Duggan and Members of the City Council DATE: November 10, 2004 RE: Claim Against the City of Dubuque by Michael Gibson Claimant Michael Gibson Date of Claim 10/28/04 Date of Loss 10/08/04 Nature of Claim Property Damage This is a claim in which the claimant alleges that as the City of Dubuque leisure Services Department was removing a tree stump on Indian Ridge, a hunk of wood flew out of the grinder and punctured a hole in claimant's garage door, located at 1185 South Grandview. Claimant states that City Forester Steve Pregler notified claimant of the incident. According to the report of John Hail, Park Division Manager, the claimform filed by Michael Gibson is accurate. As the forestry crew was grinding a large stump near claimant's residence, a piece of wood was projected from the stumper and punctured a hole in claimant's garage door. It is therefore the recommendation of John Hail to approve this claim for the amount of the submitted estimate of $517.88. The legal Department concurs with this recommendation.
