ORDINANCE NO. 64-04
AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADOPTING A NEW
CHAPTER 8 ARTS AND CULTURAL AFFAIRS ESTABLISHING THE ARTS AND CULTURAL
AFFAIRS ADVISORY COMMISSION
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City of Dubuque Code of Ordinances is hereby amended by adopting the
following new chapter:
Chapter 8
Arts And Cultural Affairs
Article I General
Sec. 8-1 - 8-10. (Reserved)
Article II Arts and Cultural Affairs Advisory Commission
Sec. 8-11. Created:
There is hereby created the Arts and Cultural Affairs Advisory Commission to have such powers
and responsibilities as hereinafter provided.
Sec, 8-12. Mission:
The mission of the Commission is to build the community of Dubuque through arts and cultural
programs by developing visibility, funding, audiences, information and partnerships.
Sec. 8-13. Goals:
The goals of the Commission shall be as follows:
(1) To promote, educate and create awareness for arts and cultural activities in the Dubuque
Community;
(2) To develop and increase the market for arts and cultural activities in the Dubuque
Community;
(3) To facilitate and convene partnerships for arts and cultural activities in the Dubuque
Community; and
(4) To develop funding options and allocate budgeted funding for arts and cultural activities in
the Dubuque Community.
Sec. 8-14. Purpose:
The purpose of the Arts and Cultural Affairs Advisory Commission shall be to plan, promote
and encourage programs to further public awareness of, accessibility to, participation in and
support for the artistic and cultural development of the city and to make recommendations to
the City Council regarding the establishment of arts and cultural policies and programs, the
expenditure of budgeted City funds on arts and cultural activities and the implementation of
programs for arts and culture.
Sec. 8-15- Powers:
The Commission shall have the following powers:
To act in an advisory capacity to the City Council in all matters pertaining to the arts and
cultural environment of the City;
To hold regular public meetings and maintain a written record of its proceedings;
To make recommendations to the City Council on the allocation of budgeted city funding for
arts programs and services;
To recommend to the City Council applications and solicitations for grant, gifts and donations
from individuals, groups, organizations and agencies, both private and public, for any purpose
consistent with the purposes of the Commission;
To make recommendations to the City Council regarding city sponsorship of public programs
to further the development of public awareness of and accessibility to arts and culture programs
and activities;
At the request of the City Council, to work with area organizations on broad-community issues
in which a cultural perspective is relevant and desirable; and
To engage in comprehensive planning for the cultural development of the City.
Sec. 8-16. Cooperation With Other Agencies:
The Commission shall cooperate with the Dubuque Cultural Alliance and other groups
interested in the promotion and implementation of arts and cultural activities which are in the
best interest of the city,
Sec-8-17. Solicitation And Acceptance Of Donations:
The Commission may solicit and otherwise accept donations and gifts of money, personal and
real property and personal services on behalf of the city. All such donations and gifts received
shall become the property of the city for the general use of support of arts and cultural
programs of the city as determined by the City Council unless such items have been designated
by the donor for specific purposes.
Sec. 8-18- Membership, Appointment:
(a) The Commission shall comprise seven (7) members. The initial term of four of the
members shall be for three years and the initial term of three of the members shall be two
years. Thereafter, all terms shall be three (3) years. The expiration date for all terms of office
shall be June 30 of the appropriate year.
(b) Four members of the Commission shall have significant knowledge and demonstrated
interest in one or more areas of the arts including music, dance, literature, visual arts, theater,
folk arts, media arts, design, arts education or be a member of the Dubuque Cultural Alliance.
Two members shall be from the business and professional community, one of who lives or
works in the Cultural and Entertainment district. One member shall be at-large who lives or
works outside the Cultural and Entertainment district.
(c) Vacancies caused by death, resignation or otherwise shall be promptly filled by the City
Council for the unexpired term of office.
Sec-8-19- Attendance:
(a) Members of the Commission shall attend at least two-thirds (2/3) of all regularly scheduled
and held meetings within any consecutive twelve (12) month period. If any member fails to
attend such prescribed number of meetings, it shall be grounds for the Commission to
recommend to the City Council that the position be declared vacant and a replacement
appointed.
(b) The attendance of all Commission members shall be entered upon the minutes of all
meetings by the secretary.
Sec. 8-20. Compensation:
Members of the Commission shall serve without compensation except for reimbursement of
necessary expenses.
Sec. 8-21. Organization:
At the initial meeting of the Commission and at the first meeting in July of each year, the
Commission shall elect a chairperson, a vice-chairperson and a secretary to serve one-year
terms of office. All officers shall be eligible to serve successive terms of office.
Sec. 8-22. Meetings:
(a) The Commission shall hold a minimum of six meetings a year. Meeting shall be held on
the fourth Tuesday of each month at 4:30 p.m.
(b) Special meetings may be called by the chairperson or at the written request of three (3)
members.
(c) All meetings shall be called and held in conformance with the Iowa Open Meetings Law.
(d) A copy of the minutes of all regular and special meetings of the Commission shall be filed
with the City Council within ten (10) working days after each such meeting.
(e) Four (4) members of the Commission shall constitute a quorum for the transaction of
business. The affirmative vote of at least four (4) members shall be necessary for the adoption
of any resolution.
Sec- 8-23. Rules And Regulations:
The Commission shall adopt such rules and regulations to govern its internal organization and
procedure as it may deem necessary and which are not in conflict with this Chapter or this Code
of Ordinances. Copies of such rules and regulations upon their adoption shall immediately be
provided to the City Council.
Sec. 8-24. Administrative And Other City Policies:
All administrative, personnel, accounting, budgetary and procurement policies of the city shall
govern the Commission in all of its operations.

