Additional Housing CommissionerPrepared by: David Harris, City of Dubuque Housing Services, 1805 Central Ave, Dubuque, lA, 319 589-4239 Ordinance No. 28-00 An ordinance amending the Code of Ordinances, City of Dubuque, Iowa, Chapter 15, Community Development, by: repealing sub-Section 15-23(a) relating to membership of the Housing Commission and adopting in lieu thereof a new sub-Section 15-23(a) relating to membership ofthe Housing Commission; and adopting a new sub-Section 15-23(e) relating to membership on the Commission by a member of a Section 8 programs resident board representative. Now, therefore, be it ordained by the City Council of the City of Dubuque, Iowa: Section 1. Section 15-23(a) of the City of Dubuque Code of Ordinances is hereby repealed, and the following new Section 15-23(a) is hereby adopted in lieu thereof: (a) The Housing Commission shall be comprised of a membership often (10) persons. Section 2. Section 15-23 of the City of Dubuque Code of Ordinances is hereby amended by adding the following suh-section (e): Option 1 (e) One member of the Commission shall be a person who is a recipient;oftenant-based rental assistance under Section 8 ofthe United Stated Housing Act of 1937 (42 USC 1437f) whose name appears on a lease of Section 8 property and who is eighteen years of age or older. If such member ceases to be a recipient of rental assistance under Section 8, the term of such member shall be deemed terminated and a new member who meets the requirements ofthis paragraph (e) shall be appointed for the remainder of the term. Option 2 (e) One member of the Commission shall be a person who is a recipient of tenant- based rental assistance under Section 8 of the United States Housing Act of 1937 (42 USC 1437f) whose name appears on a lease of Section 8 property and who is eighteen years of age or older. If such member ceases to be a recipient of rental assistance under Section 8, the term of such member shall be deemed terminated and a new member who meets the requirements of this paragraph (e) shall be appointed for the remainder ofthe term. Such member shall only be permitted to take part in decisions related to the administration, operation and management of Section 8 tenant- based rental assistance programs. Section 3. Van Milligen, City Manager SUBJECT: Requirement for Additional Housing Commissioner The U.S. Department of Housing and Urban Development requires that a Section 8 Program tenant be appointed to the Housing Commission. . The City Council has the choice of giving this 10th position on the Commission full member status or only allowing them to vote on Section 8 Program matters. CITY OF DUBUQUE, IOWA MEMORANDUM 2 March 00 To: Mike ~\\illigen, City Manager From: David Harris, Housing Services Department ( Re: Requirement for additional Housing Commissioner Introduction The purpose ofthis memorandum is to request the City Council to approve an amendment to Chapter 15 ofthe Code of Ordinances, regarding composition of the Housing Commission. Discussion The HUD Quality Housing and Work Responsibility Act of 1998 contained a provision for requirement of Section 8 Program tenants on the "governing board" of every public housing agency. The implementing rule has now been published and we are required to bring our program into compliance. In Dubuque, the "public housing agency" is the City of Dubuque and the governing board for Section 8 Programs is the Housing Commission. The requirement ofthe Act is that we form a resident advisory board, comprised of Section 8 tenants; and that these advisory board members are offered the opportunity to elect a representative to serve on the governing board, i.e., Housing Commission. The Act further specifies that the "resident board member" must be allowed to take part in decisions related to the administration, operation and management of Section 8 tenant-based rental assistance programs. Finally, the resident board member may be excluded ITom taking part in matters of the governing board not related to the administration ofthe Section 8 Programs. This means that we are required to provide for the membership of a Section 8 tenant on the Housing Commission, subject to appointment by the City Council. Further, it provides us an option: this tenant representative may be appointed to "full" Commissioner status, or could be appointed with voting authority only over matters of administration of the Section 8 Programs. Accordingly, two options have been prepared for Council review, both amending Chapter 15, Community Development, Article II. Low-Rent Housing, Division 2. Housing Commission: . . . Option I: (at Sec 15-23. In either case, an additional amendment to the ordinance will be required, to expand the membership of the Housing Commission, ITom nine to ten members, at Sec 15-23(a) as follows: The Housing Commission shall be comprised ofa membership often (10) persons.
