Senators - HR 1000 on FAA , City Manager's Office 50 West 13th Street Dubuque, Iowa 52001-4864 (319) 589-4110 (319) 589-4149 FAX D~BmE ~Y4-~ March 13, 2000 The Honorable Tom Harkin 731 Hart Senate Building Washington, D.C. 20510 Dear Senator Harkin: It is my understanding that legislation has been introduced which may preclude major new expansions of existing landfills within six miles of the nearest airport runway. The bill is H.R. 1000 and concerns FAA Re-authorization. The provisions of the bill concerning the expansion of landfills would be very detrimental to the City of Dubuque and the surrounding areas which use the landfill. The runway of the Dubuque Regional Airport is approximately 5 miles from the Dubuque Metropolitan Area Solid Waste Agency Landfill. The short and long range plans for the landfill include expansion for two reasons. First, it is very difficult to site new landfills and second, there is a strong trend toward regionalization of landfill operations. The City of Dubuque encourages you to oppose legislation which limits the ability of the Dubuque Area Landfill to expand in the future. Thank you for your consideration on this issue. Prior legislation required cities to undertake notice and public hearing requirements for all potentially affected property owners whose property may be acquired by the city. This put cities in the position of notifying a broad range of properties which may not be subject to condemnation. House File 2528 corrects this problem by limiting the scope of the notice and hearing requirements to only condemnations involving agricultural lands. Another change in the condemnation laws in 1999 was to require the deliberation of compensation commissions to operate under the open meetings law as a governmental body. This put commissioners in the position of deliberating in public in decisions which may pit neighbor against neighbor. House File 2528 addresses this problem by allowing deliberations to be conducted in private, such as those used by juries, All evidence and testimony presented, however, will still be conducted in open session.