BOARD/COMMISSION APPLICATION FORM
Individuals serving on Boards and Commissions play and important role in advising the Council on matters of interest to our community and its future.
The City Clerk's Office, City Hall, 50 W. 13th St., Dubuque, IA accepts application for any Board and/or Commission at any time, and that application stays active for one year from the date of receipt in the Clerk's Office.
At the appropriate regularly scheduled council meeting, applications will be submitted to the City Council for their review and applicants are encouraged to address the Council stating their reasons for wanting to serve on this particular commission. Applicants will be advised when the application is being presented. Appointment to the Board or Commission will be made at a later meeting. Applicants will then be notified as to the outcome of the Council's action. If not appointed at that time, this application will be resubmitted, as needed, as long as the application is active (unless the applicant advises they are no longer interested)

See Attached Resume & Addendum - I am a recently returned Dubuquer. I grew up in Dubuque and then lived in other communities (Iowa City, Madison, WI, New York, Chicago, Evanston), before returning to Dubuque in September. My mother still lives here in a house my dad built on Mineral
Street in 1963. I attended Lincoln Elementary School, Washington Jr. High School, and Dubuque Senior High, as well as a couple of years at the University of Dubuuqe.
I have always had an interest in the cultural arts and the various creative events that characterize a town and its people. My own talents lie in writing, but my sister is quite
musical and played in the Dubuque Symphony some years ago under Dr. Mahmoud, and my father was an artist, photographer, and chess player. I myself am an explorer of the Mines of Spain area, the River, and the bluffs, and am interested
in architecture, books, music and museums.
I am especially excited by the vitality and the energy that everyone is experiencing right now in Dubuque - with the development of the old downtown district, the creation of public space along the Mississsippi,
the coming together of creative individuals behind the Dubuque365 effort, the new Museum and Aquarium, and the ConventionCenter. Certainly the energy of defining cretive centers - such as the Mississippi Mud Pottery studios, its bistro, the attached
Outside the Lines Art Gallery, and the Yoga Studio - exemplifies the synergy of the cultural arts. It shows how a few individuals can combine vision, outreach, and create a venue for music, art display, and community gatherings, utiliziong various talents
and transforming the community for the greater good and sparking other ventures.
The beauty of cultural partnerships and growth is that such developments in Dubuque draw in people of all ages, from many different backgrounds and areas, and end up supporting and suggesting yet other endeavors. That is the power of culture and arts - together with
business and education - to attract people, to please and entertain, to enrich the quality of life for the individual and the community. And we are witness to this very energy right now. Let's build on this energy with ideas, creativity, and partnerships. Nothing can stop our growing
success if we carry forth our vision.
WHAT CONTRIBUTIONS CAN YOU MAKE OR STATE REASON FOR APPLYING:
See attached addendum - I have reviewed the goals of the Advisory Commission and support them:
Promoting, educating awareness of arts and cultural activities; developing the market for arts and cultural activities;
