SUBJECT: Acceptance of the Port of Dubu,que Storm Sewer Improvements - Phase
IV Project (CIP 410401: Port of Dubuque Storm Sewer Improvements-
Phase IV)
Acting Public Works Director/City Engineer Gus Psihoyos is recommending acceptance
of the Port of Dubuque Storm Sewer Improvements - Phase IV Project, as completed
by Tschiggfrie Excavating Co., in the final contract amount of $210,065.12.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of the Port of Dubuque Storm Sewer Improvements - Phase
IV Project (CIP 410401: Port of Dubuque Storm Sewer Improvements -
Phase IV)
INTRODUCTION
The enclosed resolutions provide for the acceptance of the Port of Dubuque Storm
Sewer Improvements - Phase IV Project.
DISCUSSION
The Port of Dubuque Storm Sewer Improvements - Phase IV Project involved the
construction of an 8-foot wide by 7 -foot high box culvert from the junction box north of
the Portside Building, east and south to the Ice Harbor. With the completion of Phase
IV, the Port of Dubuque collector storm sewer will be complete from the Ice Harbor to
Pine Street and the Star Brewery. Additional storm sewer will be required west of Bell
Street and north of 5th Street when it develops.
Tschiggfrie Excavating Co. of Dubuque, Iowa, has completed the construction project in
the final contract amount of $210,065.12.
RECOMMENDATION
I recommend acceptance of the improvements and establishment of the final contract in
the amount of $210,065.12.

Total Project Cost
The project was funded with the Fiscal Year 2004 Port of Dubuque Storm Sewer
Improvements - Phase IV appropriations in the amount of $258,570. Remaining funds
associated with this project will be utilized fòr additional phases that will be required as
development occurs west of Bell Street.
ACTION TO BE TAKEN
I recommend the adoption of the attached resolution accepting the Port of Dubuque
Storm Sewer Improvements - Phase IV Project and establishing the final construction
contract in the amount of $210,065.12.

RESOLUTION NO. 424-04
ACCEPTING IMPROVEMENT
Whereas, the contract for the Port of Dubuque Storm Sewer
Improvements - Phase IV Project has been completed and the City Manager has
examined the work and filed his certificate stating that the same has been
completed according to the terms of the contract, plans and specifications and
recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby
directed to pay to the contractor from the Fiscal Year 2004 Port of Dubuque
Storm Sewer Improvements - Phase IV appropriations in amounts equal to the
amount of his contract, less any retained percentage provided for therein.

FINAL ESTIMATE
Whereas, the contract for the Port of Dubuque Storm Sewer
Improvements - Phase IV Project has been completed and the City Engineer has
submitted his final estimate showing the cost thereof including the cost of
estimates, notices and inspection and all miscellaneous costs.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to
be $222,357.32 and the said amount shall be paid from the Fiscal Year 2004
Port of Dubuque Storm Sewer Improvements - Phase IV Project appropriations
of the City of Dubuque, Iowa.
Passed, approved and adopted this 15th day of November, 2004.
