve this claim for the amount of the submitted estimate of $316.90. The Legal Department concurs with this recommendation. cc: Michael C. Wadding Police Chief RE: Claim against the City of Dubuque by Dona Oberfoell INTRODUCTION The purpose of this memorandum is to reply to the claim file against the City of Dubuque by Dona Oberfoell concerning a motor vehicle accident (#04-48326) occurring on October 25, 2004 at approximately 5:45 P.M. near the intersection of West17th and Main. BACKGROUND On October 25, 2004 at approximately 5:45 P.M. Police Auxilia~ Officer Jason Coble was driving a marked patrol unit near the intersection of West 17 h Street and Main. As he attempted to make a right turn from a private drive onto West 1 th Street he struck a 2003 Ford Focus, registered to Dona Jean Oberfoell of 2939 Jackson Street Dubuque, Iowa. The 2003 Ford Focus was legally parked east of the private drive along the south curb of West 1th Street. Light damage occurred to rear bumper of the 2003 Ford Focus. DISCUSSION An investigation of the accident was conducted by Officer Jeff Stewart and reviewed by Captain Tom Raschke of the Dubuque Police Department. A copy of the accident report is attached. RECOMMENDATION Based upon these circumstances, I recommend payment of the damage to Dona Oberfoell. In reviewing the submitted estimates, I recommend payment in the amount of $316.90 as quoted by Mike Finnin Ford. ACTION REQUESTED To seek City Council approval for the payment of $316.90 to Dona Oberfoell for damages related to this motor vehicle accident.