Creativing partnerships of various kinds;
Developing funding options.
Further, the Arts & Cultural commission can ensure that Dubuque's attractions and business and civic communities support each other over time and
Build on the identity of Dubuque's landmarks as historic and cultural anchors, and work to strengthen and expand the base of the cultural district;
Work with a vision of the "heart of the city"
Build on the concept of the artist as asset;
Be creative and think broadly about culture, an inclusive term that incorporates civic, commercial and cultural worlds
As for my experience, I have worked ten years as a librarian in academic and public libraries, ten years in the nonprofit sector giving grants to creative individuals (in the MacArthur Foundation's famous "genius grants" programs), and seven years in educational textbook publishing (grades 6-12).
Through all of these endeavors, I have gained a rich perspective of communities, individuals, and the institutions and the cultural-business partnerships that can transform them.
I live in an apartment within the area of the new Cultural District, at 198 MainSt. (3F) above the Main Galley (Bob & Cynthia Byrne's building)., Since moving back to Dubuque, I worked on a retrospective exhibit of art by my father Tali Berzins at the Rocco Buda Gallery in October 2004. In November I started working full-time as
editorial director at Julien's Journal, the magazine that covers the richness of events happening in the Tri-State ara. I am pleased to work with Dubuque Dave Rusk, and am learning a lot from him and this job, which chronicals the full spectrum of cultural events in th is vital Dubuque Tri-State ra. I am excited to be situated within the
community this way.
As to other interests, I hope to be inducted into the Dubuque Kiwanis Club on Monday, November 29, andI have begun attending meetings of the Dubuque County Fine Arts Society.
In addition to my life and work experience, I feel that I bring the asset of a fresh perspective to the issues at hand, along with the desire to participate in the communityand civic life of Dubuque. I have the time, the interest, the ideas and the experience to make a good team member on this new Arts and Cultural Affairs Commission.

ExperienceÆducation:
With a Masters in Communication and a B.A. with double majors in Public Relations and Writing. the arts peppered my
academic pursuits and continue to season my career choices and hobbies.
.Being lucky enough to grow up in a culturally nurturing environment, exposure to the arts was prenatal; I come from a
long line of accomplished musicians and artists. Having appeared on stage in well over 50 theatrical productions, I fell
in love with the spotlight at age seven. An adept vocalist, I played piano, saxophone, and violin in grade school, and
continued with strings-adding cello to the mix - in high schooL In college I joyously labored over four years of voice
lessons, concert choir, and art classes- I still paint with several exhibited and purchased works to my credit. After graduat-
ing from college, I found the world of advertising where the written word exists in harmony with its artistic presentation.
As a graphic designer known for bold color choices and creative uses of typography, I am in continual demand to jury
graphic arts competitions- My own work has garnered numerous awards for both copy and design. In addition to owning
and running big fish creative since 2002, I currently teach composition as an adjunct through NIce and doubled my career
responsibilities as a fulI-time graphics arts Instructor at the University of Dubuque (2002-2003).

