Amending Urban RevitalizationRESOLUTION NO. 106-00 RESOLUTION AMENDING RESOLUTION NO. 57 - 2000 BY REMOVING CERTAIN RESIDENTIAL PROPERTY TAX EXEMPTION APPLICATIONS FROM THE LIST OF APPROVED APPLICATIONS FOR TRANSMITTAL TO THE CITY TAX ASSESSOR Whereas, by Resolution 57-2000, the City Council approved a list of residential property tax exemption applications and directed that said list be forwarded to the City Assessor as provided in Chapter 404 of the Code ofIowa, the Urban Revitalization Act; and Whereas, the City Assessor has advised that certain of the applications may not qualify for exemption under the City's Urban Revitalization Plans which limit exemptions to residential property and to commercial property consisting of three or more residential units with not less than seventy-five percent of the space used for residential purposes; and Whereas, upon review by the Housing Services Department, it has been determined that the following applications do not qualify for exemption under the City's Urban Revitalization Plans: West II th Street Urban Revitalization Area J. Thomas Zaber, 1005 Locust Street Washington Street Urban Revitalization Area Upholsterers Credit Union, 1402 White Street Pablo and Julie Ramirez, 1564 Central Avenue Maximo Damaso, 1876 & 1876 Yo Central Avenue NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the above-described tax exemption applications do not meet the eligibility requirements of the City of Dubuque's Urban Revitalization Plan. Section 2. That Resolution No. 57 - 2000 is hereby amended by deleting the above- described tax exemption applications from said Resolution as approved by the City Council. Section 3. This action has been requested by the City Assessors Office. DISCUSSION On February 21, the City Council approved this year's application for urban revitalization tax exemptions, Following that action, the Council resolution was forwarded to the City Assessors Office as provided by state law. The Assessors Office reviewed the properties approved by the Council and found that four of the properties may not qualify under the City's urban revitalization plans because they do not meet the definition of eligible property. Eligible properties include residential properties and commercial properties containing three or more residential units with at least 75% of the space used for residential purposes. The Housing Services staff was requested to reinspect these properties to determine ifthey are eligible, As a result of the reinspections, we have found that these four are not eligible. The appropriate action is therefore to delete these properties from the list approved by the City as provided in the attached resolution. RECOMMENDATION I recommend that the City Council amend its previous action on this year's urban revitalization tax exemption applications by deleting the four properties identified in the attached resolution from the list of approved applications. ACTION STEP The Action Step is for the City Council to adopt the attached resolution
