Cedar Cross Road and Center Grove Drive Sidewalk Installations
In April, 1998, the City Council directed staff to proceed with plans, specifications
and assessments for the installations of public sidewalks in certain areas. Two
locations were scheduled for the year 2000:
1.
Cedar Cross Road, from Center Grove Drive to 280 feet north of
Nightengale Lane; and
2.
Center Grove Drive, from Wacker Drive to Cedar Cross Road.
In 1997, a petition containing 32 signatures asked for a sidewalk in this area.
Currently there is sidewalk only across the west side of the Cedar Cross Bridge,
and properties abutting Tamarack Court and Obeche Court with Cedar Cross Road
frontages. The cost of installing sidewalks in the balance of this area is
approximately $85,000. A large portion of this frontage would be along currently
undeveloped properties which would be extremely difficult to sustain development.
The cost would be spread over 12 property owners, some with large frontages; and
because of possible lack of benefit, there may be a considerable amount of City
share as deficiencies on this section of sidewalk.
With respect to Center Grove Drive, there is sidewalk currently along only about 15
percent of this street. The cost of the remaining sidewalks would be about
$90,000, with an approximate $35,000 retaining wall needed behind the Dubuque
Inn and the West Clock Tower properties. The cost of the retaining wall would be
spread over the 18 property owners along the entire length of the project.

proceed with the preparation of plans and specifications for a public hearing.

INTRODUCTION
At the April 20, 1998 Council meeting, the City Council directed staff to proceed with
the plans, specifications, and assessments for the installation of public sidewalks at
each of the following areas:

Since that time, on August 3, 1998, the City Council approved the installation and
assessment for the one section of sidewalk on Pennsylvania Avenue from Vizaleea
Drive to Embassy West. This project has been completed. The second section of
sidewalk, however, on Pennsylvania from Embassy West to Radford was not approved
for construction.
At a public hearing of July 6, 1999, the Council rejected the proposal to install
sidewalks along John F. Kennedy, from Spring Valley to Asbury Road, which had
earlier been given preliminary approval. Objections from adjacent property owners
cited a lack of pedestrian usage in the area, excessive assessment costs, and lack of
benefit as some of the reasons for objecting to the installation of sidewalks on John
F. Kennedy Road.
The original schedule in 1998 also established calendar year 2000 as the construction
year for the Cedar Cross Road and Center Grove Drive sidewalks. Currently there is
sidewalk only across the west side of the Cedar Cross Bridge, and properties abutting
Tamarack Court and Obeche Court with Cedar Cross Road frontages. The cost of
installing sidewalks in the balance of this area is approximately $85,000. A large

With respect to Center Grove Drive, there is sidewalk currently along only about 15
percent of this street. The cost of the remaining sidewalks would be about $90,000,

West Clock Tower properties. The cost of the retaining wall would be spread over the
18 property owners along the entire length of the project.
All of the above estimates have assumed little or no grading work behind the sidewalk,
except at the Dubuque Inn and the Clock Tower West property. Should slopes require
additional grading behind the sidewalks on private property, easements would need to
be secured from these property owners as part of these projects. These easements
would need to be either secured through negotiations or the process of eminent
domain.
RECOMMENDATION
City staff is requesting preliminary direction from City Council as to whether to
develop full plans, specifications, and the preparation of preliminary special
assessments for these two sidewalk construction projects, given the denial of the John
F. Kennedy Road project.
In its deliberations, I would remind the City Council that both Cedar Cross Road and
Center Grove Drive were petitioned for in March, 1997, by Mary Schumacher of 457
Shinoak Court. The request included 32 other petitioners in the Cedar Lake
Subdivision located directly off of Cedar Cross Road.
ACTION TO BE TAKEN
The City Council is requested to give direction to City staff on whether to proceed
with the preparation of plans, specifications and special assessments for the
installation of public sidewalks on Cedar Cross Road, from Center Grove Drive to 280
Feet North of Nightingale Lane; and on Center Grove, from Wacker Drive to Cedar
Cross Road.

Dear Mayor Duggan and Council Members,
We, the residents of Cedar Lake neighborhood, petition that you require sidewalks to be
installed on Cedar Cross Road north and south of the Cedar Cross Road Bridge and
continuing up the hill going south on Cedar Cross Road and also on Center Grove Road,
There is a sidewalk on the Cedar Cross Bridge, but no connecting walkway either north
or south of the bridge.
With the area growing in residential and commercial development, there is no pedestrian
access to walk or run safely to areas such as, Warren Plaza, Kennedy Mall, Inn Plaza, etc.
Due to increased traffic and the speed of traffic, this makes walking along the curb very
unsafe.
Since our previous letter of March 31, 1997, there is now further construction in our
immediate area such as, the Woodland Apartments for senior citizens and the development
of the Hamel property on the west side of Cedar Cross Road. We feel it is imperative that
direction come ITom the city council for sidewalks to be mandated, for the safety and
well-being of all residents living in and visiting our city.

FACTORS WARRANTING SIDEWALK INSTALLATION
CONSIDERA nONS:

Potential use of proposed sidewalks. Are there attractions such as long flat grade for walking, jogging,
strolling, etc. which wnuld increase the pedestrian usage.
A school is located in area which creates pedestrian traffic for proposed sidewalks.
Park is located in the area which creates pedestrian traffic for the proposed sidewalks.
A bus route or bus stops abut the proposed sidewalk area creating additional pedestrian traffic.
Alternative routes for accessing the area or site. Are there walks on other side of street? Is there a safe
route for pedestrians due to street width? Is the site located such that access is limited or nonexistent for
pedestrians?
Development of lots adjacent to tbe proposed route is signigicant. If and how much has development
increased whicb would create pedestrian traffic?
Area has developed and improvements will fill in existing walk network. Existing walking routes have
gaps whicb would be filled in by the proposed sidewalk.
Curb and gutter is present on proposed route. Sidewalk grades are determined from the curb and therefore
installation of sidewalk requires curb and gutter to be in place.
Proposed area is in the Five Year Program. If the proposed area for sidewalk installation is in the Five
Year Capital Improvement Project list the sidewalks could be addressed at time of the street project. This
would alleviate problems if the street resurfacing/reconstruction would change street grades or sidewalks
would be included in the street project with more efficient use of construction funds.
Level of vehicle traffic on street adjacent to proposed sidewalks. Traffic counts of street fnr proposed
sidewalk can range from high, medium, or low which may affect pedestrian safety.
Intersections and streets served by the proposed walks are multi-lane. Is traffic centered in street with
available space to the sides or are all lanes utilized by vehicles?
Elevated speed of vehicles traveling on street adjacent to proposed sidewalks. How much of an impact is
the speed of vehicles when considering safety of pedestrians if walks are or are not installed?
OTHER CONSIDERA nONS:
Per linear foot cost is not unusual. Are there such items as retaining walls, extensive grading, landscaping
or other circumstances that would be needed to facilitate the installation of tbe proposed sidewalks thereby
increasing the cost to the abutting owner?
Back yard frontages of lots would be affected by proposed route. If a rear lot abuts to street both front and
rear are considered frontages and would require sidewalks. Are there lots abutting the proposed sidewalk
route that would be affected in this way and what are circumstances related to maintenance of these walks.
Other unusual circumstances that need to be considered such as right-of -way availability, tree removals,
guardrail relocation or other situations which sbould be factored into the decision for the proposed
sidewalk installation.