Of the stated areas for which the City of Dubuque is looking for arts experience/knowledge as outlined in Section 8- 18 b
of the Arts and Cultural Ordinance, I luckily possess exposure to each of these areas (music, dance. literature, visual arts,
theater, folk arts, media arts, design, and arts education) with vast participation and expertise in most. I view the arts as
a reflection of our community. The Dubuque area possesses an incredible amount of talent. It is my hope that this com-
mission serves as an interactive gateway to bring the arts to people of all ages by promoting our local offerings first and
rounding out the community's overall arts exposure with national and international artists second-

As Music Director of the Dubuque Symphony Orchestra, I have worked for years to promote the arts
in our community: leading performances, creating new partnerships and collaborations, creating
new concert and educational programs, teaching about music, attending events of many other arts
organizations, and, in general, serving as an ambassador for the arts in Dubuque and beyond. I feel
that this is an especially exciting time for Dubuque, with new development and growth in many
areas. The arts have kept apace with this growth with many outstanding, quality programs in all
fields. The arts have also proven to be an important part of our economic development and a vital
contributor to the education of our youth. I believe our city should be viewed as a thriving mecca for
arts and culture, and that this is something for which every Dubuquer can feel pride. As a resident
of downtown Dubuque, I am especially excited about creating a thriving cultural corridor. Serving on

1970s. My first job after graduation was as Director of the Old Jail Gallery, My education includes a
BA in art and art history from Clarke, a MA in art history from the University of Illinois and a MFA in
studio art from the University of Wisconsin-Madison- I have been teaching at Clarke for 20 years and
now chair the art department. My own artwork has been exhibited throu9hout the United States. I bring

literature; I attended the Manhattan School of Music in NYC for an additional year. I have a minor
in art history.

budget cultural organizations. I chose to move to Dubuque from the East Coast because of the

I have been a member of the Loras College Arts and Lecture Committee for the past eight years-
As a member 1 have overseen the college's film series. I reb'Ularly teach a course on film and
havepuhlished and presented papers 011 film, mus.ic, and art. I also play trumpet in severa!
commlmity groups, including Tri-State Wind Symphony, Big Band Express, and Loras Wind
Ensemble. I am a member of the 81. Raphael Cathedral Education Committee. I have a Ph.D. in
Communication trom the University of Utah and have been a Dubuque resident for ten years-
What Contributions. Can You Make or State Reason for Applying:
1 would like to see an increased presence ofthe arts in Dubuque, especially some of the more
non"trarlitional art'S.. I would like to see the community challenged and emlcated more in terms
of what can be considered art and culture. Film is the first thing that comes to mind. Our
dependence and expectations on film as an entertainment medium has detracted from the power
that cinema has as a form of artistic expression. Likewise I would like to see a presence of more
modern art in ternlS of music, theater, graphic arts, etc-

graduate education is in business, with an emphasis in marketing. I subscribe to
the symphony, visit art galleries (and purchase from them), attend plays, listen to

While my passion is the arts, my career is marketing. I'm an excellent strategist,

