SUBJECT: Alley That Extends from Alpine Street to Nevada Street
On August 25, 2004, a petition was received from property owners whose properties
abut the alley that extends from Nevada easterly toward Alpine along the north side of
349 Nevada Street. The petitioners indicate that when a vehicle is parked in the alley,
they are denied access to their properties. They argue that typically the vehicle that
parks in the alley is associated with the 349 Nevada property. The petition asks that the
City Council designate this alley as a "no parking" zone on both sides.
City staff met with Ms. Helen Brown of 349 Nevada. Ms. Brown indicated that due to
her limited mobility, restricting parking in the alley would cause a hardship for her. In an
effort to allow parking in the alley in a manner that would not violate City Code, she was
presented with an option to widen the alley at her expense. Ms. Brown indicated that
was her preference.
Acting Public Works Director/City Engineer Gus Psihoyos recommends that the City
Council allow Ms. Brown to improve the alley to a width that will accommodate her
parking needs while allowing a minimum alley width of 10 feet for traffic and emergency
vehicular access. This recommendation is contingent that she has sole responsibility
for the expense and that it will be completed prior to using a portion of the alley for
parking.
Whether the alley is widened or not, if the 1 O-foot driving lane is not maintained, Police
will be responsible for its enforcement based on the City's current ordinance requiring a
10 foot driving lane, which does not require the posting of "No Parking" signs.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

BACKGROUND
On August 25, 2004, a petition was received from property owners whose
properties abut the alley that extends from Nevada easterly toward Alpine along
the north side of 349 Nevada Street. The petitioners indicate that when a vehicle
is parked in the alley they are denied access to their properties. They argued
that typically the vehicle that parks in the alley is associated with the 349 Nevada
property. The petition asks that the City Council designate this alley as a "no
parking" zone on both sides.
DISCUSSION
On September 22, 2004, Bill Schlickman and I met with Ms. Helen Brown at 349
Nevada. Because of her limited mobility Ms. Brown indicated that restricting
parking in the alley would cause a hardship for her. In an effort to allow parking
in the alley in a manner that would not violate City code, she was presented with
an option to widen the alley at her expense. The City indicated to her that the
option would be presented to the petitioners. Ms. Brown is the only abutting
property owner that did not sign the petition.
On September 27, 2004, City staff, including Engineering, and Corporation
Counsel met at 349 Nevada Street, to evaluate the alley parking. At this meeting,
two of the petitioners, Mr. Kingsley and Mr. Konrardy, joined City staff in the
discussion. City staff presented the option of allowing Ms. Brown to widen the
alley thereby creating enough width for vehicular traffic to pass through. Mr.
Kingsley and Mr. Konrardy admitted that this could solve their problem.
Subsequent to talking with the petitioners, the City directed a letter to Ms. Brown
requesting a written response by October 26, 2004 to two options presented by
the City:
Option 1: Improve the alley using base stone material for a minimum distance of
30 feet east of the sidewalk to a width that will accommodate her parking needs
while allowing a minimum alley width of 10 feet for traffic and emergency
vehicular access. This improvement is to be at her personal expense.
Option 2: Recommend to the City Council in favor of the petitioners to install "No
Parking" signs in the alley that extends from Nevada Street to its easterly
terminus.
On October 23, 2004, Ms. Brown indicated in writing that Option 1 was her
preferenèe. She also requested that the City send the necessary information for
her to obtain an estimate and that the City notify the petitioners of her preference.
On November 3, 2004, City staff met with the petitioners to explain the two
options and the Option 1 preference by Ms.' Brown. Also City Code of
Ordinances 32-261 (12) was provided: "No person shall stop, stand, or park a
vehicle except when necessary to avoid conflict with other traffic or in compliance
with the directions of a police officer or traffic control device, in any of the
following places: Upon any street or in any alley in any part of the city in such a
manner or under such conditions as to leave available less than ten feet (10') of
the width of the roadway of such street or alley for the free movement of
vehicular traffic, except when necessary obedience to traffic regulations or traffic
signs, or signals of a police officer."
Although this alley improvement will accommodate the minimum 10-foot alley
width for the free movement of vehicular traffic, the petitioners still maintain that
"No Parking" signs need to be installed in the alley that extends from Nevada
Street to its early terminus.
ACTION TO BE TAKEN
It is recommended that the City allow Ms. Brown to improve the alley using base
stone material for a minimum distance of 30 feet east of the sidewalk to a width
that will accommodate her parking needs while allowing a minimum alley width of
10 feet for traffic and emergency vehicular access. This recommendation is
contingent that she has sole responsibility for the expense and that it will be
completed prior to using a portion of the alley for parking. If the 10-foot parking
compliance is not maintained, Police will be responsible for its enforcement
based on the City's current ordinance, which does not require the posting of "No
Parking" signs.

We the undersigned property owners, are petitioning for a "No Parking" sign
in the alley that extends from Alpine to Nevada behind the Kingsley and Resnick
residences. It is necessary to keep this alley open 24 hours a day in case of
emergency.
On the south corner of the alley when driving in, that property is owned by
Helen Brown, 349 Nevada, Lot 5-007. Whenever her son Gary comes home(he
lives in Wisconsin) there is a problem. This has been an ongoing dispute with
parking in the alley, thus blocking it. Mr. Brown feels he can park his car or
car and trailer in the alley and other people should be able to drive around him.
However only approximately 10 ft. or less ofthe alley is driveable. Police have
been called many, many times and the most recently on Aug. 1,2004 the police
suggested we petition for a "No Parking" sign in the alley to correct the problem.
That alley is the only access the property owners of Lots 28-015,29-016,2-006
have to get into their garages or parking area.
All the petitioners listed have property abutting the alley in question,

To Whom It May Concern,
I, Helen Brown, fomlally request to speak at the city council meeting
Monday November 15th, 2004. I request a small amount of time to voice
concerns in changing the alley between 394 and 430 Nevada St. from a
parking area to a non parking area. I represent a small number of Dubuque
citizens who wish that the alley remain a parking area. Thank you for your
time and hope to see you on Monday.