ARTICLE I. IN GENERAL
Sec. 27-1. Definitions':
When used in this chapter, the following
terms shall have the meanings ascribed herein
unless the context otherwise requires:
Commission: The Dubuque human rights
commisBion created by article II of thiB chapter,
Court: The Iowa district court in and for
Dubuque County,
Covered Entity: An employer, employment
agency, labDr organization, or joint labor man-
agement committee.
Direct Threat: A significant risk to the health
or safety of others that cannot be eliminated by
reaBDnable accommodation.
Disability: With respect to a person:
(1) A physical or mental impairment which
substantially limits one or more of such
person's major life activities, and the
condition of a perBon with a poBitive
human immunodeficiency virus test re-
sult, a diagnosiB of acquired immune
deficiency syndrome, a diagnosis of ac-
quired immune deficiency syndrome
related complex, or any other condition
related to acquired immune deficiency
syndrome. The incluBion of a condition
related to a positive human immunodefi-
ciency virus test reBult in the meaning of
"disability" under the provisions of this
chapter doeB not preclude the application
of the provisions of thiB chapter to condi-
tions reBulting from other contagiouB or
infectious diseaBes;
(2) A record of having such an impairment;
or
(3) Being regarded as having such an im-
pairment, but such term does not include
current, illegal use of or addiction to a
§ 27-1
controlled substance as defined in section
102 of the controlled Bubstances act (21
USC 802) or chapter 204 of the Iowa
Code.
Drug: A controlled substance, as defined in
scheduleB I through V of Bection 202 of the
controlled substances act,
Employee: An individual employed by an
employer,
Employer: The state or any political subdivi-
sion, board, commission, department, institu-
tion, Dr school diBtrict thereof, and every other
perBon employing employees within the Btate.
Employment Agency: Any perBon undertaking
to procure employeeB or opportunities to work
for any other person or any perBon holding such
perBon or itself to be equipped to do BO.
Familial Status: One or more individuals
(who have not attained the age of 18 years)
being domiciled with:
(1) A parent or other perBon having legal
custody of such individual or iIidividualB;
(2) The designee of such parent or other
perBDn having Buch custody, with the
written permiBsion of Buch parent or
other person; or
(3) The protections afforded against diBcrim-
ination on the baBiB of familial status
shall apply to any person who is. preg-
nant or is in the proceBB of securing legal
custody of any individual who has not
attained the age of eighteen (18) years.
Labor Organization: Any organization which
exists for the purpose in whole or in part of
collective bargaining, of dealing with employees
concerning grievanceB, termB or conditions of
employment, or of other mutual aid or protec-
tion in connection with employment,
Person: An individual, partnership, associa-
tion, corporation, legal repreBentative, trustees,

Public Accommodation: Each and every place,
eBtablishment, or facility of whatever kind,
nature, Dr class that caterB or offers serviceB,
facilities, or goods for a fee or charge to non-
members of any organization or asBociation
utilizing the place, establishment, or facility;
provided, that any place, establishment, or
facility that caterB or offers services, facilities,
or gOOdB to the nonmemberB gratuitDusly Bhall
be deemed a public accommodation if the ac-
commodation receives any governmental sup-
port or subsidy. "Public accommodation" shall
not mean any bona fide private club Dr other
place, establishment, or facility which is by its
nature distinctly private, except when Buch
distinctly private place, establiBhment, or facili-
ty caters or Dffers Bervices, facilitieB, or gDods to
the nonmembers for a fee or charge or gratu-
itously, it Bhall be deemed a public accommoda-
tion during such period.
"Public accommodation" includes each Btate
and local government unit or tax supported
district of whatever kind, nature, or claBs that
offers serviceB. facilitieB, benefitB, grants or
goods to the public, gratuitouBly or otherwise.
ThiB paragraph shall not be construed by nega-
tive implication or otherwise to restrict any
part or portion of the preexisting definition of
the term "public accommodation" (contained in
the definition above).
Readily Achievable: Easily accompliBhable
and able to be carried out without much diffi-
culty or expense. In determining whether an
action iB readily achievable, factors to be con-
sidered include:
(1) The nature and cost of the actiDn needed
under this chapter.
(2) The overall financial reBources of the
facility or facilities involved in the ac-
tion; the number Df perBons employed at
such facility; the effect on expenseB and
reBources, or the impact otherwise of

such action upon the operation of the
facility;
(3) The Dverall financial resources of the
covered entity; the overall Bize of the
busineBs of a covered entity with respect
to the number of its employees; the num-
ber, type, and location of its facilities;
and
(4) The type of operation or operations of the
covered entity, including the composi-
tion, structure, and functions of the work
force of such entity; the geographic Bepa-
rateness, adminiBtrative or fiBcal rela-
tionship of the facility or facilities in
question to the covered entity.
Reasonable Accommodation: May include:
(1) Making existing facilities used by em-
ployees readily accessible to and usable
by individuals with disabilities; and

(2) Job reBtructuring, part time or modified
work schedules, reaBsignment to a va-
cant position, acquisition or modification
Df equipment or deviceB, apprDpriate
adjuBtment or modificationB of examina-

As a member of the Dubuque Human Rights commission, I believe we should
continue to be primarily concerned with lonf!:-term f!oals and not with the details and day-
to-day administrative tasks by which those goals are to be achieved. While helping with
the direction, control and inspiration of the commission, through careful establishment of
policies, I hope to further facilitate positive articulation of the values that should drive
our commission's services to the Dubuque community.
Although as a commission, we plan to add more goals as they become more
prevalent within our community, the past goals and objectives, along with the following
four goals, have kept our commission involved in educating and communicating to the
public the mission of our commission. That mission is to work to eliminate
discrimination and promote the Qualitv of/ire for everv resident in the city of Dubuque.

our reputation as a world destination. Dubuque as a "Masterviece On The Mississippi"
will soon be a reality that truly resonates throughout the world. Thank you so much for

At the beginning of July, National Service Inclusion Project (NSIP)
send out highlights from the landmark survey conducted by National
Organization on Disabilities. The survey indicated that "Americans with
disabilities are at a critical disadvantage compared to other Americans
in ten key areas of life." Below is a recap of some of the highlights:
Highlighted statistics:
* Only 35 percent of people with disabilities reported being employed
full or part time, compared to 78 percent of those who do not have disabilities.
* Three times as many live in poverty with annual household incomes
below $15,000 (26 percent versus 9 percent).
* People with disabilities remain twice as likely to drop out of high
school (21 percent versus 1 0 percent).
* They are twice as likely to have inadequate transportation (31 percent
versus 13 percent), and a much higher percentage go without needed
health care (18 percent versus 7 percent).
Since the survey has been published, there have been different reactions
from the disability community. We would like to share one of those
reactions with you this week.

As you may know, on November 18,2002, the Iowa Civil Rights Commission passed a resolution reaffirming its
recommendation to the Iowa Legislature and other Iowa jurisdictions that sexual orientation be added to the list
of protected classes in the Iowa Code. On January 7, 2003, The Iowa Civil Rights Commission pre-filed a bill
with the Iowa Legislative Bureau that would make discrimination based on sexual orientation illegal in Iowa.
Five Iowa cities (Ames, Cedar Rapids, Davenport, Des Moines, and Iowa City) as well as numerous businesses,
universities, and colleges have adopted non-discrimination language in their employment policies and local
ordinances- As representatives of our local Human Rights/Civil Rights Commissions, and in support of our Iowa
Civil Rights Commission, we encourage your commission to consider recommending the inclusion of sexual
orientation in the non-discrimination language in your city code.
Nationwide thirteen states and the District of Columbia ban employment discrimination based on sexual
. orientation in both the public and private sectors. Nine additional states prohibit discrimination in public sector
employment. Currently, two hundred thirty nine cities and counties have laws that prohibit sexual orientation

If your community currently investigates complaints, adding sexual orientation to your non-discrimination
ordinance will not greatly increase your caseload. Iowa City has had sexual orientation as a protected category
in its Human Rights Ordinance since 1977. Over the last 26 years, Iowa City has received only one to three
complaints of discrimination each year based on sexual orientation.
Historically, communities that have adopted anti-discrimination legislation have tended to have relatively few
complaints- "A 1993 survey of states having civil rights laws that include sexual orientation depicted similar
findings, with complaints of antigay discrimination making up less that 5% of all complaints_" (Source: Kevin
Sack, "Gay Rights Hurt by Lack of Uniform Protections," New York Times, March 28, 1993) Although the
number of complaints has been small, a suîv'ey indicated that one of the many positive effects of the legislation
was the recognition that discrimination based on sexual orientation is legally wrong- (Source: Private Lives,
